The purpose of this chapter is not the establishment or encouragement of local shopping, wholesaling or industrial uses which would inhibit the function of the highway. Driveways should be reasonably controlled and, where possible, access roads with controlled egress and ingress to highways and local roads should be encouraged.

The B-1 District should generally have direct access from a major highway or State route and, where possible because of performance characteristics, should not be in direct contact with Residence Districts.

1149.05 MAXIMUM HEIGHT OF BUILDINGS.

1149.06 OFF-STREET PARKING AND LOADING.
Off-street parking and loading facilities shall be provided and screened as specified in Chapter 1163.

1149.07 PERMITTED USES.
A building or lot within the B-1 District may be used for only the following purposes:
(a) Hotels and motels;
(b) Gasoline or service stations;
(c) Personal services, including dry cleaners, laundry, barber shop, beauty shop, shoe repair shop, tailor and dressmaker, when in connection with a hotel or motel;
(d) Restaurants and eating places;
(e) Convenience retail stores;
(f) Automobile and recreational vehicle sales;
(g) Shopping plazas, shopping malls or shopping centers;
(h) Supermarkets and department or discount stores in excess of 10,000 square feet in area;
(i) Professional offices, provided that such services are contained within a building or group of buildings in excess of 5,000 square feet in area;
(j) Banks;
(k) Assembly halls for social activities;
(l) Recreational and entertainment facilities;
(m) Wholesale facilities exceeding 10,000 square feet in area;
(n) Public and semipublic uses; and
(o) Billboards, provided that no billboard shall be placed within 500 feet of an existing billboard.

1149.08 OUTDOOR STORAGE, DISPLAYS AND SALES.
(a) No outdoor storage of any objectionable material (useable or waste) shall be permitted.
(b) Outdoor displays of large items intended for outdoor use shall be allowed, provided that no items are directly sold from such displays and that no such displays are located within required setbacks. Such displays are not intended to be permanent fixtures. Automobile sales are exempted from the provisions of this section.
(c) Outdoor seasonal sales are permitted, provided that sales areas are not located within ten feet of any right-of-way and do not interfere with pedestrian or vehicular traffic.
(d) One temporary structure, such as a tent, may be erected during the sales periods, provided that the structure occupies 400 square feet or less of ground space.
(e) Nothing in this section shall prohibit the location of displays sold on the premises under covered walkways which are part of the main building and do not extend more than eight feet beyond the building front facing.

1149.09 SCREENING.
All side and rear yards in the B-1 District abutting residentially zoned land shall be screened therefrom and shall be required to have effective screening suitable for the purpose intended and as required in this section. Such screening shall be aesthetically attractive, compatible with the surrounding residential properties and have year-round screening value. The sole use of deciduous trees and shrubs is not acceptable for screening purposes. Acceptable for such screening purposes are plantings of spruce, pine, fir or hemlock in sizes sufficient to provide effective screening at the time of planting. Arborvitae (thuja) is not acceptable for permanent screen planting. Plantings shall be so arranged as to provide both effective screening immediately, and yet provide adequate space for development at maturity. Where plant material is used, a growing strip at least six feet in width, measured perpendicular to the lot line, shall be provided. The surface of the growing strip may not be paved or covered over with any material impervious to the free passage of either air or water. Also acceptable for screening purposes are walls or fences constructed of wood products, brick, stone or precast concrete shapes other than blocks subject to the approval of the Code Enforcement Officer.

1149.10 FENCES AND HEDGES.
In addition to any fencing or screening which may be required by Section 1149.09, fences or hedges may be placed in rear yards, provided that they do not exceed seven feet in height and do not unsafely obstruct the view of pedestrian or vehicular traffic.

1149.11 TRASH AND REFUSE.
(a) All trash, refuse and waste materials shall be stored in dumpsters or other containers and shall be screened by an opaque fence, landscaping, earth berm or other suitable opaque enclosure. The average height of the enclosure shall be two feet more than the height of the container, but shall not be required to exceed eight feet in height.
(b) All trash, refuse and waste materials shall be removed at least weekly.
