§ 18-12

VIOLATIONS AND PENALTIES.

a. 
This Chapter shall be enforced as hereinafter provided by the Building Inspector, or Code Enforcement Officer, who is empowered to cause any building, structure, plans, or premises to be inspected and examined and to order in writing the remedying of any condition found to exist therein or Chapter thereat in violation of any provision of this Chapter. The owner or agent of a building or premises where a violation of any provision of this Chapter shall have been committed or shall exist, or the lessee or tenant of any part of the building or premises in which such violation shall have been committed, or shall exist, or the agent, architect, builder, contractor, or any person who shall maintain any building or premises in which any violation of this Chapter shall exist, shall for each and every violation upon conviction be imprisoned in the Monmouth County Jail for a period not exceeding 30 days or be fined not exceeding $500 or both. Each day that a violation is permitted to exist shall constitute a separate offense. The penalty for construction without first having obtained a permit shall be no less than $500 and no more than $2,000.
b. 
In addition to the powers given to the Building Inspector and Code Enforcement Officer as aforesaid; the owner of, or any person having interest in, any property in the Borough of West Long Branch, may make complaint for any violation of this Chapter or any provision or section thereof, and upon conviction, in such case, the penalties hereinbefore provided shall be imposed.
c. 
In addition to the remedy or remedies hereinbefore provided, any person, persons, company or corporation violating this Chapter or any provision or section thereof, may be proceeded against by the Borough of West Long Branch, or by the Building Inspector or Code Enforcement Officer of the Borough of West Long Branch, or by the owner of any property in the Borough of West Long Branch, by appropriate action or proceeding in equity or otherwise to prevent and enjoin any threatened violation or any existing violation or any continuing violation of this Chapter or any provision or section thereof.
d. 
Any person or entity who is found guilty of violating the impervious coverage ordinances of the Borough shall, in addition to any monetary penalty, be required to restore the property so that the property conforms to the impervious coverage limits for such properties in the zone in which the property exists; with the court specifying the time within which such restoration shall occur.
