This chapter is to regulate the location of public utilities. This chapter shall be in addition to the property
standards contained within the provisions of each respective

13-15-2: APPROVAL AUTHORITY:
The
or his designee may approve the following public utilities in any
:
A. Electric power transmission and distribution lines with a capacity of less than sixty nine (69) kV.
B. Gas transmission and distribution lines with a design pressure of less than six hundred (600) psi and pipe diameter of less than sixteen inches (16").
C. Canals and water transmission and distribution lines with a capacity of less than two hundred (200) second feet.
D.
roads and driveways.
E. Railroad tracks.
F. Telephone lines.
G. Cable television lines.
H. Sewer lines.
I. Any rights of way, service driveways or accessory structures which are accessory to the uses listed in this section. (2001 Code § 89-6-902; amd. Ord. 19-50, 12-11-2019, Effective at 12 noon on January 6, 2020)
13-15-3: CONDITIONAL USE PERMIT REQUIRED:
The following large scale public utilities or others may be established in all zones, subject to the granting of a
:
A. Electric power transmission lines with a capacity of sixty nine (69) kV or greater.
B. Gas transmission lines with a design pressure of six hundred (600) psi or greater and pipe diameter of sixteen inches (16") or larger.
C. Water transmission lines with a capacity of two hundred (200) second feet or greater.
D. Communication towers.
E. Any rights of way, service driveways or accessory structures that are appurtenant of the uses listed in subsections A through D of this section. (2001 Code § 89-6-902)
13-15-4: DEVELOPMENT STANDARDS:
Public utility structures shall be subject to all of the height, bulk, location and other standards for the
in which they are located, except:
A. There shall be no minimum zoning
size required.
B. Only walled and/or roofed structures shall be required to meet the
requirements (setbacks) of the
. Otherwise, the
listed in this chapter shall have no minimum yard requirements.
C. Public utility lots, facilities or structures shall not be required to have frontage on a
, so long as access adequate for the public utility's purposes is available to the public utility through an
