MAXIMUM HEIGHT LIMITS ARE ESTABLISHED
3.101: R-1, R-D, R-2 and R-P Districts: (Amended 2-25-85; 2-14-05; 4-25-05)
A.
For detached single dwellings the maximum height shall not exceed forty-five (45) feet or two and one-half (2½) stories except as provided below.
B.
The maximum height may be increased to sixty (60) feet upon approval of the City Council after review and recommendation of the Planning and Zoning Commission and public hearings before the Planning and Zoning Commission and City Council. The procedure to be followed for the public hearing and report and recommendation of the Planning and Zoning Commission and public hearing and action by the City Council shall be the same as that required for a planned district as set forth in Section 2.2 of this Ordinance. The fee charged to an applicant for an increase in height shall be as set by the City Council by resolution, from time-to-time. Consideration will be given to existing homes and the neighborhood, and the City Council may impose such additional conditions (such as increased side yard setbacks) as it deems necessary or desirable.
C.
For accessory buildings the maximum height shall not exceed thirty-five (35) feet.
D.
Public and private schools, churches, municipal buildings, and public service buildings may be erected to a height not to exceed seventy (70) feet provided that all yard setback lines are increased one (1) foot for each foot of height exceeding thirty (35) feet.
E.
Church steeples and belfries, chimneys, cooling towers, fire towers, monuments, smoke stacks, flag poles, electric and telephone lines and poles, and residential television and radio antennae are exempt from height limitations.
F.
Those parts of buildings that are existing at the effective date of this Ordinance that violate height regulations may be repaired and remodeled, but may not be reconstructed or structurally altered.
G.
Dwellings and buildings shall not exceed the height restrictions set forth herein from any point where measured.
3.102: P-C and O-P Districts: (Amended 10-21-74, 5-22-95, 7-10-06, 10-6-08)
A.
Two and one-half (2½) stories or thirty-five (35) feet in a P-C or O-P District; or
B.
Three and one-half (3½) stories or forty-five (45) feet in a P-C or O-P District upon approval of the City Council after review and recommendation of the Planning and Zoning Commission and public hearings before the Planning and Zoning Commission and the City Council. The procedure to be followed for the public hearing and report and recommendation of the Planning and Zoning Commission and action by the City Council shall be the same as that required for a planned district as set forth in Section 2.2 of this Ordinance; or
C.
Six (6) stories and seventy (70) feet in a P-C District which is located within the Building Height Overlay District, a map of which is on file in the office of the City Secretary, upon approval of the City Council after review and recommendation of the Planning and Zoning Commission and public hearings before the Planning and Zoning Commission and the City Council provided that the building is set back at least one (1) foot for every foot of height exceeding thirty-five (35) feet and provided that the building height does not exceed the seventy (70) foot height restriction from any point where it is measured. The procedure to be followed for the public hearing and report and recommendation of the Planning and Zoning Commission and action by the City Council shall be the same as that required for a planned district as set forth in Section 2.2 of this Ordinance.
3.103: M-P and M Districts: (Amended 12-27-04)
A.
Any building may be erected to a height of seventy (70) feet provided that the building is setback at least one (1) foot for every foot of height exceeding thirty-five (35) feet and provided that the building height does not exceed the seventy (70) foot height restriction from any point where it is measured, with the exception of the items which are exempt from the height restrictions as set forth in Section 3.103 (C) of this Ordinance; or
B.
Upon approval of the City Council after review and recommendation of the Planning and Zoning Commission and public hearings before the Planning and Zoning Commission and City Council, a building may be erected to a height of eighty (80) feet provided that the building is set back at least one (1) foot for every foot of height exceeding thirty-five (35) feet and provided that the building height does not exceed the eighty (80) foot height restriction from any point where it is measured, with the exception of the items which are exempt from the height restrictions as set forth in Section 3.103 (C) of this Ordinance.
C.
Chimneys, cooling towers and air conditioning equipment, smoke stacks, flag poles, fire exit stairs and towers, elevator housings, water tanks, television, radio and communication towers are exempt from height limitations; however, these items must be in compliance with all other ordinances, rules and regulations of the city.
3.104 LR-P District: (Added 7-10-06)
A.
Any building may be erected to a height of two and one-half (2 ½ ) stories or thirty-five (35) feet.
Those parts of existing buildings that violate height specifications may be repaired and remodeled, but may be reconstructed or structurally altered only if height will thereafter conform to specifications.
