CHAPTER 19

ANIMAL REGULATIONS

9-19-1: KEEPING OF ANIMALS OR FOWL:

   A.   Zones Permitted: In the RE20, RE20 R/R, RE50 and AG zones, animals and fowl may be kept for family use outside the dwelling as provided in this chapter.
   B.   Defined: For purposes of this chapter, the terms "animals or fowl" shall include domesticated animals not normally kept as household pets, such as horses, cows, llamas, sheep, goats, mink, turkeys, ducks, chickens, etc.
   C.   Applicability:
      1.   Wild, Dangerous Animals: The general regulations relating to wild and dangerous animals shall be regulated as provided in title 5, chapter 2 of this code.
      2.   Number, Types: Nothing in this chapter shall be construed as excusing a property owner from complying with any and all applicable laws regarding the number or types of household pets the owner may maintain. (Ord. 213-12, 11-13-2012)

9-19-2: AREA RESTRICTIONS:

The following area restrictions shall apply to the keeping of animals and fowl:
   A.   Distance To Buildings On Adjacent Lots: No animals or fowl shall be kept or maintained closer than twenty five feet (25') from main buildings on adjacent lots.
   B.   Distance To Main Building: No animals or fowl shall be kept or maintained closer than twenty five feet (25') from a main building on the same lot. (Ord. 213-12, 11-13-2012; amd. 2013 Code)
   C.   Enclosures: Any barn, stable, coop, pen, corral or enclosure for the housing or keeping of animals or fowl shall be kept, constructed or maintained not less than one hundred feet (100') from a public street and not less than twenty five feet (25') from any lot line. 9-19-3: NUMBER OF ANIMALS OR FOWL PERMITTED:

The number of animals or fowl permitted shall be governed by the following schedule, except that the number of pigs which may be kept is governed by subsection D of this section:
   A.   Dependent Young: Dependent young of an allowed animal may be kept in addition to these numbers, but only until the young becomes independent of their parents. (Ord. 213-12, 11-13-2012)
   B.   Number Based On Square Footage: For each twenty thousand (20,000) square foot lot space in RE20, RE20 R/R, RE50 or AG zones, a property owner shall be eligible to keep or house up to fifty (50) points worth of animals as shown on the following chart: (Ord. 213-12, 11-13-2012; amd. 2013 Code)
      1.   Points will be allowed only for whole increments of twenty thousand (20,000) square feet.
      2.   Examples:
         a.   The owner of a twenty thousand (20,000) square foot lot could keep fifty (50) points of animals.
         b.   The owner of a forty thousand (40,000) square foot lot could keep one hundred (100) points of animals.
         c.   The owner of a thirty thousand (30,000) square foot lot could keep animals worth fifty (50) points.
   C.   Points Assigned: Points are assigned to animals as follows:

   D.   Pigs: Pigs may be kept in the RE20, RE20 R/R, RE50 and AG zones only as follows: (Ord. 213-12, 11-13-2012; amd. 2013 Code)
      1.   Pigs may be kept only on lots of forty thousand (40,000) square feet or greater.
      2.   A property owner may keep one pig for each forty thousand (40,000) square feet of property in the lot.
      3.   Pigs must be kept in pens which are a minimum of two hundred feet (200') from a dwelling on an adjacent lot.
         a.   Examples:
            (1) The owner of a forty thousand (40,000) square foot lot may keep one pig, provided the owner complies with the other regulations of this subsection.
            (2) The owner of an eighty thousand (80,000) square foot lot may keep two (2) pigs, provided the owner complies with the other regulations of this subsection.
            (3) The owner of a sixty thousand (60,000) square foot lot may keep one pig, provided the owner complies with the other regulations of this subsection.
      4.   Any property included in the forty thousand (40,000) square foot calculation for keeping a pig may not be used for accumulating points to keep other animals or fowl under subsections A, B and C of this section.
         a.   Examples:
            (1) The owner of a forty thousand (40,000) square foot lot may keep one pig or one hundred (100) points worth of animals under subsections A, B and C of this section, but not both, provided the owner complies with the other regulations of this subsection.
            (2) A person with an eighty thousand (80,000) square foot lot, on the other hand, could keep one pig and fifty (50) points worth of animals as described in subsections A, B and C of this section, provided the owner complies with the other regulations of this subsection. 9-19-4: GENERAL REGULATIONS RELATING TO KEEPING OF ANIMALS AND FOWL:

   A.   Animal Control Generally: The general regulations relating to the keeping of animals and fowl shall be regulated as provided in title 5, chapter 2 of this code.
   B.   Responsibility For Damage: The owner of the property upon which the animals or fowl are kept shall be responsible for any damage which the animals or fowl cause to other property.
   C.   Keeping Other Animals: Persons wishing to keep an animal which is not described in the tables in subsection 9-19-3C of this chapter, or obviously comparable to an animal described in subsection 9-19-3C of this chapter, shall submit the matter to the planning commission.
      1.   The planning commission shall determine the category of animal or fowl from subsection 9-19-3C of this chapter to be assigned to each animal or fowl proposed to be kept.
      2.   The planning commission shall have no authority to create new categories, but must assign each animal or fowl to one of the existing categories.
      3.   The procedure for appeals shall be as provided in chapter 5 of this title. (Ord. 213-12, 11-13-2012)
