16.15

ENFORCEMENT AND PENALTIES.

The following enforcement powers and penalties shall apply:

(1)

The City of Waupun Building Inspector, acting in the capacity of Zoning Administrator, in cooperation with the Police Chief, Fire Chief and other Code Enforcement Officials, shall enforce this ordinance as follows:

(a)

Issue permits and inspect properties for compliance with this chapter and issue certificates of compliance when appropriate.

(b)

Advise applicants as to the provisions of this chapter and assist them in preparing permit applications.

(c)

Maintain permanent records relating to the adoption, amendment and administration of this ordinance including, but not limited to, all maps, conditional uses, variances, appeals, certificates of occupancy and applications.

(d)

Receive, file and forward all applications for amendments, variances, conditional uses or other related matters to the Plan Commission.

(e)

Investigate, prepare reports and report uncorrected violations of this chapter to the City Attorney for appropriate corrective action according to the Wisconsin Statutes and the City of Waupun Zoning Ordinance.

(f)

Enforce the provisions of this chapter, all other ordinances of the City and all laws and orders of the State which relate to zoning administration, and for these purposes, they shall have the right at all reasonable times to enter buildings and premises.

(2)

The Building Inspector shall not issue a permit for a structure or a use that is not allowed by this Ordinance. No structure shall be built, moved, or altered, and no land use shall be substantially altered, until a permit has been issued.

(3)

Applications for any permit shall be accompanied by a plan showing the location, size and shape of the land involved, and of any proposed use of each structure and lot, and in the case of residential development, the number of families expected to be accommodated.

(4)

In any district where public sewerage service is not available, the width and area of all lots shall be sufficient to permit the use of an on-site sewage disposal system designed in accordance with Ch. DILHR 83, Wis. Adm. Code, and shall meet the minimum area requirements of this Ordinance.

(5)

In any district where public sewage service is not available, only those sewage disposal systems specified by the community, the Wisconsin Department of Industry, Labor and Human Relations and the County Sanitarian shall be permitted after certification by the County Sanitarian. The specified private sewage disposal systems shall include only systems utilizing a septic field and shall not include mound or holding tank type systems.

(6)

Any person, firm, or company, or corporation who violates, disobeys, omits, neglects, or refuses to comply with, or who resists the enforcement of any of the provisions of this ordinance shall be subject to the forfeitures and penalties identified in section 18.04 of this code.

(7)

Compliance with the provisions of this Ordinance may also be enforced by injunction order at the suit of the City or one or more owners of real estate situated within an area affected by the regulations of this Ordinance.
