40 - NONCONFORMING USES, LOTS, AND STRUCTURES

This chapter is intended to conditionally permit continuance of uses and structures which do not conform to the terms herein but were in lawful existence prior to the adoption of this title.

A.
A nonconforming use or structure may be continued and shall be maintained in reasonable repair but shall not be altered or expanded unless the expansion or alteration decreases the nonconformity as determined by the town clerk-finance director.
B.
Structures for which a building permit has been issued prior to the adoption date of the ordinance codified in this title shall be allowed to be completed under the terms of the building permit.

Discontinuance of a nonconforming use or structure, or a combined nonconforming use and structure for a period of one hundred eighty (180) days shall cause permanent prohibition of the use or structure, or use and structure in combination, except in conformance to the provisions of this title.

A nonconforming use may be changed to another nonconforming use if the proposed use would be less nonconforming than the original use as determined by the planning commission.

If a nonconforming structure or a structure containing a nonconforming use is destroyed by accident or by natural disaster it may be reconstructed within one year of its destruction; provided:

The structure and/or use shall not exceed its level of nonconformity prior to its destruction and shall meet all building area, height, setback and all other density and building requirements pursuant to this title to the maximum extent which is reasonably possible.

Lots that do not meet minimum area requirements required herein but were in lawful existence prior to the adoption of the ordinance codified in this title may be developed; provided, that all other requirements pursuant to this title are satisfied.
