CHAPTER 9

COMMERCIAL ZONES

9-9A-1: PURPOSE AND LIMITATIONS:

   A.   Commercial Activity: The purpose of the C1 zone is to provide suitable areas for the location of the various types of commercial activity needed to serve the people and commerce of the city.
   B.   Prohibited Housing: This zone does not allow for basement houses or mobile homes, nor does it allow for campers, travel trailers or recreational vehicles to be used for living purposes, except as provided for in chapter 15 of this title.
   C.   Supplementary And Qualifying Regulations: All uses are subject to meeting the requirements of chapter 14 of this title. (Ord. 230-16, 4-5-2016)

9-9A-2: ARCHITECTURAL SITE PLAN REVIEW:

All proposed commercial development shall meet the requirements of chapter 12 of this title. (Ord. 230-16, 4-5-2016)

9-9A-3: PERMITTED USES:

Permitted uses within the C1 zone are those which are considered to have a low impact on the adjacent properties and on the infrastructural and municipal demands on the city. The following are examples of uses which may be permitted. Determination of whether a proposed use is considered permitted shall be made by the planning commission.
Accounting, consulting engineering, attorneys at law, etc.
Assisted living centers/nursing homes.
Auction houses.
Auto service and repair and similar.
Banks, credit unions, financial institutions.
Barber and beauty services.
Catering, food services.
Churches, synagogues and temples.
Daycare center facility for children and adults.
Dining establishments.
Equipment and appliance light repairs service enclosed within a building.
Excavation and mining sales and service.
Facilities with drive-through service.
Fitness centers.
Gas stations, convenience stores, car washes.
General distribution and warehousing.
Home improvement and hardware.
Hotels/motels.
Laundry/dry cleaning services.
Light manufacturing.
Medical, health or dental services.
Motor vehicles, boats and trailer sales.
Pawnbrokers, secondhand merchandise dealer, secondary metal dealers and recyclers and similar businesses.
Pharmaceuticals.
Printing and publishing.
Professional services such as medical and dental services, real estate sales, insurance.
Public buildings and public utility buildings.
Reception center and/or wedding center.
Retail sales excluding those identified as conditional, such as sporting and outdoor goods, auto parts, office supplies, apparel, furniture, appliance and home (less than 10,000 square feet) furnishings.
Storage units and services with office. (Ord. 230-16, 4-5-2016)

9-9A-4: CONDITIONAL USES:

The following list identifies possible uses which may be permitted within the C1 Zone based on conditions set forth by the Planning Commission. These are uses which based on the judgment of the Planning Commission have the potential for a greater impact on the adjacent properties and demands on the City than those identified as permitted uses. Uses that are not listed but that are judged by the Planning Commission to be similar and compatible with the purpose of this article may also be reviewed for approval. Conditions for approval shall be determined by the Planning Commission or as otherwise provided in chapter 13 of this title.
Christmas tree sales which may not be opened prior to November 15 and may not operate after December 31.
Entertainment, amusement and recreational activities.
Residential uses as approved by the Planning Commission.
Solicitors. (Before beginning work within the City, all solicitors must register with the City Recorder and receive a registration certificate.)
Temporary uses as approved by the Planning Commission that do not exceed ninety (90) days in length.
Tents for assembly occupancies for special events as approved by the Planning Commission that do not exceed thirty (30) days in length. (Ord. 249-18, 7-17-2018)

9-9A-5: SPECIAL PROVISIONS AND LIMITATIONS:

The following specified permitted and conditional uses shall be permitted only when the following conditions are complied with:
   A.   Windows In Accessory Living Quarter: Where an accessory living quarter is provided as permitted herein, no window shall be permitted in any wall which is located within eight feet (8') of a side property line.
   B.   Mobile Homes Prohibited: Mobile homes are not allowed in this zone.
   C.   Manufacturing In Enclosed Building: All manufacturing shall be done within a completely enclosed building.
   D.   Objectionable Conditions: All uses shall be free from objection because of odor, dust, smoke or noise.
   E.   Car Wash: A car wash shall be permitted, subject to the following restrictions:
      1.   Operation or use is forbidden between the hours of ten o'clock (10:00) P.M. and six o'clock (6:00) A.M.
      2.   There shall not be more than four (4) washing bays.
      3.   Off street vehicle storage required as follows:
         a.   One bay car wash, four (4) spaces in the approach lane;
         b.   Two (2) bay car wash, three (3) spaces in the approach lane for each wash bay;
         c.   Three (3) or more bay car wash, two (2) spaces in the approach lane for each wash bay. (Ord. 230-16, 4-5-2016)

9-9A-6: SITE DEVELOPMENT STANDARDS:

   A.   Lot Size: Each individual commercial use not located in an approved commercial complex shall have a lot not less than one- half (1/2) acre in size. For the purposes of this section, "pad" sites in a commercial complex shall be considered separate commercial sites.
   B.   Lot Width: The minimum width for a commercial lot shall be one hundred feet (100').
   C.   Setback From Street: The minimum setback from public or private streets shall be twenty feet (20') for buildings or structures twenty feet (20') or less in height. Buildings or structures over twenty feet (20') in height shall be set back an additional foot for each foot of height over twenty feet (20'). Any commercial building located adjacent to, or across a street from, a residential zone shall have the same front yard setback as that required in a residential zone. Parking lots shall not be permitted within the minimum required street setback(s).
   D.   Side And Rear Setbacks: There shall be no minimum setback requirement except where the C zone shares a common boundary with a noncommercial zone. In such cases, the minimum side and rear setbacks from property lines shall be twenty feet (20') for buildings and structures twenty feet (20') or less in height. Buildings or structures over twenty feet (20') in height shall be set back an additional foot for each foot of height over twenty feet (20').
   E.   Building Height: Maximum building height shall be forty feet (40') above main floor finished grade. (Ord. 230-16, 4-5-2016)

9-9A-7: OFF STREET PARKING AND LOADING:

Provisions of chapter 18 of this title shall apply and shall be in full force and effect in this zone, except in the case of a bona fide temporary use. (Ord. 230-16, 4-5-2016)

9-9A-8: PERMITTED SIGNS:

The height, size and location of the following permitted signs shall be in accordance with the regulations set forth in chapter 17 of this title:
   A.   Class 4 signs.
   B.   Class 5 signs will be allowed by conditional use permit.
   C.   Class 6 signs. (Ord. 230-16, 4-5-2016)

9-9A-9: LANDSCAPING REQUIREMENTS:

At least five percent (5%) of the total site in commercial, institutional or industrial uses shall be thoroughly landscaped, including an irrigation system to maintain such landscaping. Landscaping shall meet the requirements of chapter 12 of this title. (Ord. 230-16, 4-5-2016)

9-9B-1: PURPOSE AND LIMITATIONS:

   A.   Nursery Commercial Zone: The purpose of the C2 zone is to provide suitable areas for the location of a nursery commercial zone needed to serve the people and commerce of the city.
   B.   Prohibited Uses, Housing: This zone does not allow any residential uses nor does it allow for campers, travel trailers or recreational vehicles to be used for living purposes, except as provided for in chapter 15 of this title.
   C.   Supplementary And Qualifying Regulations: All uses are subject to meeting the requirements of chapter 14 of this title. (Ord. 230-16, 4-5-2016)

9-9B-2: ARCHITECTURAL SITE PLAN REVIEW:

All proposed commercial development shall meet the requirements of chapter 12 of this title. (Ord. 230-16, 4-5-2016)

9-9B-3: PERMITTED USES:

The following uses are permitted in the C2 zone:
Business offices for running a nursery, garden supply store or similar business.
Christmas tree sales and related displays.
Garden equipment sales and displays.
Nurseries, greenhouses and raising of plant materials for retail sales.
Sales, displays of chemicals for pest and weed control.
Sales, displays of fertilizer and lawn care products.
Sales, displays of ornamental lawn decorations, pots and yard landscaping tools.
Sales, displays of soils, decorative rocks, decorative bark or other landscaping materials.
Accessory uses and buildings customarily incidental to and subordinate to the above, and devoted exclusively to the main permitted use of the premises. (Ord. 230-16, 4-5-2016)

9-9B-4: CONDITIONAL USES:

In the following list of possible uses, those that are not listed that are judged by the planning commission to be similar and compatible with the purpose of this article may also be reviewed for approval. Conditions for approval shall be determined by the planning commission or as otherwise provided in chapter 13 of this title.
Temporary retail uses.
Temporary uses as approved by the planning commission that do not exceed ninety (90) days in length.
Tents as accessory structures for temporary seasonal storage buildings and for special events, provided they comply with all other aspects of this title.
Tents for assembly occupancies, for special events as authorized by the planning commission. (Ord. 230-16, 4-5-2016)

9-9B-5: SPECIAL PROVISIONS AND LIMITATIONS:

The above specified uses shall be permitted only under the following conditions:
   A.   Retail Sales: All sales on the premises, except for sales of plants, shall be retail sales.
   B.   Wholesale Plant Sales: Plants may be sold at wholesale on the premises.
   C.   Objectional Uses: All uses shall be free from objections because of odor, dust, smoke, noise, vibration or other causes.
   D.   Residential Uses Prohibited: There shall be no residential uses in the C2 zone.
   E.   Animals: No animals shall be kept, bred or raised in the C2 zone, except that guard dogs may be kept on the property; provided, that the guard dogs are kept in a secure kennel or other enclosure during all hours when any business is open to the public.
   F.   Parking: Businesses in the C2 zone shall be responsible for providing sufficient parking spaces to accommodate their customers, and shall also be responsible for ensuring that their customers use the provided parking and do not use the city streets or private driveways for parking.
