PART SIX

OFF-STREET SPACES ARE REQUIRED

Section 6.1: - The following off-street parking spaces shall be provided: (Amended 10-21-74, 7-10-06)

6.101: For single-family dwellings, two (2) spaces.

6.102: For multi-family dwellings and apartment hotels, two (2) spaces for each living unit. Such spaces shall not be closer than fifteen (15) feet to any lot line and each such space be covered by a shelter designed to complement the main structure.

6.103: For hotels, one (1) space for each guest room or suite of the first twenty (20) individual guest rooms or suites; one (1) additional parking space for each two (2) guest rooms or suites in excess of twenty (20) and not exceeding forty (40); one (1) additional space for each four (4) guest rooms or suites in excess of forty (40); plus one (1) additional space for each four (4) patron seats in rooms open to the non-resident public; plus one (1) space for each two hundred (200) square feet of display area or ballroom area.

6.104: For motels, one (1) space for each bedroom unit, plus one (1) additional space for each four (4) patron seats of facilities open to the non-resident public plus one (1) space for each two hundred (200) square feet of display area or ballroom area.

6.105: For churches erected on new sites, one (1) parking space on the lot for each four (4) seats in the main auditorium.

6.106: For places of public assembly, including auditoriums and theaters, one (1) space for each four (4) seats provided.

6.107: For elementary and junior high schools, public, parochial and private, two (2) spaces for each classroom; for senior high schools, public, parochial and private, seven (7) spaces for each classroom.

6.108: For hospitals, one (1) space for each hospital bed.

6.109: For institutions, clubs, lodges, and public buildings, one space for each one hundred fifty (150) square feet of floor area.

6.110: For uses in P-C, LR-P, M, M-P, and O-P Districts, the following off-street parking space requirements shall be observed: (Amended 7-10-06; 8-25-14)

7. All other uses not specified above or in another section of Part Six One (1) space for each two hundred (200) square feet of gross floor area

B.

In determining the number of required off-street parking spaces based upon gross floor area of a specific use, gross floor are shall mean the total floor area by such use on all stories of a structure, except for:

1.

Areas within the structure occupied by off-street parking and loading facilities;

2.

Areas occupied exclusively by mechanical equipment used for heating, ventilating and air conditioning of the structure;

3.

Non-habitable basements or cellars used for accessory storage.

C.

When the computation of off-street parking requirements results in a fractional space required, any fraction less than one-half (½) may be disregarded while a fraction of one-half (½) or greater shall be counted as on space.

D.

In the case of a mixed use, the off-street parking spaces required shall equal the sum of the requirements of the individual used computed separately. (Added 7-24-00)

6.111: For duplex dwellings, two (2) spaces for each living unit. (Added 2-25-85; Amended 8-25-14)

Section 6.2: - The Foregoing Requirements are Subject to the Following General Rules and Exceptions: (amended 10-21-74, 7-10-06)

6.201: In the P-C, O-P, M-P and M Districts, parking space may be provided on separate lot if within three hundred (300) feet of the building and two (2) or more such owners may join together in the provision of this parking space; provided such space is sufficient to meet the combined minimum parking requirements of all such owners joining together. (Amended 7-10-06)

6.202: Parking spaces for dwellings may be provided in only one (1) side and rear yards, except that parking spaces for duplex dwellings may be provided in both side yards and rear yards. On a corner lot in an R-2 or R-P District, no parking shall be permitted in the side yard adjoining the side street, unless such parking shall be screened from the public right-of-way by a wall. 6.203: All driveways and required off-street parking shall be paved with asphalt, paving stone, brick or concrete.

6.204: Parking spaces may be provided in any yard in P-C Districts, except that no parking spaces may be provided in the front yard, unless the building is set back at least forty (40) feet from the street right-of-way. (Amended 7-10-06)

6.205: No parking lot, as defined at Section 13.48, shall be permitted in the R-1, R-D, R-2 or R-P Districts; nor shall any phase of the construction of any such facility be commenced, unless a special use permit is first obtained in accordance with the Code of Ordinances and Zoning Ordinance of the City of Woodway, Texas. Such special use permit may be issued for a specified period of time, as recommended by the Planning and Zoning Commission and approved by the City Council, rather than limited to the regular time limitations of other special use permits. This provision does not prevent the providing of off-street parking spaces on a lot on which a main building or structure is located which meet or exceed the minimum requirements for off-street parking, spaces set forth at Section 6.1, and which are otherwise consistent with all other provisions of the Zoning Ordinances of the City of Woodway, Texas; provided, however, that this exception shall not apply to any lot or lots which have been created by platting or replatting of property after the initial construction of the main building or structure, unless a special use permit is first obtained as provided. 6.206: That granting of any special use permit applied for pursuant to Section 6.205 shall be conditioned upon compliance with the following requirements:

A.

Submission to the Planning and Zoning Commission of:

1.

Detailed plans which show any existing structures, trees and shrubs on the property prior to the proposed conversion to a parking lot;

2.

A drainage plan for the property after conversion to a parking lot;

3.

A plan showing the parking spaces and entrances to the parking lot and a detailed landscaping plan for the parking lot that will within a reasonable time:

(a)

Utilize solid shrubs and hedges along the perimeter of the parking lot with the purpose to restrict the view of the parking lot from streets and surrounding property, except at driveways and street corners, which shall comply with other city ordinances;

(b)

Utilize both existing and new trees to shade the parking lot, with the purpose to reduce the excess heat from paved surfaces;

(c)

Utilize solid fencing with a minimum height of six (6) feet along that portion of the parking lot that borders property on which a residence is located to reduce noise and provide privacy to the adjoining property at the request of the existing adjoining property owner or owners at the time the permit is issued.

4.

A plan showing the details of the proposed pavement, its composition and design of the subgrade base and surface.

B.

Parking lots in the R-1, R-D, R-2 and R-P Districts shall only be located on the lot with the main building; or, if on a separate lot, both lots must be joined by the entire property lines on the sides or rear of the lots and shall not be separated by a street.

C.

1.

The paved surface of the parking lot shall have a minimum setback distance from streets and adjoining property for a greenbelt area as follows:

(a)

Distance from streets—Five (5) feet from the property line and to comply with other city ordinances with regard to shrubs and trees located at intersections.

(b)

Distance from adjoining property—Five (5) feet.

2.

Landscaping, to include hedges, shrubs, grass and trees, must be provided in the greenbelt and must be continuously maintained.

D.

A special use permit granted pursuant to Section 6.205 may be revoked by the City at any time for noncompliance with the terms of the permit or other city ordinances. (Added 12-14-87)

Section 6.3. -

Existing buildings, not complying with off-street parking requirements, may be remodeled, repaired and structurally altered; but any enlargement must provide the parking spaces as required by the enlargement.
