Requirements
As provided by LUDMA, the city is required to provide notice of all public hearings and public meetings to consider both legislative and administrative matters. The notice requirements of the Vineyard for all public hearings and public meetings regarding land use matters and Land Use Applications are provided, herein. The notice requirements of this Chapter are hereby found to require greater notice than required by Section 200 of LUDMA.
When required by the provisions of this Ordinance, the Planner for public hearings before the Commission, and the City Recorder, or Designee for public hearings before the Council, shall provide notice of the public hearing as follows:
When required by the provisions of this Ordinance, the City Planner for public meetings by the Commission or BOA, and the City Recorder, or designee for public meetings by the Council, shall provide notice of the public meeting as follows:
As required by LUDMA, the Planner for the Commission and BOA, and the City Recorder, or designee for the Council, shall notify the Applicant for a Land Use Application of the date, time, and place of each public hearing and public meeting to consider the Application.
In addition to the Applicant notice required by VZC 15.18.060, the Planner for the Commission and BOA, and the City Recorder, or designee for the Council, shall notify the Applicant for a Land Use Application of any action on the Application, as required by LUDMA.
If notice given under authority of this Chapter, and authority of LUDMA, is not challenged under the provisions of LUDMA, within thirty (30) days after the meeting(s), or action for which notice is given, the notice is considered adequate and proper.
In addition to the public hearing notice required by this Chapter, and in the interests of favoring an awareness of all public hearings and participation in the public processes, the city may also provide courtesy notice, in addition to the mandatory public hearing notice required by VZC 15.18.020 and VZC 15.18.030.
