In order to carry out the intent and purpose of this Zoning Ordinance, the City of Uhrichsville, Ohio is hereby divided into the following districts:
"R" - Residence District
"B" - Business District
"I" - Industrial District
"B and LI" - Business and Light Industry District
"T" - Trailer Park

1149.02 ZONING MAP.
The Zoning Map, upon which are drawn the boundaries of the Districts designated in Section 1149.01 of this Zoning Ordinance, and identified by the title "City of Uhrichsville, Ohio Zoning Map", together with the legends, words, figures, letters, symbols and explanatory matter thereon, is hereby declared to be part of the Zoning Ordinance, and shall be known as the "Zoning Map". The date of the adoption of the Zoning Map, and the signatures of the President of Council and Mayor of the City of Uhrichsville, Ohio, attested by the Clerk of Council and bearing the seal of the City under the following words: "THIS SEAL IS TO CERTIFY THAT THIS IS THE OFFICIAL ZONING MAP REFERRED TO IN SECTION 1149.02 OF THE ZONING ORDINANCE OF THE CITY OF UHRICHSVILLE, OHIO" shall appear thereon.
If, in accordance with the provisions of this Zoning Ordinance, changes are made in District Boundaries or other matter displayed on the Official Zoning Map, within five (5) business days after such change has been approved and adopted by the Council, an entry on the Official Zoning Map shall be made as follows:
"On (date), Ordinance No.13-12 duly adopted by official action of the Council of the City of Uhrichsville, Ohio, the following change(s) was/were made: (briefly describe change(s))".
The original and one (1) copy of the Official Zoning Map shall be maintained and kept up to date. An updated copy shall be on public display in the City of Uhrichsville Municipal Building; whereas the original and any and all updates thereof shall be displayed in the Clerk of Council's Office, accessible to the public and it shall be the final authority as to the current zoning status of lands, buildings and structures in the City.

1149.03 DISTRICT BOUNDARIES.
The Boundaries of the zoning districts listed under 1149.01 of this Zoning Ordinance are shown on the Oficial Zone Map described in Section 1149.02. This map, together with all explanatory data thereon including all changes and amendments as hereinafter provided, shall be incorporated and made a part of this Zoning Ordinance. (Ord. 13-12. 1149.04 UNCERTAINTY OF BOUNDARY LOCATION.
Where uncertainty may exist relative to the boundaries of the various districts as shown on the Official Zoning Map, the following rules shall apply:
(a) Boundaries indicated as approximately following the center line of streets, alleys or highways shall be construed to follow the centerlines;
(b) Boundaries indicated as approximately following platted lot lines shall be construed as following such lot lines;
(c) Boundaries indicated as approximately following the Corporation line of the City of Uhrichsville, Ohio shall be construed as following such Corporation line;
(d) Boundaries indicated as following railroad tracks shall be construed to be midway between the tracks;
(e) Boundaries indicated as approximately following the center line of streams, rivers, canals, lakes or other bodies of water shall be construed to follow such center lines; and in the event of changes of location in such physical features the boundary shall be construed as moving with the actual center line.
(f) Boundaries indicated as parallel to the extension of features indicated in Section 1149.04 subsections (a) through (e) of this Zoning Ordinance shall be so construed. Distances not specifically indicated on the Official Zoning Map shall be determined by the scale said map.
(g) Where physical or cultural features existing on the ground are at variance with those on the Official Zoning Map, or in other circumstances not covered by Section 1149.04 Subsections (a) through (e) of this Zoning Ordinance, the Board of Zoning Appeals shall interpret the district boundaries.

1149.05 ZONING UPON ANNEXATION.
Whenever any parcel of land is annexed to the City of Uhrichsville, Ohio, one of the following conditions shall apply:
(a) Land that is zoned previous to annexation by the Township or the County shall be classified as being in whichever district of this Zoning Ordinance that most closely conforms with the zoning that existed prior to annexation; such classification to be recommended for an interim period by the Planning Commission to the Council and the Council shall approve the same after a public hearing.
(b) Land that is not zoned prior to annexation shall be classified in the same manner into whichever district of this Zoning Ordinance that most closely conforms with the existing use of the annexed area.
(c) In all cases, within ninety (90) days after the effective date of the annexation, the Planning Commission of the City of Uhrichsville, Ohio shall recommend to the Council the appropriate permanent zoning district(s) for the annexed land. The Council shall follow the prescribed procedure to amend the Official Zoning Map as set forth in Chapter 1177 of this Zoning Ordinance.

1149.06 PROHIBITED USES.
The following uses are prohibited anywhere within the territorial limits of the City of Uhrichsville, regardless of district:
(a) No shipping or storage containers of any size shall be placed in any "R" Residential District area for any purpose. "Shipping or storage container" shall be defined as a compartment in which freight is placed (as on a train or ship) for convenience of movement.
(b) No shed or storage building shall be used for temporary or permanent dwelling purposes. "Shed or storage building" shall mean any building, or part thereof, primarily used for storing or sheltering goods, wares, or merchandise, whether freestanding or attached to another structure.
(c) No tents of any kind shall be used for permanent dwelling purposes. "Tent" means a temporary structure enclosure or shelter constructed of fabric or any other pliable material. As used in this section only, "permanent" means any amount of time over five (5) twenty-four (24) hour periods, whether consecutive or non-consecutive.
(d) No travel trailers or house vehicles of any kind shall be used for permanent dwelling purposes. "Travel trailers" or "house trailers" shall have the same definition as set forth in Ohio Revised Code Section 4501.01. As used in this section only, "permanent" means any amount of time over five (5) twenty-four (24) hour periods, whether consecutive or non-consecutive.

1149.99 PENALTIES.
Penalties for violations of Chapter 1149 of this Zoning Ordinance shall be as follows:
(a) The first violation of the provisions of this Zoning Ordinance or failure to comply with any of its requirements shall constitute a minor offense. Upon conviction thereof any person may be fined one hundred dollars ($100.00).
(b) A second violation of a different type, of the provisions of this Zoning Ordinance or failure to comply with any of its requirements shall constitute a misdemeanor of the fourth degree. Upon conviction thereof any person may be fined not more than two hundred fifty dollars ($250.00) or imprisoned for not more than thirty (30) days or both, and in addition shall pay all costs and expenses involved in the case.
(c) If the same violation occurs a second time within the same year the offense shall constitute a misdemeanor of the third degree and upon conviction the fine shall not be more than five hundred dollars ($500.00) or imprisonment for not more than sixty (60) days or both, and in addition the offender shall pay all costs and expenses involved in the case. If the same violation occurs a third time within the same year the offense shall constitute a misdemeanor of the second degree and upon conviction the fine shall be not more than seven hundred fifty dollars ($750.00) or imprisonment for not more than ninety (90) days or both, and in addition the offender shall pay all costs and expenses involved in the case.
(d) Each day any such violation continues after receipt of a violation notice shall constitute a separate offense. The owner or tenant of any building, structure, premises, or part thereof, and any architect, builder, contractor, agent, or other person who commits, participates in, assists in, or maintains, such violation, may each be found guilty of a separate offense and suffer the penalties herein provided. Nothing herein contained shall prevent the City from taking other such lawful action as is necessary to prevent or remedy such violations.
(e) In addition to the penalties set forth above, the owner of any contiguous or neighboring property may institute a suit pursuant to the provisions of Ohio Revised Code Section 713.13.
