ARTICLE XIIIA

S-O Sewer Overlay Zoning District

§ 460-73.1 Statement of purpose.

It is the intent of this article to:
A. 
Encourage development of uses promoting economic development in the Township;
B. 
Provide for appropriate development flexibility; and
C. 
Provide for uses that develop a tax base in a manner that will have minimum impact on municipal services, while protecting the health, safety, and welfare of Township residents.

§ 460-73.2 Area of S-O Sewer Overlay Zoning District.

The S-O Sewer Overlay Zoning District shall be comprised of the following areas:
A. 
All areas depicted on Exhibit 1 to the Upper Tulpehocken Township Act 537 Plan Update, entitled "Municipal Sewer Districts," as "existing service area," "future growth area," and "ultimate growth area"; and
B. 
Properties containing the following zoning district designations:
(1) 
I-1 General Industrial;
(2) 
C-2 General Commercial;
(3) 
C-3 Mixed Commercial-Residential, with the exception of properties located to the south of Spring Road or located to the east of Pine Hill Road; and
C. 
Any property within a 0.6-mile radius of the center point of the interchange of Interstate 78 and SR 0183 for new or expanded uses as described in § 460-73.4. (NOTE: A map depicting the entire SO Zoning District Area is attached hereto, incorporated herein, and marked as 460 Attachment 5 to the Code of the Township of Upper Tulpehocken.)

§ 460-73.3 Underlying zoning.

A. 
If a use is one which is permitted by right, special exception, or conditional use under the current zoning of the tract or portion thereof, that use shall remain as permitted by right, special exception, or conditional use in the S-O Sewer Overlay Zoning District, subject to the requirements of the S-O Sewer Overlay Zoning District when the use is a new or expanded commercial, industrial, residential, warehouse, distribution, or institutional development in areas subject to these overlay requirements as stated in § 460-73.2 above, which is estimated, based on the chart contained in 25 Pa. Code § 73.17, to generate more than 10,000 gallons per day (10,000 gpd) of sewage flows.
B. 
All other regulations of the underlying zoning district(s) of the tract not specifically stated in this section shall remain in effect for the tract.

§ 460-73.4 Connection to public or community sanitary sewer system required.

Any new or expanded commercial, industrial, residential, warehouse, distribution, or institutional development subject to these sewer overlay requirements as stated in § 460-73.2 above which is estimated, based on the chart contained in 25 Pa. Code § 73.17, to generate more than 10,000 gallons per day (10,000 gpd) of sewage flows shall be connected to and served by the Township's public sanitary sewer system. For uses within the Sewer Overlay Area which are expected to generate less than 10,000 gpd of sewage flows per 25 Pa. Code § 73.17, the applicant must provide for adequate sewage disposal, in accordance with Pennsylvania Department of Environmental Protection (DEP) and Township ordinance requirements, including but not limited to regulations on size, setbacks, and isolation distances. All costs of sewage disposal, treatment (including pretreatment, if necessary), all costs of connection to the public sanitary sewer system, and all maintenance costs for the portion of any sewer system on private property shall be the responsibility of the applicant.
