CHAPTER 2

DISTRICTS; MAP

10-2-1: DISTRICTS:

For the purpose of this title and in accordance with the comprehensive general plan, all land within the city's zoning jurisdiction is divided into the following districts:
AR
Agricultural residential
AL
Low density residential
A
Low density residential district - single-family and two-family dwellings
B
Medium density residential district
C
Commercial districts
D
Industrial district
E
Floodplain overlay
F
Mixed use development overlay

10-2-2: ZONING MAP:

The boundaries of the above zoning use districts shall be shown on the official zoning map and designated on said map by the use of the following colors:
AR
Agricultural residential
Dark green
AL
Low density residential
Red
A
Residential district
Blue
B
Residence district
Purple
B-1
Residence district
Orange
C
Commercial districts
Yellow
D
Industrial district
Brown
E
Floodplain overlay
F
Mixed use development overlay
 
Said official map, together with two (2) copies thereof, shall be kept on file in the office of the clerk, and it is hereby adopted by reference thereto. All notations, references, indications and other matters shown on said map are as much a part of this title as if they were fully set forth herein. (Ord. 1183, 12-12-2005)

10-2-3: BOUNDARY LINES:

   A.   District boundary lines, as shown on the official zoning map, follow streets, alleys and existing property lines, where feasible. When the district boundary lines do not follow any of these lines, the width or extent of the district may be scaled from the map, unless otherwise provided in this chapter.
   B.   Whenever a district boundary line does not follow either a street or alley, the less restricted district (industrial district being less restricted than the commercial districts or residential districts, respectively) extends only to the back of the lots where the lots or buildings thereon, or to be constructed thereon, face the least restricted district and cannot face towards the side of a building existing or erected in conformity with subsection A of this section.
   C.   Whenever any street, alley or public way or railroad right of way is vacated by proper authority, the districts adjoining each of such vacation and all that are included in the vacation shall henceforth be subject to all regulations of the extended districts. (Ord. 1183, 12-12-2005)

10-2-4: ZONING OF ANNEXED AREAS:

Prior to annexation of an unincorporated area, the city council shall request and receive a recommendation from the Weiser planning and zoning commission on the proposed comprehensive plan and zone change for the unincorporated area. Each commission and the city council shall follow the notice and hearing procedures as provided in Idaho Code 67-6509. Concurrently, or immediately following the adoption of an ordinance of annexation, the city council shall amend the plan and zoning ordinance. (Ord. 1183, 12-12-2005)
