9.42 Street

Design

9.42.010 Right Of Way And Surface Width

Road right of way and surface widths shall be as required by table 1, as follows:

Note: "Slope" refers to the slope on which the road is proposed, not the grade of the road itself. Where one-way circulation systems are used, the developer shall install "one-way" and "do not enter" signs in the appropriate locations at all intersections. (Ord. 2000-02, 3-3-2000)

9.42.020 Right Of Way Treatment

The entire required right of way should not be cleared. Grading should be confined to the minimum area necessary for construction of a properly drained road surface. Where a road passes through timber or brushy vegetation that creates a wildfire hazard, the entire right of way shall be treated as a fuel reduction area where trees or brush are thinned to a density where crowns do not overlap or touch and ladder fuels are removed. Construction slash shall be removed from the right of way along with other fuels. (Ord. 2000-02, 3-3-2000)

9.42.030 Surface Construction

Road surfaces shall be laid over a properly compacted subgrade and consist of:

  1. A subbase of a minimum six inches (6") of coarse aggregate.
  2. A base of a minimum two inches (2") of crushed coarse aggregate.
  3. Roads must be paved with a minimum of two inch (2") plant mix pavement. (Ord. 2000-02, 3-3-2000)

9.42.040 Minimum Design Standards Required

All plats submitted pursuant to the provisions of this title, and all subdivision improvements and facilities done, constructed, or made in accordance with said provisions shall fully comply with the minimum design standards set forth in this title; provided, however, that any higher standards adopted by any highway district, state highway, or department of health agency shall prevail over those set forth herein. 9.42.050 Dedication

Arterial and collector streets shall be dedicated to the public in all cases. All other streets shall also be dedicated for public use. (Ord. 2000-02, 3-3-2000)

9.42.060 Location

Street and road location shall conform to the following:

  1. When major street plans have been adopted, subdivision streets shall conform to such plans.
  2. Local or minor streets shall be so arranged as to discourage their use by through traffic.
  3. The arrangement of streets shall provide for the continuation of existing streets from adjoining areas into new subdivisions, unless otherwise approved by the commission/council and the department having jurisdiction over such streets.
  4. The streets shall be arranged in proper relation to topography so as to result in usable lots, safe streets, and acceptable gradients.
  5. The city does not have alleys at the present time; therefore, any reference to alleys will not be included in this document until such alleys have been established.
  6. Where a subdivision shunts or contains an arterial street, it shall be required that there be frontage roads approximately parallel to and on each side of such arterial street, and that there be such other treatment as is necessary for the adequate protection of residential properties and to separate through traffic from local traffic.
  7. Cul-de-sac streets shall not be more than seven hundred fifty feet (750') in length and shall terminate with an adequate turnaround having a minimum radius of sixty feet (60') for right of way.
  8. Half streets shall be prohibited except where unusual circumstances make such necessary to the reasonable development of a tract in conformance with this title and where satisfactory assurance for dedication of the remaining part of the street is provided. Whenever a tract to be subdivided borders on an existing half or partial street, the other part of the street shall be dedicated within such tract.
  9. Reverse frontage streets are streets that are parallel with and one lot away from major arterial streets and which provide frontage access for lots backing up to major arterial streets. (Ord. 2000-02, 3-3-2000)

9.42.070 Specifications

  1. Right Of Way Widths: Street and road right of way widths shall conform to any adopted plans and the rules of the appropriate departments having jurisdiction. Right of way lines of intersecting or connecting streets shall be connected with curves having at least a twenty five foot (25') radius. Minimum right of way standards are as follows:

  2. Grades: Street grades shall not exceed nine percent (9%) on either local or collector streets, and no street grade shall be less than one-half of one percent (0.5%).
  3. Alignments: Street alignments shall be as follows:
    1. Horizontal Alignment: When street lines deflect from each other by more than ten degrees (10°) in alignment, the centerlines shall be connected by a curve having a minimum radius of seven hundred feet (700') for arterial streets, three hundred feet (300') for collector streets, and one hundred fifty feet (150') for minor streets. Between reverse curves on minor streets, there shall be a minimum tangent distance of one hundred feet (100') and on collector and arterial streets, two hundred feet (200').
    2. Vertical Alignment: Minimum sight distances shall be two hundred feet (200') for minor streets and three hundred feet (300') for collector streets, and five hundred feet (500') for arterials.
  4. Improved Surface/Improved Standards: Width of improved surface/improvement standard shall be as follows:
    1. All streets as defined, unless already existing and paved, shall be improved to a width of not less than twenty four feet (24').
    2. The level of improvement shall meet or exceed the improvement standard of the county or state road or highway that it adjoins. In the case where a subdivision adjoins a county or state road or highway at two (2) locations and the standards of the county or state road or highway differ, the subdivision shall be required to meet the stricter standard of the two (2). In no case may the local roads within the subdivision be less than the Fremont County and/or Madison County standards set for paved surfacing, whichever may apply, no matter what the condition or standard of the road to which it connects.
    3. Said street improvements shall be completed within six (6) months of the sale of the first lot in the subdivision, and shall at least meet minimum Fremont County and/or Madison County standards for the quality and type of paving, chip or seal surfacing, whichever may be required. Building permits will be issued upon lots with unimproved streets; however, an occupancy permit (allowing the structure to be occupied) will not be issued until all subdivision improvements are completed and accepted by the city.
    4. If the streets of the subdivision are not improved to the highest standard (paving) at the time of development, the city reserves the right to require higher standards in the future through a local improvement district authorized under I.C. 50, chapter 17. The developer and subsequent owners in a subdivision without paved streets will be required to sign a deferment contract with the city agreeing to participation in a local improvement district at the city's request. The subdivision final plat shall so note these conditions and the deferral contract requirement.
  5. Storm Drainage Runoff: Subdivisions and the streets within them shall make provisions for storm drainage runoff as required by the council.
  6. Road And Bridge Specifications: The width of all the roads, whether private or public, must be a minimum of twenty four feet (24') wide, or as wide as may otherwise be dictated by the rules, regulations or ordinances in force and effect at the time such road is constructed. The setback for each structure built adjacent to a private road will be required to be fifty feet (50') from the center of the private road. All private roads that are not through roads will be required to have a turnaround with a minimum of a sixty foot (60') radius. All bridges on private roads must be at least twenty four feet (24') wide and structurally designed for emergency vehicles. All roads must be built as all weather roads, as shown in Fremont and Madison County road standards (whichever applies), with a gravel base and select gravel topcoat. (Ord. 2000-02, 3-3-2000)

9.42.080 Street Names

The naming of streets shall conform to the following:

  1. Street names shall not duplicate any existing street name or number, except where a new street is a continuation of an existing street; street names that may be spelled differently but sound the same as existing streets shall not be used.
  2. All new streets shall be named in accordance with the existing city numbering system currently used for all city streets. Assignment of numbers will be provided by the Teton city clerk. (Ord. 2000-02, 3-3-2000)

9.42.090 Intersections

  1. Streets shall intersect at ninety degrees (90°) or as closely thereto as possible, fifteen degrees (15°) for at least fifty feet (50') before the intersection, and in no case shall streets intersect at less than eighty degrees (80°).
  2. Clear sight distance requirements shall remain as previously exist in the comprehensive plan1.
  3. No more than two (2) streets shall cross at any one intersection.
  4. "T" intersections may be used whenever such design will not unduly restrict the free movement of traffic.
  5. Street centerlines shall be offset by a distance of at least one hundred twenty five feet (125'), except for intersections with arterials, where it shall be two hundred feet (200').
  6. A nearly flat grade with appropriate drainage slopes is desirable within intersections. This flat section shall be extended fifty feet (50') to one hundred feet (100') each way from the intersection. An allowance of two percent (2%) maximum intersection grade in rolling terrain, and four percent (4%) in hilly terrain, will be permitted. (Ord. 2000-02, 3-3-2000)

9.42.100 Pedestrian Walkways

Right of way for pedestrian walks in the middle of long blocks will not be addressed at this time. (Ord. 2000-02, 3-3-2000)

9.42.110 Easements

Unobstructed utility easements shall be provided along front lot lines, rear lot lines and/or side lot lines when deemed necessary; total easement width shall not be less than twelve feet (12'), unobstructed drainageway easements shall be provided as required by the council. The subdivider shall consult with the appropriate utility or other public service providers to determine the size and location of easement. (Ord. 2000-02, 3-3-2000)

9.42.120 Blocks

Every block shall be so designed as to provide two (2) tiers of lots, except where lots back onto an arterial street, natural feature, or subdivision boundary; blocks shall not be less than four hundred feet (400') long in all cases. (Ord. 2000-02, 3-3-2000)

9.42.130 Building Setback Line

No building shall be built within fifty feet (50') of arterial streets and within fifty feet (50') of all other streets or road rights of way unless otherwise regulated by state or county government. (Ord. 2000-02, 3-3-2000)

9.42.140 Lots

Lots shall conform to the following:

  1. Side lot lines shall be essentially at right angles to straight streets and shall conform to the radius of curved streets.
  2. Narrow, deep lots shall be avoided.
  3. Corner lots shall have sufficient extra width to permit appropriate building setback from both streets or orientation to both streets.
  4. Uninhabitable area including land subject to flooding or which shall otherwise be deemed to be uninhabitable shall not be platted for residential purposes or for any other use that may increase or create a danger to health, life or property or which may increase or create a flood hazard. Such land within a subdivision shall be set aside for other use such as parks or other open spaces.
  5. Backup lots shall back into such features as freeways, arterial streets, shopping centers, or industrial properties, except where there is a separate frontage street provided. Such lot shall contain a landscaped easement (planting strips) along the rear at least twenty feet (20') wide in addition to the utility easement; the intent of which is to minimize noise and protect outdoor living areas. Lots extending through a block and having frontage on two (2) local streets shall be prohibited.
  6. All regular lots shall have at least one hundred ten feet (110') of frontage upon a publicly dedicated street. Variances may be permitted for an approved planned unit development.
  7. There shall not be more than one dwelling constructed on each lot. (Ord. 2000-02, 3-3-2000)
