CHAPTER 1147

R-4 Multiple-Family Residence District

1147.01 PURPOSE.

   The purpose of this chapter is to create living areas of moderate density in two-family and multiple-family dwellings.

1147.02 LOCATION.

   The R-4 District should generally be located near the following facilities and services:
   (a)   Collector or arterial streets;
   (b)   Public transportation;
   (c)   Shopping facilities;
   (d)   Schools;
   (e)   Parks and recreation areas;
   (f)   Public sewer and water facilities; and
   (g)   Police and fire protection.
   The moderate population density of the R-4 District and the limited elevation of structures therein tend to make such district reasonably compatible with single-family residential areas, and such district can be located in close proximity thereto under good design principles.

1147.03 MINIMUM DIMENSIONAL REQUIREMENTS.

   No building shall be erected or enlarged in the R-4 District unless the following minimum requirements are met:

1147.04 MAXIMUM DENSITY.

   The total floor area shall not exceed .30 square foot for each square foot of lot area, and the number of dwelling units shall not exceed fifteen per lot acre. Lot acreage, for this computation, may include one-half of one public street which the lot acreage abuts.
   Lot area x .30 = allowable floor area (square feet)
   Lot acreage x 15 = allowable number of dwelling units

1147.05 MINIMUM FLOOR AREA.

   No dwelling unit in the R-4 District shall have less than 700 square feet of floor area, provided, however, that a single-family dwelling shall have not less than 1,000 square feet of floor area.

1147.06 MINIMUM OPEN SPACE.

   In the R-4 District, open space is the total land area of the lot minus the total area of such lot used for buildings. There shall be not less than 2.3 square feet of open space for each square foot of floor area.

1147.07 MINIMUM LIVABLE SPACE.

   Livable space is that part of the open space, as defined in Section 1147.06, remaining after excluding therefrom the nonenclosed space for vehicular parking and vehicular movement. There shall be not less than 1.3 square feet of livable space for each square foot of floor area.

1147.08 MAXIMUM HEIGHT OF BUILDINGS.

   No building or structure shall be erected or enlarged to exceed three stories or thirty- five feet in height. (See Chapter 1161 for height exceptions.)

1147.09 OFF-STREET PARKING AND LOADING.

   Off-street parking and loading facilities shall be provided and screened as required in Chapter 1163.

1147.10 MAXIMUM FLOOR AREA OF BUILDINGS ON LOTS OF RECORD.

   (a)   Any lot of record in the R-4 District at the time of the adoption of this Zoning Code, having a total area of less than 8,400 square feet, or a width of less than seventy feet, shall not have constructed thereon a building containing a floor area exceeding .20 square feet for each square foot of lot area.
   Lot area x .20 = allowable floor area (square feet)
   (b)   Any lot of record in the R-4 District at the time of the adoption of this Zoning Code, exceeding both the area and width requirements under subsection (a) hereof, but having a total area of less than 9,000 square feet, or a width of less than eighty feet, shall not have constructed thereon a building containing a floor area exceeding .25 square feet for each square foot of lot area.
   Lot area x .25 = allowable floor area (square feet)
   (c)   On any lot of record in the R-4 District at the time of the adoption of this Zoning Code, having less than 5,000 square feet of land area, one dwelling unit shall be permitted thereon, provided that the yard and other requirements of this Zoning Code are met. (Ord. 4320. Passed 11-15-93.)

1147.11 PERMITTED USES.

   A building or lot within the R-4 District may be used for the following purposes only:
   (a)   Single-family dwellings;
   (b)   Two-family dwellings;
   (c)   Apartment buildings;
   (d)   Group homes;
   (e)   Condominiums and townhouses;
   (f)   Public uses of a nonindustrial nature;
   (g)   Semipublic uses;
   (h)   Accessory buildings and uses are permitted in an R-4 District, including, but not limited to, the following:
      (1)   Private automobile garages;
      (2)   Swimming pools, provided that they are located only in the buildable portion of a lot or in a required rear yard and are not closer to any lot line than ten feet.
         An accessory building shall be located in the rear yard area, not to exceed twenty-five feet in height, with a minimum side yard of five feet and a five-foot minimum setback from the rear yard line. An accessory building shall not occupy more than thirty-five percent of the required rear yard. An accessory building shall not be closer than ten feet to the main building on the lot.
         Where there is a corner lot and the house should face the side street, and a variance has been granted for less than the standard rear lot, an accessory building may be built in the side yard if the side yard is forty feet. The accessory building must be located behind an imaginary line extended from the mid-point of the main building or fifty feet from the front property line, whichever would be the most feasible.
   (i)   Recreational vehicles may be parked or maintained outside in an R-4 District for a period of time not to exceed three consecutive days, unless proper paved storage and parking places are provided in a rear yard, not to exceed one recreational vehicle and one pleasure boat per living unit.
      A single-family use of lots in an R-4 District for purposes of recreational vehicle storage or parking (if adequate yard space exists) shall be governed by Section 1145.06(a)(8).

1147.12 FENCES AND HEDGES. (REPEALED)

   (EDITOR’S NOTE: Section 1147.12 was repealed by Ordinance No. 5835, passed October 21, 2019.)

1147.13 ROW OR MOTEL-TYPE DWELLING UNITS.

   In two-family and multiple-dwelling buildings with attached dwelling units, which are of a row house nature with party walls between dwelling units and private or semiprivate entrances, each dwelling unit shall have provided adjacent to one exterior face and open space extending twenty feet horizontally outward at right angles the full width of the building face. For each dwelling unit which has two exterior faces parallel to each other, there shall be provided adjacent to the second exterior face an open space extending ten feet horizontally outward at right angles the full width of the building face. (See Diagram B for illustration of open space requirements.)
In addition, the following conditions shall apply:
   (a)   Vehicular parking areas and driveways shall be prohibited from both required open spaces.
   (b)   An open space which fulfills one of the above requirements for one dwelling unit shall not be used to satisfy the requirements for another dwelling unit, except for adjacent dwelling units on the inside corner of a building or adjacent buildings whose exterior walls are at right angles to each other, in which case the required yards may overlap. (See Diagram C for illustration of interior corners where open space requirements may be shared.)

1147.14 CONDITIONAL USES.

   The following conditional uses are permitted in an R-4 District, subject to compliance with the conditions hereinafter set forth:
   (a)   Mortuary. The minimum lot size shall be 24,000 square feet. The required plan shall show location of all buildings, drives, parking, screening or screened planting, and interior location and size of any parlors or service rooms. A four-foot high screen fence shall be provided for any parking area adjoining a Residence District or a residential use in a Planned Unit Development District. Single nonilluminated or indirectly illuminated exterior signs containing a maximum of twenty-four square feet shall be permitted. The Code Enforcement Officer shall insure that adequate ingress, egress and parking are provided. Trash and refuse storage shall meet those requirements found in Section 1151.11.
   (b)   Nursing Homes, Day-Care Centers, Nursery Schools, Rest Homes and Homes for the Aged. The minimum lot size shall be 12,000 square feet for the first ten beds and 1,000 square feet for each additional bed. A four-foot decorative fence shall be provided on all property lines adjoining a Residence District or a Planned Unit Development District. An enclosed recreation area, open or partially under roof, containing a minimum of fifty square feet per bed, shall be provided. There shall be a minimum of sixty feet of frontage on a major street which frontage shall contain at least one entry drive to the site. The required site plan shall show all drives, parking areas, building locations, recreation areas and screening or screened planting. The Code Enforcement Officer shall insure that adequate ingress, egress, parking and protection of adjacent property is provided. Trash and refuse storage shall meet the requirements found in Section 1151.11.
   (c)   Retail Sales and Allied Activities. Retail sales and allied activities which are convenient to and designed primarily to serve a neighborhood's resident population, and not intended for activities which may attract from the entire City or major portions thereof, are permitted, subject to the following conditions:
      (1)   Such retail uses shall be limited to buildings of 2,000 square feet in area or less, and shall also be located only on major or arterial streets.
      (2)   Retail uses shall be limited to convenience retail items and video rental stores. Gasoline sales may be permitted as an accessory use to a retail store, but no gas pumps or storage tanks shall be allowed in any required yard.
      (3)   No business shall remain open between the hours of 11:00 p.m. and 6:30 a.m. of the following day, and no outdoor storage or activity (with the exception of gasoline sales) shall be allowed.
      (4)   Screening, fences and trash and refuse storage shall meet the requirements of Chapter 1151.

1147.15 TRASH AND REFUSE.

   (a)   All multiple-family residential structures containing three or more residential units shall provide dumpsters or other containers which shall be screened by an opaque fence or other suitable opaque enclosure. The average height of the enclosure shall be two feet more in height than the height of the containers, but shall not be required to exceed five feet in height.
   (b)   All trash, refuse and waste materials shall be removed at least weekly.
