CHAPTER 5

AR RESIDENCE DISTRICT, AGRICULTURAL RESIDENTIAL

10-5-1: USES PERMITTED:

The following uses are permitted in zone AR, agricultural residential district:
Accessory buildings and uses including private garages, carports, parking areas, and recreation rooms and areas.
Agricultural uses, not to include CAFOs.
Customary home occupations.
Golf courses, country clubs, tennis courts and similar recreational uses.
Parks, playgrounds, libraries, community centers and similar uses owned and operated by a governmental agency, including police, fire and postal substations.
Single-family dwellings.
The city of Weiser utilities and public service uses or structures.
Two-family dwellings (duplexes and townhouses). (Ord. 1183, 12-12-2005)

10-5-2: CONDITIONAL USES:

The planning commission may, after notice and public hearing, permit the following uses where such uses are deemed essential or desirable to the public convenience or welfare. The commission shall have the authority to impose such conditions and safeguards as it deems necessary to protect the best interests of the surrounding property or neighborhood from damage, hazard, nuisance or other detriment:
The following conditional uses may be permitted in the AR zone:
   A.   Airports, heliports or other aircraft landing fields.
   B.   Artificial lake, all districts.
   C.   Educational institutions, including university facilities.
   D.   Natural resources development, together with the necessary buildings, apparatus or appurtenances incidental thereto.
   E.   Recreational vehicle parks.
   F.   Religious institutions including places of worship, schools and convents.
   G.   Research and development centers for experimental or scientific investigation of materials, methods or products.
   H.   Other uses deemed similar by the city to the uses above may be considered under a conditional use application.
   I.   Public utilities and public service uses or structures other than the city of Weiser. (Ord. 1183, 12-12-2005)

10-5-3: LOT AREA REGULATIONS:

   A.   Minimum lot area, five (5) acres or more.
   B.   Minimum at width, seventy five feet (75').
   C.   Front yard not less than thirty feet (30') from the property line or the established setback line in compliance with subsections 10-11-1D and E of this title.
   D.   Side yard not less than fifteen feet (15').
   E.   Rear yard, not less than thirty feet (30') from the property line.
   F.   No structure shall be placed in any utility easement of record. (Ord. 1183, 12-12-2005)

10-5-4: HEIGHT RESTRICTIONS:

The height restrictions for the AR residential district shall be three and one-half (31/2) stories but not exceeding forty five feet (45'). (Ord. 1183, 12-12-2005)

10-5-5: OFF STREET PARKING AND LOADING:
