SITE PLAN REQUIREMENTS
(a)
Purpose. For the purpose of assuring good arrangement, appearance, function, harmony with surrounding and adjacent uses and the objectives of the comprehensive plan, and compliance with the requirements of these regulations, site plans shall be submitted and reviewed in accordance with the requirements and procedures of this section.
(b)
Application. A site plan shall be submitted in each of the following instances:
(1)
With every building permit application received by the city under Chapter 6 of this Code.
(2)
Redevelopment of existing nonresidential uses.
(3)
The conversion of a single-family or two-family use to another use.
(4)
The demolition or removal of any structure or building.
(5)
The addition of dwelling units to an existing dwelling unit.
(6)
To change a building location or size.
(7)
New construction of residential and nonresidential uses, structures, and buildings.
(8)
Addition of accessory uses, structures and buildings to lots.
(9)
Addition or reconfiguration of parking lots.
(10)
Addition or change in location or configuration of freestanding or ground mounted signs on lots.
(c)
Reviewing authority.
(1)
Administrative site plans. Administrative site plans may be reviewed by the city's plan review team. The approving authority for compliance with Chapters 21 and 27 of this Code for administrative site plans shall be the city planner or his or her designee. Decisions of the public works director may be appealed before the board of adjustment in the manner outlined in sections 27-56 through 27-63.
(2)
Major site plans. Conditional use permits and planned unit developments shall be reviewed by the city's plan review team, the planning and zoning commission and submitted to the city council for review and approval.
(d)
Referral agencies. The city's plan review team may consist of the following positions or agencies or their representatives:
City planner.
Public works.
Building official.
Police chief.
Fire chief.
Parks and recreation director.
City collector.
City manager.
Mayor.
Representatives from environmental, traffic, historic preservation, planning and other commissions, as deemed appropriate.
Other staff, as determined by city manager.
Utility companies.
Economic development partners.
Missouri Highway and Transportation Department.
Warrensburg R-VI School District.
(e)
Waiver of site plan. The approving authority may waive the requirement for a site plan where there is a change in use or occupancy and no extensive construction or improvements is sought or when the scope of a building permit application does not include extensive construction or improvements. In considering whether to waive the requirement, the approving authority will determine whether the proposed application will involve significant alteration to existing drainage, circulation, spatial relationship of structures to each other and to the setbacks, landscaping and buffering, lighting, parking and other matters regulated by city ordinance.
(f)
Responsibilities of the applicant. The applicant is responsible for having a representative at all meetings where the request is reviewed. Failure to have a representative present will be cause to have the item withdrawn from the agenda of that meeting.
(g)
Preparation of site plan.
(1)
Site plans for construction or change of use related to land use groups 1.000 to 1.200 and not in a special flood hazard area shall be made with an engineer's scale, and drawn to a scale commonly used for such plans on paper no less than eight and one-half (8½) inches by eleven (11) inches.
(2)
Site plans for construction or change of use related to land use groups 1.300 and all subsequently adopted land use groups, or any construction located in a special flood hazard area, or requiring a conditional use permit are required to be prepared by a registered, professional engineer or land surveyor licensed by the state of Missouri. The site plan shall be made with an engineer's scale, and drawn to a scale commonly used for such plans on paper no greater than twenty-four (24) inches by thirty-six (36) inches.
(h)
Plans and data.
(1)
All site plans shall contain the following information:
a.
The date of preparation, the scale, a north arrow.
b.
The name of the project.
c.
The legal description.
d.
The names, addresses and phone numbers of the applicant and the firm(s) or person(s) responsible for preparing the site plan.
e.
Land uses adjacent to the site.
f.
Lot dimensions, lot boundary lines, and location of all front, rear, and side building setback lines.
g.
The location and dimensions of all existing on-site and adjoining easements, rights-of-way curb cuts, location of off-street parking areas, paved areas, sidewalks, landscaped areas and plantings, two-foot contours, structures and their uses, parking areas, trash disposal areas, and utility service connections.
h.
The location and dimensions of all proposed on-site and adjoining easements, rights-of-way, curb cuts, location of off-street parking areas, paved areas, side walks, open space, landscaped areas showing materials used, two-foot contours, structures and their uses, utility facilities, storm drainage, trash disposal areas, utility service connections, exterior lighting standards, signage, and driveways.
i.
Adjacent street improvements, including rights-of-way and pavement width, curb cuts and intersecting streets across from the site.
j.
Appropriate certification blocks, as approved by the city, shall appear on the site plan.
k.
Location of boundaries of special flood hazard areas if present on site.
l.
For PUD projects, the percentage of land devoted to open space, categorized by total amount and amount of usable open space; and residential density.
(i)
Site plan review.
(1)
Administrative site plan procedures.
a.
The applicant may consult with the city planner for general information regarding requirements for site plans and any special considerations pertaining to the site. The applicant may meet with the city's plan review team at any point prior to or after application.
b.
The applicant shall submit to the city two (2) copies of each site plan and accompanying plans, a completed building permit application, and the site plan review fee as established by resolution.
c.
Upon receipt of the site plan, the city planner and plan review team shall review the site plan for compliance with the zoning ordinance, subdivision regulations and all adopted codes, ordinances, and policies of the city. The city planner and each plan review team member will review plans promptly and furnish comments or necessary corrections to the applicant.
d.
The applicant shall make all changes necessary to comply with city code requirements.
e.
The city planner shall approve, approve with conditions, or not approve of the site plan within forty-five (45) days of receipt of the site plan in its final form. Approval shall be indicated upon the site plan.
(2)
Major site plan procedures.
a.
The applicant may consult with the city planner for general information regarding requirements for site plans and any special considerations pertaining to the site. The applicant may meet with the city's plan review team at any point prior to or after application.
b.
The applicant shall apply for and receive a conditional use permit according to the provisions set forth in section 27-300 and section 27-29.
c.
Upon receipt of the conditional use permit and at the time the applicant applies for a building permit, the applicant shall submit to the city two (2) copies each of the site plan and accompanying plans, a completed building permit application, and the site plan review fee as established by resolution.
d.
Upon receipt of the site plan, if the site plan is consistent with the development plan submitted per Section 27-300(i), staff will review the plan per section 27-350(g)(1) above. If the site plan is substantially different than the development plan submitted per section 27-300(i), the site plan shall be set on the agenda of the planning and zoning commission meeting at the next meeting no less than thirty (30) days from the date of receipt of the site plan.
e.
The city planner and plan review team shall review the site plan for compliance with the zoning ordinance, subdivision regulations and all adopted codes, ordinances, and policies of the city. The city planner and each plan review team member shall furnish comments or necessary corrections to the planning and zoning commission.
f.
The planning and zoning commission shall either approve, conditionally approve, or not approve the final site plan and shall submit a written recommendation to the city council.
g.
The final site plan and recommendations of the planning and zoning commission shall be reviewed at the next regularly scheduled meeting of the city council. The city council shall either approve the final site plan, disapprove it, or refer the item back to the planning and zoning commission for further study.

Upon receipt of the site plan, if the site plan is consistent with the development plan submitted per Section 27-300(i), staff will review the plan per section 27-350(g)(1) above. If the site plan is substantially different than the development plan submitted per section 27-300(i), the site plan shall be set on the agenda of the planning and zoning commission meeting at the next meeting no less than thirty (30) days from the date of receipt of the site plan.
e.
The city planner and plan review team shall review the site plan for compliance with the zoning ordinance, subdivision regulations and all adopted codes, ordinances, and policies of the city. The city planner and each plan review team member shall furnish comments or necessary corrections to the planning and zoning commission.
f.
The planning and zoning commission shall either approve, conditionally approve, or not approve the final site plan and shall submit a written recommendation to the city council.
g.
