CHAPTER 7

A RESIDENCE DISTRICT, LOW DENSITY - SINGLE-FAMILY

10-7-1: USES PERMITTED:

The following uses are permitted in zone A, residence district:
A professional office of a surgeon, physician, dentist, lawyer, clergyman or other professional person using his residence for the consultation, emergency treatment or performance of religious rites only, and not for the general practice of a profession.
Accessory buildings and uses including private garages, carports, parking areas, and recreation rooms and areas.
City of Weiser public utilities and public service uses or structures.
Customary home occupations.
Golf courses, country clubs, tennis courts and similar recreational uses.
Parks, playgrounds, libraries, community centers and similar uses owned and operated by a governmental agency, including police, fire and postal substations.
Single-family dwellings.
Two-family dwellings (duplexes).
Two-family dwellings (townhouses), minimum lot size twenty percent (20%) larger than minimum area regulation (see subsection 10-7-3A of this chapter). (Ord. 1183, 12-12-2005)

10-7-2: CONDITIONAL USES:

The planning commission may, after notice and public hearing, permit the following uses where such uses are deemed essential or desirable to the public convenience or welfare. The commission shall have the authority to impose such conditions and safeguards as it deems necessary to protect the best interests of the surrounding property or neighborhood from damage, hazard, nuisance or other detriment:
The following conditional uses may be permitted in the A zone:
   A.   Artificial lake.
   B.   Cemeteries, mausoleums, columbariums and crematories.
   C.   Educational institutions, including university facilities.
   D.   Hospitals and sanatoriums.
   E.   Kindergarten or day nursery in the residential districts.
   F.   Medical and dental clinic or medical health center.
   G.   Mortuary or funeral home.
   H.   Natural resources development, together with the necessary buildings, apparatus or appurtenances incidental thereto.
   I.   Nursing or convalescent homes.
   J.   Planned unit developments.
   K.   Religious institutions including places of worship, schools and convents.
   L.   Research and development centers for experimental or scientific investigation of materials, methods or products.
   M.   Neighborhood commercial uses serving the local residents.
   N.   Other uses deemed similar by the city to the uses above may be considered under a conditional use application.
   O.   Public utilities and public service uses or structures other than the city of Weiser. (Ord. 1183, 12-12-2005)

10-7-3: LOT AREA REGULATIONS:

   A.   Minimum lot area, nine thousand six hundred (9,600) square feet.
   B.   Minimum at width, seventy five feet (75').
   C.   Front yard not less than twenty five feet (25') from property line or the established setback line in compliance with subsections 10-11-1D and E of this title.
   D.   Side yard not less than six feet (6') with a combined total of both side yards of not less than fifteen feet (15').
   E.   Rear yard, not less than twenty five feet (25') from the property line.
   F.   Minimum open space, sixty five percent (65%). Open space is that area of blue sky above, including driveway and parking area.
   G.   No structure shall be placed on any utility easement of record. (Ord. 1183, 12-12-2005)

10-7-4: HEIGHT RESTRICTIONS:

The height restrictions for the A residence district shall be two and one-half (21/2) stories but not exceeding thirty five feet (35'). (Ord. 1183, 12-12-2005)
