The intent of this district is to provide for manufacturing plants, assembly plants and warehouses in a restricted area in order to protect neighboring land uses from potentially harmful noise, odor, smoke, dust, glare or other objectionable effects and to protect streams, rivers and the air from pollution. 1165.02 PERMITTED PRINCIPAL USES.
In "B and LI" Business and Light Industry District land may be used and buildings and structures may be erected, altered or used for the following purposes:
(a) Rental storage units that are completely enclosed and equipped with a locking door;
(b) Any Principal use permitted in "B";
(c) Amusement parks;
(d) Billiards and pool halls;
(e) Golf driving ranges;
(f) Miniature golf ;
(g) Veterans' posts;
(h) Indoor archery ranges;
(i) Indoor firing ranges;
(j) Ice skating arenas indoors and outdoors;
(k) Roller skating;
(l) Commercial swimming pools;
(m) Commercial tennis courts;
(n) Apparel and other fabricated textile products manufacturing;
(o) Pharmaceuticals manufacturing;
(p) Fabricated metal products manufacturing;
(q) Food and kindred products manufacturing;
(r) Furniture and fixtures manufacturing;
(s) Lumber and wood products manufacturing;
(t) Paper and allied products manufacturing;
(u) Printing, publishing and allied industries;
(v) Professional, scientific and controlling instruments; photographic and optical goods; watches and clocks manufacturing;
(w) Miscellaneous plastic products manufacturing;
(x) Cut stone and stone products manufacturing;
(y) Glass and glassware (pressed or blown) manufacturing;
(z) Pottery, earthenware, porcelain and related products manufacturing;
(aa) Textile mill products manufacturing;
(bb) Jewelry, silverware and plated ware manufacturing;
(cc) Motion picture production;
(dd) Musical instruments and parts manufacturing;
(ee) Pens, pencils and other office and artists' materials manufacturing;
(ff) Signs and advertising displays manufacturing;
(gg) Toys, amusement, sporting and athletic goods manufacturing;
(hh) Other miscellaneous manufacturing excepting that which is dangerous by reason of fire, radiation or explosion, or injurious, noxious or detrimental to the surrounding neighborhood by reason of the possible emission of excessive dust, odor, fumes, gas, smoke, wastes, refuse matter, noise, vibration; or because of any other objectionable feature; or is now or in the future likely to be a hazard or nuisance to adjacent property or the community at large, as determined by the Zoning Inspector, Fire Marshal or Director of the Tuscarawas County, State of Ohio or Federal Health or environmental protection agencies;
(ii) Hotels and motels;
(jj) Drive-in movie theatres;
(kk) Any food and beverage related business for consumption on or off the premises.
(ll) General agricultural operations including crop or tree farming and truck gardening and the raising of farm animals and feeding lots; and required accessory buildings, pens or structures for farm animal or uses shall not be located closer than 300 feet to any residential commercial or industrial structure.

1165.03 ACCESSORY USES.
In "B and LI" District any building, structure, or shed necessary to the operation of a use listed in Section 1165.02 is permitted; required off-street parking per Section 1141.24; signs provided all requirements of Section 1141.27 are met.

1165.04 CONDITIONAL USES.
The following Conditional Uses are permitted in "B and LI" District:
(a) Dwellings and residences in existing buildings provided that they meet the conditions set forth in Chapter 1141 and subsections 1145.02(23) and (24).
(b) New construction of dwellings and residences provided that they meet the conditions set forth in Chapter 1141 and subsections 1145.02(23) and (24).
(c) Convalescent or Nursing Home provided that they meet the conditions set forth in Chapter 1141 and subsections 1145.02(23) and (24).
(d) Schools, be they public, private, for profit or not for profit provided that they meet the conditions set forth in Chapter 1141 and subsections 1145.02(23) and (24).

1165.05 PROHIBITED USES.
In the "B and LI" District the following uses shall be prohibited:
(a) Adult Entertainment Facilities as defined by Ordinance 4.02, passed 3-14-2002.
(b) Any use not specifically Permitted, Accessory or Conditional.

1165.06 YARD REQUIREMENTS.
In the "B and LI" District the following yard areas shall be provided:
(a) For all Principal Permitted Uses and Accessory Uses:
(1) Front Yards: There shall be a front yard of a minimum of twenty-five (25) feet from the R-O-W line of the lot to building or structure, including but not limited to porches, steps, decks, overhangs and outdoor HVAC units; or the front yard shall be in line with existing residences facing the same street.
The R-O-W line shall be as platted on the "official tax maps" of the City of Uhrichsville on file at the County Map Office. Said R-O-W line shall be shown on a scaled drawing of the lot and the location of the surveyor pins shall be indicated thereon. If the surveyor pins cannot be found the burden of cost to locate and mark same by a Registered Professional Surveyor shall be borne by the property owner.
(2) Side Yards: There shall be a side yard of a minimum of five (5) feet between any building or structure, including but not limited to porches, steps, decks, overhangs and outdoor HVAC units, erected and the property line of the premises on which such buildings or structures and/or appurtenance thereto are erected; however the side yard on the street side of a corner lot shall be the same front setback as any yard. (3) Rear Yards: All buildings and structures of any sort shall be located no closer than twenty-five (25) feet to a side lot line except where the property is adjacent to a railroad R-O-W and written approval from the railroad authorities and owners/lessees has been obtained to utilize a railroad spur for loading and unloading. 1165.07 BUILDING HEIGHT REGULATIONS.
There shall be no specific height limitation in the "B and LI" District provided, however, that prior to the issuance of a Zoning Permit for any structure which is planned to exceed thirty-five (35) feet in height, the Planning Commission shall make a finding that any such excessive height will not be detrimental to the public safety; to the light, air or privacy of any other structure or use currently existing or approved for construction.

1165.08 OFF-STREET PARKING.
In the "B and LI" District there are no requirements for providing a minimum number or amount of parking spaces. Section 1141.24 shall apply to accessory parking this district.
