9.12 Zoning

Districts And Map

9.12.010 Scope

This chapter creates zoning districts and overlay zoning districts for use in the city, and adopts an official map of those districts. It also provides rules for the interpretation of zoning district boundaries. (Ord. 2000-02, 3-3-2000)

9.12.020 Zoning Districts Established

The following zoning districts shall be established for use in the city:

  1. Residential zoning district: See TCC 9.14 for the permitted and conditional uses, and the standards for development in this zoning district.
  2. Village center zoning district: See TCC 9.16 for the permitted and conditional uses, and the standards for development in this zoning district.
  3. Higher density residential zoning district: See TCC 9.18 for the permitted and conditional uses, and the standards for development in this zoning district.
  4. Flood hazard overlay: See TCC 9.20 for the additional requirements imposed in this overlay district. (Ord. 2000-02, 3-3-2000)

9.12.030 Official Zoning Map

The "official zoning map of Teton" is adopted, by reference, as part of this title. A dated copy of that map, certified to be correct by the signature of the mayor, shall be maintained for public inspection at the office of the administrator. (Ord. 2000-02, 3-3-2000)

9.12.040 Zoning District Boundaries

  1. Zoning district boundaries shall be as shown on the "official zoning map of Teton", except that the boundaries of the flood hazard overlay shall be as shown on the federal emergency management agency's flood insurance rate maps of Fremont County and Teton, Idaho.
  2. Any person who disputes the location of a zoning district boundary, as interpreted by the administrator, may appeal the administrator's decision using the appeals procedure of TCC 9.08.020. (Ord. 2000-02, 3-3-2000)

9.12.050 Structure Of Zoning Districts

Each zoning district established by this title has the following elements:

  1. A statement of purpose, which briefly explains the reason why that district was established;
  2. A list of permitted uses, for which a class I permit is required, unless the proposed use or building is exempted from the requirement for a permit by TCC 9.10.010, TCC 9.10.020, or TCC 9.10.030;
  3. A list of special permit uses, for which a class II permit is required;
  4. Specification standards, which regulate the placement of structures;
  5. Performance standards, which regulate other aspects of development; and
  6. Mapping guidance: There is a section in each of the chapters that establish a zoning district entitled "Mapping Of District" which provides guidance, based on the purpose of that district and the comprehensive plan, for responding to request for zoning map amendments. (Ord. 2000-02, 3-3-2000)
