ARTICLE I

General Provisions

§ 470-1 Title.

An ordinance limiting and restricting to specified zones and regulating therein buildings and structures according to their construction and the nature and extent of their use and the nature and extent of the uses of land and the exercise of such authority, subject to the provisions of law, regulating and restricting the height, number of stories and sizes of buildings and other structures; the percentage of the lot that may be occupied; the sizes of yards, courts and other open spaces; the density of population and the location and use and extent of use of buildings and structures and land for trade, industry, residence or other purposes; establishing a Zoning Hearing Board; and repealing all prior ordinances relating to zoning; and providing penalties for the violation of the terms and provisions thereof, in the Borough of West York, in the County of York and Commonwealth of Pennsylvania.

§ 470-2 Short title.

This chapter shall be known as the "West York Borough Zoning Ordinance" (hereinafter "Ordinance").

§ 470-3 Purposes.

This chapter is enacted for the following purposes:
A. 
To promote, protect and facilitate one or more of the following: the public health, safety, morals, general welfare, coordinated and practical community development, proper density of population, civil defense, disaster evacuation, airports, and national defense facilities, the provision of adequate light and air, police protection, vehicle parking and loading space, transportation, water, sewage, schools, public grounds and other public requirements, as well as fire protection.
B. 
To prevent one or more of the following: overcrowding of land, danger and congestion in travel and transportation, loss of health, life or property from fire, flood, panic or other dangers.
C. 
This chapter is enacted as part of the overall plan for the orderly growth and development of West York Borough and ,as such, it is an integral part of the West York Borough Comprehensive Plan.

§ 470-4 Interpretation.

In interpreting and applying the provisions of this chapter, they shall be held to be the minimum requirements for the promotion of the public health, safety, comfort, convenience and general welfare. Where the provisions of this chapter impose greater restrictions than those of any statute, other ordinance, or regulation, the provisions of this chapter shall be controlling. Where the provisions of any statute, other ordinance or regulation impose greater restrictions than this chapter, the provisions of such statute, other ordinance or regulation shall be controlling.

§ 470-5 Applicability of district regulations.

The regulations set by this chapter within each district shall be minimum regulations and shall apply uniformly to each class or kind of structure or land, except as hereinafter provided.
A. 
No building, structure or land shall hereafter be used or occupied and no building or structure or part thereof shall hereafter be erected, constructed, reconstructed, moved or structurally altered unless in conformity with all the regulations herein specified for the district in which it is located and otherwise required by this chapter. No lot shall have erected upon it more than one principal building.
B. 
No building or other structure shall hereafter be erected or altered:
(1) 
To exceed the height;
(2) 
To accommodate or house a greater number of families;
(3) 
To occupy a greater percentage of lot area; or
(4) 
To have narrower or smaller rear yards, front yards, side yards or other open spaces than shall be required by the regulations herein specified for the district in which such building or other structure is located or as may be otherwise required by this chapter.
C. 
No part of a yard or other open space or off-street parking or loading space required about or in connection with any building for the purpose of complying with this chapter shall be included as part of a yard, open space or off-street parking or loading space similarly required for any other building.
D. 
No yard or lot existing at the time of passage of this chapter shall be reduced in dimension or area below the minimum requirements set forth herein. Yards or lots created after the effective date of this chapter shall meet at least the minimum requirements established by this chapter.

§ 470-6 Community development objectives.

This chapter is enacted as part of the overall plan for the orderly growth and development of West York Borough. As such, this chapter is based upon the expressed or implied community development goals and objectives as contained in the West York Comprehensive Plan of 1993, as amended.
