CHAPTER 10

COMMERCIAL DISTRICTS

10-10-1: COMMERCIAL DISTRICTS ESTABLISHED:

   A.   Certain districts, designated by the symbol C followed by a numeral or numeral and letter and referred to collectively herein as C commercial districts may be created to provide space in suitable locations for the various types of business activity needed to serve the people and commerce in the city in conformance with the comprehensive general plan.
   B.   All uses permitted in the B residence districts shall be permitted. (Ord. 1183, 12-12-2005)

10-10-2: LOT AREA REGULATIONS FOR ALL C COMMERCIAL DISTRICTS:

   A.   No minimum lot area shall be required.
   B.   Minimum lot width for buildings containing any dwelling units unless such dwelling occupy the second or higher floor of the structure, shall be the same as in the B residence district. No minimum lot width for any other buildings shall be required.
   C.   Front yard shall be not less than five feet (5') from the property line. When commercial property adjoins any residential district, the front yard shall not be less than the established setback line.
   D.   Side yards are not required unless commercial property adjoins any residential district, in which case a minimum of ten feet (10') side yard shall be required. A privacy fence with a maximum height of eight feet (8') is required.
   E.   No rear yards are required except where vehicular access to or from an alley or required loading space requires same, in which case there shall be determined the necessary setback, as specified in this title.
   F.   Minimum open space shall be ten percent (10%).
   G.   Height restrictions for all C commercial districts shall be four (4) stories but in no event to exceed any limits in the currently adopted building code, except as provided in subsection 10-11-1H of this title.
   H.   Off street parking and loading for all C commercial districts are required and provided in chapter 12 of this title.
   I.   Sewers and connections to public sewers shall be permitted in accordance with the bearing walls or partitions, sewer regulations.
   J.   Street, sidewalk, curb and gutter regulations shall be in accordance with title 8, chapter 3 of this code.
   K.   Open space, all parkway areas are to be landscaped and maintained as open space except where access driveways and walks preclude such landscaping; in no event should parkway areas be used to provide required parking or loading space. Whenever a building or structure is constructed after the effective date of this section, the city of Weiser landscaping guidelines as required in this title shall be complied with. Whenever a building or structure is existing prior to the effective date hereof is enlarged to the extent of fifty percent (50%) or more in floor area, number of employees, number of housing units, seating capacity or otherwise, said building or structure shall then and thereafter comply with the city of Weiser landscaping guidelines. 10-10-3: C-1 COMMERCIAL DISTRICTS; REGULATIONS FOR NEIGHBORHOOD COMMERCIAL PURPOSES:

   A.   Purpose: It shall be the purpose of the C-1 district classification to establish distinct zones, regulate or provide local commercial service needs and to restrict incompatible commercial uses.
   B.   Uses Allowed: The following uses shall be permitted in C-1 commercial districts:
All uses permitted in B residence, as required in section 10-8-1 of this title.
Banks and financial institutions.
Barbershops and beauty parlors.
Book or stationery stores.
Catering shops.
Delicatessens.
Drugstores.
Family daycare/childcare center.
Florist or gift shops.
Interior decorating or upholstering shops.
Jewelry stores.
Medical and/or dental clinics or laboratories.
Newsstands or news dealers.
Office buildings of all types.
Parking lots.
Pizza parlor.
Post offices.
Record shops.
Restaurants, cafes and soda fountains, excluding drive-ins.
Tailor shops.
Video rental.
Other uses deemed similar by the city may be allowed. (Ord. 1183, 12-12-2005)

10-10-4: C-2 CENTRAL BUSINESS DISTRICT:

   A.   Purpose: It shall be the purpose of the central business district or C-2 district classification to establish a district zone regulated to fulfill the needs of the city's central business district and to provide for activities conducive to a compact and concentrated urban downtown commercial center. Lands may be classified C-2 if contiguous to existing C-2 designated lands and in accordance with the comprehensive plan.
   B.   Uses Permitted: The following uses shall be permitted in a C-2 district:
Antique shops.
Bakeries and bakery goods shops.
Bicycle shop.
Blueprinting and photo development establishments.
Car washes.
Clothes cleaning pick up stations or pressing establishments.
Clothing apparel shops.
Custom dressmaking or millinery stores.
Dairy shops.
Dancing and/or music studios or academies.
Department stores.
Dry goods and notions stores.
Electrical appliance shops.
Grocery, fruit or vegetable stores.
Hobby shops.
Hotels and motels.
Housing on second and higher floors of structures.
Indoor recreational facilities.
Indoor theaters.
Laboratory.
Laundromat/dry cleaner.
Meat markets.
Paint and wallpaper stores.
Parks and plazas.
Pharmacy.
Printing, publishing, bookbinding and lithographing establishments.
Professional offices.
Radio and television sales and repairs.
Radio/TV stations (except exterior communications facilities).
Retail sales.
Shoe repair shops.
Sporting goods stores.
Supermarkets.
Variety stores.
Other uses deemed similar by the city may be allowed. (Ord. 1183, 12-12-2005)

10-10-5: C-3 COMMERCIAL DISTRICTS:

   A.   Purpose: It shall be the purpose of the service commercial or C-3 district classification to provide for activities of a service nature which are more intensive in use than those permitted in other commercial zones and which are semiindustrial in character. Lands designated as C-3 commercial districts shall have businesses located thereon not requiring industrial locations. The following regulations shall apply, in addition to the general regulations of this title, to all lands, buildings and structures located in any C-3 commercial district.
   B.   Uses Permitted: The following uses shall be permitted in a C-3 commercial district:
Auto, RV, and/or truck sales and rentals, motorcycle shops, sales and repairs, public garages for retail service only, including automobile repairing, painting, upholstering, body-fender work, provided all operations are conducted in an enclosed building.
Carpenter, plumbing or sheet metal shops.
Clubs or lodges and fraternal associations.
Commercial parking lots.
Drive-in restaurants.
Hardware stores and furniture stores.
Filling stations or service stations.
Lumberyards.
Parcel delivery service branches.
Pet shops.
Public utilities and public service uses or structures.
Shopping centers.
Trailer sales areas.
Wholesale establishments, storage or wholesale warehouses.
Other uses deemed similar by the city may be allowed. (Ord. 1183, 12-12-2005)

10-10-6: CONDITIONAL USES:

The planning commission may, after notice and public hearing, permit the following uses where such uses are deemed essential or desirable to the public convenience or welfare. The commission shall have the authority to impose such conditions and safeguards as it deems necessary to protect the best interests of the surrounding property or neighborhood from damage, hazard, nuisance or other detriment:
The following conditional uses may be permitted in C-3 commercial:
Airports, heliports or other aircraft landing fields.
Artificial lake, all districts.
Auction establishment.
Auditoriums, stadiums, arenas and similar uses.
Bars, taverns, and retail liquor stores.
Boarding, lodging or rooming houses, bed and breakfasts and guesthouses.
Building materials, garden supply.
Bus and railroad stations.
Cemeteries, mausoleums, columbariums and crematories.
Coffee/espresso stand.
Commercial recreation uses.
Educational institutions, including university facilities.
Hospitals and sanatoriums.
Industrial laundry.
Kindergarten or day nursery in the residential districts.
Land reclamation projects.
Libraries, museums, fire or police stations or other governmental enterprises which are controlled by this title.
Manufactured home parks.
Medical and dental clinic or medical health center.
Medical research facilities.
Minor utility facilities.
Mortuary or funeral home.
Natural resources development, together with the necessary buildings, apparatus or appurtenances incidental thereto.
Nursing or convalescent homes.
Outdoor recreation.
Parks, playgrounds, community centers and other recreational uses operated by other than a governmental agency.
Public utilities and public service uses or structures.
Religious institutions including places of worship, schools and convents.
Research and development centers for experimental or scientific investigation of materials, methods or products.
Sanitary fill projects meeting state requirements.
Self-service storage.
Shelter homes.
Other uses deemed similar by the city to the uses above may be considered under a conditional use application. (Ord. 1183, 12-12-2005)

10-10-7: DESIGN STANDARDS:

All development within the commercial district may be subject to building and construction design standards, including, and not limited to, building design, landscaping, and lighting, as may be set by the city. (Ord. 1183, 12-12-2005)
