CHAPTER 1153

“R” Residence District

1153.01 INTENT.

   The intent of this district is to provide an environment for predominantly low density dwellings plus certain other facilities which serve the residents living in the district. From time to time when medium to high density residential developments may be proposed, such developments may be permitted as a Conditional Use.

1153.02 PERMITTED PRINCIPAL USES.

   The following uses are permitted in "R" Residence District:
   (a)   One-family dwellings, not including trailers, mobile homes manufactured homes or other dwellings of a non-permanent or temporary nature;
   (b)   Churches and other similar places of worship provided such use is adjacent to a school or commercial area and access is by means of a collector street or thoroughfare not an exclusively residential street, lane or alley;
   (c)   Parks and playgrounds;
   (d)   Public and private schools, exclusive of proprietary colleges, universities and other for-profit higher learning institutions;
   (e)   Parish houses and convents in conjunction with churches or schools;
   (f)   Nursery schools and/or day care centers operated in a church building or other established house of worship;
   (g)   All off-street parking and access requirements set forth in Section 1141.24 Shall be met for all Permitted Principal Uses.

1153.03 ACCESSORY USES.

   In the "R" Residence District the following Accessory Uses are permitted:
   (a)   Private garages for the sole use of a person or persons residing in a residential dwelling, either attached or detached for the storage of vehicles;
   (b)   Home occupations, provided that all requirements of Section 1145.02 (58) are met
   (c)   Swimming pools for use by residents and guests only, provided that all requirements of Section 1141.13 are met
   (d)   Signs provided all requirements of Section 1141.27 are met
   (e)   A fence, hedge, enclosure wall, provided:
      (1)   A solid fence or wall shall not exceed a height of six (6) feet; and a hedge or solid fence on the streetline of a corner lot shall not exceed a height of three (3) feet;
      (2)   An ornamental fence exceeding five (5) feet in height shall have a ratio of solid portion to open portion not in excess of one to four.

1153.04 CONDITIONAL USES.

   The following uses are permitted in a "R" Residential District provided that a Conditional Use Permit is obtained from the Board of Zoning Appeals as provided in Section 1173.14.2 of this Zoning Ordinance, and further provided that all buildings permitted by such Conditional Use Permit shall be set back from all lot lines a minimum of three (3) feet for each one (1) foot of building height, as well as meet all the requirements as they relate to building codes of the City of Uhrichsville and the State of Ohio, screening from adjacent and abutting uses, setbacks, percentage of lot coverage and off-street parking spaces.
   (a)   New construction residential dwellings for 2, 3 or more families, including but not limited to duplexes, triplexes and apartment buildings, provided that there is review of the plan for such construction by the Planning Commission and approval by the Council of the City of Uhrichsville and all requirements of Chapter 1141 are met.
   (b)   Mobile Homes, House Trailers and Manufactured homes, provided that all provisions of Chapter 1317 of the Codified Ordinances of the City of Uhrichsville are met.
   (c)   Public recreation and community center buildings and recreation areas or buildings operated by membership clubs for the benefit of their members and not for gain; provided that any principal building, accessory building or outdoor swimming pool shall be located not nearer than 200 feet from any adjoining land zoned for a residential use.
   (d)   Public-owned or leased buildings, public utility buildings, transformer stations and sub-stations, and garages and maintenance buildings that are accessory uses to a Permitted or Conditional Use.
   (e)   Institutions or higher learning, libraries and museums.
   (f)   Golf courses, either publically or privately owned and operated.
   (g)   Public and private school facilities, excluding buildings which are used for instructional purposes.
   (h)   Cemeteries, when extensions of existing cemeteries.
   (i)   Garages for the storage of automobiles for those who reside in 2, 3 and more family dwellings.

1153.05 PROHIBITED USES.

   The following uses are prohibited in "R" Residential District:
   (a)   The sale of beer, wine and liquors for consumption on the premises
   (b)   Kennels as defined in Section 1145.02(62) of this Zoning Ordinance
   (c)   Any use not specifically permitted in this Chapter as Permitted, Accessory or Conditional;
   (d)   Trailer Courts as defined at Section 1145.02(115);
   (e)   The conversion of homes or residences per Ordinance 9-97; passed 8-28-97;
      (f)   Sexually Oriented Businesses as defined by Ordinance 4-02, passed 03-14-2002. (See Chapter 1197).

1153.06 LOT SIZE, LOT COVERAGE AND YARD AND REQUIREMENTS.

   In a "R" Residence District the following lot size and yard requirements shall apply:
   (a)   The minimum lot size is 4,800 square feet with a minimum frontage on a public street of forty (40) feet.
   (b)   There shall be a front yard of a minimum of twenty-five (25) feet from the R-O-W line of the lot to building or structure, including but not limited to porches, steps, decks, overhangs and outdoor HVAC units; or the front yard shall be in line with existing residences facing the same street.
The R-O-W line shall be as platted on the "official tax maps" of the City of Uhrichsville on file at the County Map Office. Said R-O-W line shall be shown on a scaled drawing of the lot and the location of the surveyor pins shall be indicated thereon. If the surveyor pins cannot be found the burden of cost to locate and mark same by a Registered Professional Surveyor shall be borne by the property owner.
   (c)   There shall be a side yard of a minimum of five (5) feet between any building or structure, including but not limited to porches, steps, decks, overhangs and outdoor HVAC units, erected and the property line of the premises on which such buildings or structures and/or appurtenance thereto are erected; however the side yard on the street side of a corner lot shall be the same front setback as any yard.
   (d)   The maximum percent of lot coverage for all buildings Permitted, Accessory and Conditional shall be 33%.
   (e)   To allow for development or redevelopment in an existing residential neighborhood owner's of lots that meet the minimum lot size may seek approval from the Board of Zoning Appeals for a variance of the 33% maximum lot coverage provided that the following conditions are met:
      (1)   Only a single-family home;
      (2)   Planned residence has at a minimum an attached, 1-car garage and the driveway to the garage has sufficient length for storage of 1 car behind the R-O-W line of the public sidewalk;
      (3)   All yard and setback requirements of this chapter are met.

1153.07 OFF STREET PARKING REQUIREMENTS.

   The regulations provided for in Section 1141.24 shall apply.
