CHAPTER 8

AGRICULTURAL DISTRICTS

9-8A-1: PURPOSE AND LIMITATIONS:

   A.   Designate Farming Areas: The purpose of the AG Zone is to designate farming areas where agricultural pursuits and the rural environment should be promoted and preserved. The AG designation may also be affixed to properties at the time of annexation, in which case, the designation shall serve as a holding zone.
   B.   Prohibited Housing: This zone does not allow for basement houses, rentals, long and short term or mobile homes, nor does it allow for campers, travel trailers or recreational vehicles to be used for living purposes, except as provided for in chapter 15 of this title.
   C.   Tents: Tents are not allowed to be used for living purposes in the AG Zone, except that during the summer months, the residents of a house may use a tent for sleeping in the backyard of a residence; provided, that the residents may not sleep in the tent for more than four (4) consecutive nights.
   D.   Supplementary And Qualifying Regulations: All uses are subject to meeting the requirements of chapter 14 of this title. (Ord. 172-04, 3-2-2004; amd. Ord. 271-22, 7-5-2022)

9-8A-2: PERMITTED USES:

The following uses are permitted in the AG District:
Accessory building or use customarily incidental to any permitted or conditional use.
Agriculture, including agricultural based businesses which do not include retail sales.
Animals or fowl kept for family food production as an accessory use.
Churches (temporary churches held in the open area or in tents or in temporary structures excluded).
Corral, stable or building for keeping animals or fowl, provided such structure shall be located not less than one hundred feet (100') from a public street and not less than twenty five feet (25') from any rear or side lot line.
Dwellings, single-family.
Greenhouse and nursery, limited personnel and recreation uses.
Fruit or vegetable stand (for sale of products produced on owner’s premises).
Home based business.
Household pets.
Manufactured homes.
Private stables, horses for private use only.
The raising and grazing of horses, cattle, sheep or goats as part of a farming operation, including the supplementary or full feeding of such animals; provided, that such raising and grazing, when conducted by a farmer in conjunction with any livestock feed yard, livestock sales or slaughterhouse. 9-8A-3: PERMITTED USES REQUIRING FIVE ACRES MINIMUM LOT AREA:

The following permitted uses require a minimum lot area of five (5) acres:
Dairy farm and milk processing and sale; provided, that at least fifty percent (50%) of milk processed on the premises is sold.
Farming devoted to the hatching, raising (including fattening as an incident to raising) of chickens, turkeys or other fowl, rabbits, fish, frogs or beaver.
Fur farm.
Minor home based business meeting the requirements of chapter 13, article C of this title.
Public stables.
The use of farm equipment by a farm operator for off farm contracting work to supplement farm income. (Ord. 244-18, 3-6-2018)

9-8A-4: CONDITIONAL USES:

In the following list of possible uses, those that are not listed that are judged by the Planning Commission to be similar and compatible with the purpose of this article may also be reviewed for approval. Conditions for approval shall be determined by the Planning Commission or as otherwise provided in chapter 13 of this title.
Accessory dwelling unit. Accessory dwelling units are permitted with conditional use permit. (Reference title 9-14-25).
Golf courses, public or privately owned, whether or not operated as a business.
Greenhouse and nursery, limited to the sale of material produced on premises and with no retail shop operation.
Home based businesses meeting the requirements of chapter 13, article C of this title.
Kennels meeting the requirements of chapter 13, article E of this title.
Public parks and/or playgrounds, also privately owned playgrounds and recreational grounds or parks not operated as a business, in whole or in part, and to which no admission charge is made.
Residential facility for elderly persons meeting the requirements of chapter 13, article D of this title.
Residential facility for persons with a disability meeting the requirements of chapter 13, article D of this title.
Temporary uses as approved by the Planning Commission that do not exceed ninety (90) days in length.
Tents for assembly occupancies for special events as approved by the Planning Commission that do not exceed thirty (30) days in length. (Ord. 244-18, 3-6-2018; amd. Ord. 271-22, 7-5-2022)

All pens, sheds, barns, coops and stables housing animals and fowl shall be located not less than 100 feet from a public street and 100 feet from any main buildings on adjacent lots, except that on corner lots such buildings shall be located not closer than 50 feet to 1 of the public streets

9-8A-6: OFF STREET PARKING:

The provisions of chapter 18 of this title shall apply and shall be in full force and effect in this zone, except in the case of a bona fide temporary use. (Ord. 172-04, 3-2-2004)

9-8A-7: PERMITTED SIGNS:

The height, size and location of the following permitted signs shall be in accordance with the regulations set forth in chapter 17 of this title:
   A.   Class 1 signs.
   B.   For home based businesses uses allowed by conditional use permit, Class 2 signs will be allowed in addition to Class 1 signs.
