CHAPTER 1153

I-1 Light Industrial District

1153.01 PURPOSE.

   The purpose of this chapter is to provide a restricted district for location of light industrial activities.

1153.02 LOCATION AND PERFORMANCE STANDARDS.

   The I-1 Light Industrial District should generally be separated from Residence Districts, although it may, when necessary, be located close to residential areas because of the restrictions on uses and performance characteristics of the district.
   All activities in the I-1 District shall be carried on in a manner not injurious or offensive to the occupants of adjacent premises, and the emission of odors, fumes, gases, dust, smoke, noise or vibrations shall not be evident beyond the property lines of a lot upon which a use is located, except for normal pedestrian and automobile ingress and egress. No residences shall be permitted in the I-1 District.

1153.03 YARD REQUIREMENTS.

   Yard requirements in the I-1 District are as follows:
   Front yard*            50 feet
   Side yard*            20 feet
   Rear yard*            40 feet

1153.04 MAXIMUM HEIGHT OF BUILDINGS.

   No building or structure shall be erected or enlarged to exceed thirty-five feet in height. (See Chapter 1161 for height exceptions.)

1153.05 OFF-STREET PARKING AND LOADING.

   Off-street parking and loading facilities shall be provided and screened as specified in Chapter 1163.

1153.06 PERMITTED AND PROHIBITED USES.

   (a)   A building or lot within the I-1 District may be used for only the following purposes:
      (1)   Plant nurseries and greenhouses;
      (2)   Contractors' establishments and construction equipment dealers, provided that material or equipment is not stored in required front yards;
      (3)   Carting, express or hauling establishments;
      (4)   Coal and building material storage and wholesaling, provided that materials are not stored in required front yards;
      (5)   Bulk storage of petroleum products;
      (6)   Blueprinting, typesetting, photo engraving, and other printing processes, provided that such operations are contained in one or more buildings not larger than a total of 5,000 square feet;
      (7)   Bottling works;
      (8)   Radio and television broadcasting stations and towers;
      (9)   Research laboratories;
      (10)   Warehouses;
      (11)   Repair services or businesses, including automobile repair garages, provided that there is no outdoor storage of materials or items being repaired within required yards, and that no outdoor storage of such materials or items shall be permitted for a period of over two weeks;
      (12)   Utilities, including railroad terminal facilities;
      (13)   Laundries and dry cleaning plants;
      (14)   Kennels, animal hospitals and veterinary offices, provided that outside runs and kennels are not within 400 feet of any Residence District;
      (15)   Industrial plants manufacturing or assembling the following: boats; small metal products such as bolts, nuts, screws, washers, rivets, nails, etc.; clothing; drugs and medicine; electrical equipment; glass products from previously manufactured glass; furniture and wood products; and plastic products for production of finished equipment;
      (16)   Airports, railroad stations and bus terminals;
      (17)   Office buildings and offices;
      (18)   Billboards, provided that no billboard shall be placed within 500 feet of an existing billboard; and
      (19)   Accessory buildings, structures and uses, provided that such uses shall not be located in any required yard.
   (b)   After passage of this Zoning Code, no dwelling may be built, located, enlarged or structurally altered in the I-1 District.
   (c)   Conditional Uses. Subject to the approval of the Building and Zoning Board of Appeals and Council, a building or lot within an I-1 District may be used for the following use and purpose:
      (1)   Retail sales.

1153.07 SCREENING.

   All side and rear yards in the I-1 District abutting residentially zoned land shall be screened therefrom and shall be required to have effective screening suitable for the purpose intended and as required in this section. Such screening shall be aesthetically attractive, compatible with the surrounding residential properties and have year-round screening value. The sole use of deciduous trees and shrubs is not acceptable for screening purposes. Acceptable for such screening purposes are plantings of spruce, pine, fir or hemlock in sizes sufficient to provide effective screening at the time of planting. Arborvitae (thuja) is not acceptable for permanent screen planting. Plantings shall be so arranged as to provide both effective screening immediately, and yet provide adequate space for development at maturity. Where plant material is used, a growing strip at least six feet in width, measured perpendicular to the lot line, shall be provided. The surface of the growing strip may not be paved or covered over with any material impervious to the free passage of either air or water. Also acceptable for screening purposes are walls or fences constructed of wood products, brick, stone or precast concrete shapes other than blocks, subject to the approval of the Code Enforcement Officer.

1153.08 TRASH AND REFUSE.

   All trash, refuse and waste material shall be stored inside a main building or enclosure until removed from the site.
