The purpose of this district is to provide an integrated collection of structures and uses designed to supply a majority of the needs of those engaged in the provision of business and service to the community as a whole. (Ord. 13-12. Passed 8-9-12.)
1157.02 PERMITTED PRINCIPAL USES.
(a) Any generally recognized retail business, service establishment or processing uses as follows:
(1) The Permitted Principal uses listed in Section 1157.02; except no residences shall be permitted in first floor spaces of existing and/or new structures or buildings;
(2) Apparel shops including all specialty shops of all sorts;
(3) Shops selling automotive parts and accessories;
(4) Banks, loan companies, stock exchange offices and other financial-related businesses and services;
(5) Commercial recreation businesses such as bowling alleys or movie theaters;
(6) Department stores;
(7) Drug stores;
(8) Eating and drinking establishments or other businesses serving food and/or beverages;
(9) Food stores including supermarkets and all types of specialty food stores such as bakeries, candy stores and similar products;
(10) Furniture and appliances, including but not limited to rugs, floor coverings, draperies, sewing machine shops, used furniture, office equipment, office supplies and similar products;
(11) Gift shops, card shops, camera shops, record and other recorded media shops and similar uses;
(12) Hardware and related shops such as wallpaper, paint and similar products;
(13) Antique shops;
(14) Professional and other offices including but not limited to Chambers of Commerce, automobile clubs, medical practioners of all types, lawyers, architects, engineers, insurance agents, realtors, trade unions, post office and utility office;
(15) Publishing and printing operations and services;
(16) Repair shops including but not limited to shoes, watches, small and large appliances, electronic equipment, audio-visual equipment;
(17) Service shops including but not limited to barber, beauty, laundry, dry cleaner and similar uses;
(18) Travel agencies;
(19) Variety stores;
(b) Public and semi-private buildings and privately owned, for profit, proprietary schools such as but not limited to:
(1) Churches, except on the first floor of existing and/or newly constructed buildings;
(2) Fraternal organizations;
(3) Library;
(4) Offices of Municipal, State or Federal government;
(5) Parking garages and parking lots;
(6) Nursery schools and day care centers, provided that all applicable Governmental requirements are complied with.
(c) Other uses, which in the opinion of the Planning Commission of the City of Uhrichsville are similar to the above uses indicated as being permitted. The Planning Commission may also consider essentially custom manufacturing activities which in its opinion shall have the following characteristics:
(1) Benefit from a central location and appropriate to the "B" District
(2) Do not create any objectionable influences such as but not limited to noise, dust, odors either foul or benign and heavy truck traffic;
(3) Involve products characterized by a high ratio of value to bulk so that truck traffic is kept to a minimum.
(d) Off-street parking facilities provided according to the provisions of Section 1141.24 of this Zoning Ordinance. (Ord. 13-12. Passed 8-9-12.)
1157.03 ACCESSORY USES.
(a) All Accessory uses permitted in the Central Business District are permitted Accessory uses in the "B" Business District
(b) Signage, provided it meets the regulations at Section 1141.27:
(1) No more than two (2) identification signs shall be permitted for each PP use provided such signs do not exceed four (4) SF in area
(2) All signs shall be attached to a building wall, marquee, canopy or other similar weather cover.
(3) No sign shall be attached to or project from the roof of a building, nor shall any sign extend beyond the top end of the wall, marquee, canopy or weather cover to which it is attached.
(4) No portion of any sign shall project outward more than one (1) foot from the face of the wall, marquee, canopy or weather cover to which it is attached.
(5) Illuminated signs shall be permitted except for those that flash off and on.

1157.04 CONDITIONAL USES.
Conditional uses in the "B" Business District are as follows:
(a) New construction residential dwellings for 2, 3 or more families, including but not limited to duplexes, triplexes and apartment buildings, provided that there is review of the plan for such construction by the Planning Commission and approval by the Council of the City of Uhrichsville and all requirements of Section 1141.24(b) are met.
(b) Automobile wash facilities which are at least partially enclosed in a building.
(c) Building services and supplies, including lumber yards.
(d) Mortuary establishments.
(e) Gasoline Service Stations under conditions prescribed in Chapter 1141 and fulfillment of all State and federal regulations pertaining to such operations.

1157.05 PROHIBITED USES.
The following uses are prohibited in any "B" Business District:
(a) Adult Entertainment Facilities as defined by Ordinance 4-02, passed 3-14-2002.
(b) Automobile and/or other wrecking or salvage yard
(c) Storage, storing or baling of junk, scrap metal, paper or rags
(d) Warehouse, except as an accessory to a retail of wholesale store and located on the same premises
(e) New Single-family residential construction
(f) Any use not listed herein as Permitted, Accessory or Conditional shall be prohibited.
(g) All residences on the first floor of existing and/or new structures or buildings.

1157.06 YARD REQUIREMENTS.
In a "B" Business District the following yard areas shall be provided:
(a) Front Yards: There shall be a front yard of a minimum of twenty-five (25) feet from the R-O-W line of the lot to building or structure, including but not limited to porches, steps, decks, overhangs and outdoor HVAC units; or the front yard shall be in line with existing residences facing the same street.
The R-O-W line shall be as platted on the "official tax maps" of the City of Uhrichsville on file at the County Map Office. Said R-O-W line shall be shown on a scaled drawing of the lot and the location of the surveyor pins shall be indicated thereon. If the surveyor pins cannot be found the burden of cost to locate and mark same by a Registered Professional Surveyor shall be borne by the property owner.
(b)Side Yards: There shall be a side yard of a minimum of five (5) feet between any building or structure, including but not limited to porches, steps, decks, overhangs and outdoor HVAC units, erected and the property line of the premises on which such buildings or structures and/or appurtenance thereto are erected; however the side yard on the street side of a corner lot shall be the same front setback as any yard; where there is no alley, a wall or decorative fence at least five (5) feet high shall be placed along the boundary line of a side yard abutting a Residential District. (c) Rear Yards: Rear yards shall not be required excepting: Where a rear lot line of a "B" lot abuts a Residential District, there shall be a rear yard of twenty-five (25) feet for one (1) or two (2) story buildings, an additional one (1) foot of rear yard shall be provided for each two (2) feet of building height over twenty-five (25) feet, such yard may be measured from the centerline of an intervening alley. Where there is no alley, a wall or decorative fence at least five (5) feet high shall be placed along the boundary line of a rear yard abutting a Residential District.

1157.07 BUILDING HEIGHT REGULATIONS.
There shall be no specific height limitation in "B" provided, however, that prior to the issuance of a Zoning Permit for any structure which is planned to exceed thirty-five (35) feet in height, the Planning Commission shall make a finding that any such excessive height will not be detrimental to the public safety; to the light, air or privacy of any other structure or use currently existing or approved for construction.

1157.08 OFF-STREET PARKING.
In the "B" there are no requirements for providing a minimum number or amount of parking spaces. Section 1141.24 shall apply to accessory parking in this district.
