Establishment of Zoning Districts and Map

§ 470-10 List of districts.

For the purpose of this chapter, the territory of West York Borough is hereby divided into the following zoning districts.
R-1
Residential District
R-2
Residential District
C
Commercial District
I-1
Limited Industrial District
I-2
Heavy Industrial District

§ 470-11 Zoning Map.

The boundaries of the above zoning districts are delineated on a map entitled "Comprehensive Zoning Map, Borough of West York, York County, Pennsylvania" which accompanies and which, with all explanatory matter thereof, is hereby made a part of this chapter.[1]

§ 470-12 Interpretation of district boundaries.

Where uncertainty exists as to the boundaries of the zoning districts shown on the Zoning Map, the following rules shall apply:
A. 
Boundaries indicated as approximately following the center lines of streets, highways or alleys shall be construed to follow such center lines;
B. 
Boundaries indicated as approximately following platted lot lines shall be construed as following such lot lines;
C. 
Boundaries indicated as approximately following municipality limits shall be construed as following such municipality limits;
D. 
Boundaries indicated as following railroad lines shall be construed to be midway between the main tracts;
E. 
Boundaries indicated as following shorelines shall be construed to follow such shorelines and, in the event of change in the shoreline, shall be construed as moving with the actual shoreline; boundaries indicated as approximately following the center lines of streams, rivers or other bodies of water shall be construed as following such center lines;
F. 
Boundaries indicated as parallel to or extensions of features indicated in Subsections A through E above shall be so construed. Distances not specifically indicated on the Official Zoning Map shall be determined by the scale of the map;
G. 
Where physical or cultural features existing on the ground are at variance with those shown on the Official Zoning Map or in circumstances not covered by Subsections A through F above, the Zoning Hearing Board shall interpret the district boundaries.

§ 470-13 Newly annexed territory.

Newly annexed territory to the Borough shall automatically be construed to be located within the R-1 Residential District, subject to application for amendment and public hearing, unless otherwise indicated in the approved petition for annexation.

§ 470-14 Use adjustment on district boundaries.

In unsubdivided land where a zoning district boundary line divides a lot held in single and separate ownership, the following rule shall apply:
A. 
The use of any district may extend over the portion of the lot in any adjoining district, a distance of not more than 50 feet beyond the district boundary, provided that such boundary extension does not extend the lot frontage along a street.
