CHAPTER 16

FENCING AND WALL DESIGN REGULATIONS

9-16-1: BUILDING PERMIT REQUIRED:

Fences and walls exceeding six feet (6') in height, measured from ground level, shall require a building permit. (Ord. 172-04, 3-2-2004)

9-16-2: FENCES AND WALLS IN SUBDIVISIONS AND COMMERCIAL ZONES:

Fences and walls erected as part of developments in any zone shall comply with this fence and wall regulation. (Ord. 172-04, 3-2-2004)

9-16-3: HEIGHT RESTRICTIONS:

   A.   Measurement; Street Sides: Fence height shall be measured from the highest point of the fence/wall to ground level that has not been altered, specifically to maximize fence and wall height. Fence and wall heights on street sides of the property shall not exceed the maximum height as follows:

   B.   Interior Rear Or Interior Side Yard: Fences and walls within any required interior rear yard or interior side yard shall not exceed six feet (6') in height.
   C.   Grade Difference: When a fence or wall is located along a property line separating two (2) lots and there is a difference in the grade between the properties, the fence or wall may be erected or allowed to the maximum height permitted by the highest grade on the property line. The ground where the fence or wall may be erected shall not be bermed to increase maximum height of fences or walls.
   D.   Commercial Zones: Owners of property in commercial zones which border other zones shall erect structurally adequate walls eight feet (8') in height. (Ord. 172-04, 3-2-2004)
   E.   Open Fence Added; Prohibited Materials: An additional three feet (3') of open fence, such as wrought iron, may be added to the top of any fence along rear property boundaries for safety purposes. Barbed or razor wire is not allowed in RE20, RE50, RE20 R/R or RMH zones. (Ord. 172-04, 3-2-2004; amd. 2013 Code)

9-16-4: QUALITY OF CONSTRUCTION:

Fences and walls shall be constructed in a workmanlike manner and constructed according to industry standards. (Ord. 172-04, 3-2-2004)

9-16-5: MAINTENANCE OF FENCES AND WALLS:

All fences and walls shall be maintained in good repair. Areas along the wall or fence shall be maintained by the property owner. (Ord. 172-04, 3-2-2004)
