9-1-2: EFFECT OF CHAPTER:
The provisions of this chapter are general in nature and affect the entire title. (Ord. 172-04, 3-2-2004)
9-1-3: SCOPE OF TITLE:
This title is designed and enacted in accordance with the general plan for the territory lying within the boundaries of the city:
A. To designate, regulate and restrict the erection, construction, reconstruction, alteration, location and uses of buildings and the uses of land for trade, business, industry, residence, recreation, public activities or other purposes;
B. To regulate and restrict the height, number of stories, size, bulk of buildings and other structures hereafter erected or altered;
C. To regulate and restrict the height, bulk and location of objects of natural growth where such objects are deemed to be hazardous to life or property;
D. To regulate and determine the size of lots, courts, yards and other open spaces, and the percentage of the lot that may be occupied;
E. To regulate the density and distribution of population; and
F. To divide the city into zones or districts of such numbers, shape or area as may be deemed best suited to carry out these regulations and provide for their enforcement. (Ord. 172-04, 3-2-2004)
9-1-4: DECLARATION OF PURPOSE:
The purpose of this title and for which reason it is deemed necessary and for which it is designated and enacted is to preserve and promote the health, safety, morals, convenience, order and the general welfare of the city, its present and future inhabitants and the public generally, and in particular:
A. To encourage and facilitate orderly growth and expansion;
B. To secure economy in governmental expenditures;
C. To provide adequate light, air and privacy to meet the ordinary or common requirements of happy, convenient and comfortable living of the inhabitants of the city, and to foster a wholesome social environment;
D. To enhance the economic well being of the city and its inhabitants;
E. To facilitate adequate provisions for transportation, water, sewage, schools, parks, recreation, open space and other public requirements;
F. To prevent overcrowding and the undue concentration of population;
G. To stabilize and improve property values; and
H. To encourage the development of an attractive and beautiful community. (Ord. 172-04, 3-2-2004)
9-1-5: EFFECT ON PREVIOUS ORDINANCES AND ZONING MAPS:
This title and the map entitled "Uintah City Zoning Map", which is part hereof, is hereby declared to be a comprehensive amendment to the zoning ordinance of the city. The existing zoning ordinance, together with all maps which are a part of the existing zoning ordinance, are hereby superseded and amended to read as set forth herein. This title shall be so interpreted upon all questions of construction and to questions of conforming or nonconforming uses, buildings and structures, and to questions as to the dates upon which such uses, buildings or structures become conforming and nonconforming. 9-1-6: INTERPRETATION:
In interpreting and applying the provisions of this title, the requirements contained herein are declared the minimum requirements for the purposes set forth, unless otherwise specifically stated. If, in the course of administration hereof, a question arises as to the meaning of any phrase, section or chapter, the interpretation thereof given by the planning commission shall be construed to be the official interpretation thereof. In the event that there is a need of further interpretation by any person, firm, corporation or official of the city, they shall submit the question to the appeal authority, which is authorized to interpret the title as provided herein. Where the question is still unsatisfied, the applicant may either apply for an amendment to this title to clarify the portion thereof which is in question or may file a petition with a court of competent jurisdiction for final interpretation. 9-1-7: EFFECT ON PRIVATE COVENANTS AND AGREEMENTS:
This title shall not nullify the more restrictive provisions of private covenants and agreements entered into between private persons, but shall prevail notwithstanding such provisions which are less restrictive. Enforcement of private covenants and agreements affects only the parties in interest and the responsibility therefor may not be assumed by the city or its agents. (Ord. 172-04, 3-2-2004)
9-1-8: EFFECT OF OTHER ORDINANCES AND REGULATIONS:
Whenever higher or more restrictive standards are established by the provisions of any other applicable statute, ordinance or regulation than are established by the provisions of this title, the provisions of such other statute, ordinance or regulation shall govern. (Ord. 172-04, 3-2-2004)
