BUSINESS DISTRICT REQUIREMENTS.

(1)

B-1 BUSINESS/PROFESSIONAL OFFICE DISTRICT.

(a)

Purpose. The B-1 District is intended to provide a delineated area for limited professional and business uses. These uses are primarily of a service or institutional nature and can be located in any appropriate area in the City.

(b)

Permitted Uses. The following uses are permitted within the B-1 District:

(i)

Professional offices including offices and clinics for doctors and dentists, and hospitals; and

(ii)

Accessory uses customarily incident to the above uses.

(iii)

Barber and Beauty Salons.

(c)

Requirements. In order to be considered a conforming lot or structure within a B-1 District, a lot or structure must:

(i)

Have a minimum lot size of 8,000 square feet and a minimum lot width of 80 feet;

(ii)

Have a front yard setback of 25 feet, a rear yard setback of 25 feet and a side yard of 9 feet;

(iii)

Not exceed a maximum principal building height of 30 feet; and

(iv)

Have an accessory building side yard setback of 3 feet and a maximum accessory building height of 25 feet.

(d)

Conditional Uses. The following uses shall be considered conditional uses within a B-1 District:

(i)

Professional and business offices for real estate and insurance businesses, for architects, engineers, accountants, lawyers, utilities, banks and building and loan associations.

(ii)

Group child care center.

(iii)

Outdoor premises as defined in Section 11.12 of the Waupun Municipal Code. (Ord #20-06)

(iv)

Churches.

(2)

B-2 CENTRAL BUSINESS DISTRICT.

(a)

Purpose. The B-2 District is intended to provide an area for the business needs of the community and create an area of specialized retail and service businesses.

(b)

Permitted Uses. The following uses are permitted within a B-2 District:

(i)

Residential units above commercial uses;

(ii)

Bakeries and specialty food stores;

(iii)

Barbers and beauty shops;

(iv)

Taverns and restaurants;

(v)

Florists;

(vi)

Professional, governmental, and business offices;

(vii)

Mortuaries;

(viii)

Bus depots;

(ix)

Art galleries and antique shops;

(x)

Jewelry stores, gift shops, and jewelry and watch repair;

(xi)

Banks;

(xii)

Interior decorating, painting, and wallpaper stores;

(xiii)

Clothing and shoe stores, custom tailoring, dressmaking and millinery shops;

(xiv)

Hardware stores;

(xv)

Dentists offices;

(xvi)

Drive-up bank services;

(xvii)

Auto parts storage;

(xviii)

Bowling alleys and video stores;

(xix)

Pharmacies; and

(xx)

Gas station/convenience store. (Ord. 96-19)

(c)

Requirements. In order to be considered a conforming lot or structure within a B-2 District, a lot or structure must:

(i)

Have a minimum lot size of 8,000 square feet and a minimum lot width of 40 feet;

(ii)

Not exceed a maximum principal building height of 60 feet; and

(iii)

Have a maximum accessory building height of 25 feet.

(iv)

Although there are no front yard or side yard set back requirements in the B-2 District, there shall be a requirement for those properties abutting Main Street and located between the railroad tracks and Carrington Street, applying to properties on both sides of said street, so that all buildings, all remodeling and all new construction conform to the building set back line as presently in existence, and that no sidewalks, alleys or public rights-of-way, as presently existing, shall be encroached upon. (d)

Conditional Uses. The following uses shall be considered conditional uses within a B-2 District:

(i)

Service stations;

(ii)

Modifications of parking requirements;

(iii)

Taxi offices;

(iv)

Car washes;

(v)

Plumbing and heating sales and service stores;

(vi)

Car dealerships;

(vii)

Small engine repair shops;

(viii)

Rooming houses; and

(ix)

Other commercial uses compatible with other permitted and conditional uses stated above.

Residential units located upon the first floor. (89-5)

(xii)

Churches.

B-3 SHOPPING CENTER BUSINESS DISTRICT.

(a)

Purpose. The B-3 District is intended to provide areas for retail and professional services which typically include department stores, restaurants, grocery stores, and banks in outlying sections of the community. The District is also intended to provide business areas with off-street parking and drive-up services.

(b)

Permitted Uses. The following uses are permitted within a B-3 District:

(i)

Banks;

(ii)

Hardware stores;

(iii)

Restaurants;

(iv)

Drive-in restaurants and ice cream bars;

(v)

Laundries, dry cleaning, and dyeing establishments;

(vi)

Department and furniture stores;

(vii)

Building material suppliers not requiring outside storage;

(viii)

Grocery stores;

(ix)

Liquor stores;

(x)

Auto parts stores;

(xi)

Professional offices; and

(xii)

Car and truck dealerships. (Ord. 92-8)

(c)

Requirements. In order to be considered a conforming lot or structure within a B-3 District, a lot or structure must:

(i)

Have a minimum lot size of 1.5 acres and a minimum lot width of 150 feet. (Ord. 02-08)

(ii)

Have a front yard setback of 25 feet, rear yard setback of 40 feet, and a side yard setback of 20 feet, but this setback does not apply if a lot is adjacent to another B-3 lot.

(iii)

Not exceed a maximum building height of 50 feet; and

(iv)

Have an accessory building side yard setback of 3 feet and maximum accessory building height of 25 feet.

(d)

Conditional Uses. The following uses shall be considered conditional uses within a B-3 District:

(i)

Service stations, washing and repair stations and garages provided all gas pumps are not less than 30 feet from any existing or proposed street line;

(ii)

Recreational establishments including drive-in theaters, golf, or baseball driving ranges, archery fields, and miniature golf courses;

(iii)

Roadside stands;

(iv)

Tourist homes, hotels, motels, and taverns;

(v)

Other retail and professional services compatible with other permitted and conditional uses stated above; and

(vi)

Group child care center.

(viii)

Churches.

(4)

B-4 INTERCHANGE BUSINESS DISTRICT.

(a)

Purpose. The B-4 District is intended to provide an area for businesses oriented towards the highway user, tourist, or temporary visitors to the City.

(b)

Permitted Uses. The following uses will be permitted within a B-4 District:

(i)

Hotels, motels;

(ii)

Drive-in restaurants, restaurants;

(iii)

Business and professional offices;

(iv)

Indoor/outdoor theaters; and (Cr. #12-10)

(v)

All permitted uses in the B-2 and B-3 District. (Cr. #12-10)

(c)

Requirements. In order to be considered a conforming lot or structure within a B-4 District, a lot or structure must:

(i)

Have a minimum lot size of one acre and a maximum lot width of 120 feet;

(ii)

Have a front yard setback of 40 feet, a rear yard setback of 20 feet and a side yard setback of 20 feet;

(iii)

Not exceed a maximum principal building height of 60 feet; and

(iv)

Have an accessory building side yard setback of 3 feet and a maximum accessory building height of 25 feet.

(d)

Conditional Uses. The following uses shall be considered conditional uses within a B-4 District:

(i)

Truck stops;

(ii)

Service stations; and

(iii)

Group child care center.

(iv)

Outdoor premises as defined in Section 11.12 of the Waupun Municipal Code. (Ord #20-06)

(v)

Churches.

(5)

B-5 WAREHOUSING/BUSINESS DISTRICT.

(a)

Purpose. The B-5 District is intended to provide an area for businesses oriented toward storage, transportation, and shipping. The District is also intended to provide an area for associated retail and service establishments.

(b)

Permitted Uses. The following uses will be permitted within a B-5 District:

(i)

Warehouses;

(ii)

Public storage facilities;

(iii)

Trucking terminals;

(iv)

Wholesale establishments; and

(v)

Product distribution centers.

(c)

Requirements. In order to be considered a conforming lot or structure within a B-5 District, a lot or structure must:

(i)

Have a minimum lot size of 20,000 square feet and a minimum lot width of 100 feet;

(ii)

Have a front yard setback of 15 feet, a rear yard setback of 15 feet and a side yard setback of 15 feet;

(iii)

Not exceed a maximum principal building height of 65 feet; and

(iv)

Have an accessory building side yard setback of 3 feet and a maximum accessory building height of 25 feet.

(d)

Conditional Uses. The following uses shall be considered conditional uses within a B-5 District:

(i)

Drive-in restaurants;

(ii)

Automobile and truck sales; and

(iii)

Truck/car stop. (Ord. 96-03)

(iv)

Churches.

(e)

Prohibited Uses. The following uses shall be prohibited in a B-5 District:

(i)

Manufacturing, processing or assembly of goods.

(6)

B-6 NEIGHBORHOOD COMMERCIAL DISTRICT.

(a)

Purpose. The B-6 District is intended to provide areas for small grouped business uses to serve residential districts. The District is also intended to provide business areas with off-street parking and drive-up services.

(b)

Permitted Uses. The following uses will be permitted within a B-6 District:

(i)

Restaurants;

(ii)

Barbershops and beauty salons;

(iii)

Funeral homes;

(iv)

Government offices;

(v)

Neighborhood grocery stores; and

(vi)

Bicycle sales and repair.

(c)

Requirements. In order to be considered a conforming lot or structure within a B-6 District, a lot or structure must:

(i)

Have a minimum lot size of 8,000 square feet and a minimum lot width of 60 feet;

(ii)

Have a front yard setback of 25 feet, a rear yard setback of 10 feet, and a side yard setback of 10 feet;

(iii)

Not exceed a maximum principal building height of 45 feet; and

(iv)

Have an accessory building side yard setback of 3 feet and a maximum building height of 25 feet.

(d)

Conditional Uses. The following uses shall be considered uses within a B-6 District:

(i)

Service stations, washing and repair stations and garages provided all gas pumps are not less than 30 feet from any existing or proposed street line;

(ii)

Automobile dealerships;

(iii)

Liquor stores, taverns;

(iv)

Motels;

(v)

Plumbing and heating sales and service stores;

(vi)

Banks;

(vii)

Roller skating rinks and bowling alleys;

(viii)

Dry cleaning establishments;

(ix)

Dentists offices, chiropractors offices;

(x)

Building material suppliers;

(xi)

Two-family dwellings;

(xii)

Small engine repair; and

(xiii)

Other uses compatible with other permitted and conditional uses stated above.
