MINIMUM YARDS ARE ESTABLISHED
Except as provided in Section 4.2 and 4.3 and Section 7, Yards shall be provided for buildings as follows: (Amended 10-21-74, 7-10-06)
4.101: R-1, R-D, R-2, R-P Districts: (Amended 2-25-85, 5-6-91, 7-10-06)
A.
Dwellings shall have:
1.
Minimum front yard of twenty-five (25) feet measured from the property line.
2.
Minimum side yard of ten (10) feet measured from the property line.
3.
A minimum rear yard of at least thirty (30) per cent of the depth of the lot but shall not be required to exceed forty (40) feet in depth at any point when measured from the rear property line. Provided, however, that the principal structure located on the lot may extend into the required rear yard area under the following criteria:
(a)
The width of that portion of the residence extending into the 30%/40 foot rear yard area may not, itself, exceed fifty (50) per cent of the width of the principle residential structure when both are measured at their widest point;
(b)
In no event shall the rear yard be less than twenty-five (25) feet in depth at any point measured from the rear property line.
B.
Churches, public building and institutions shall provide front and rear yards of a minimum of fifty (50) feet and side yards of a minimum of twenty-five (25) feet.
C.
On corner lots, a front yard must be provided on both streets and no wall, fence, sign, structure, or view obstructing plant growth may be maintained within fifteen (15) feet of the intersection.
4.102: P-C, M, and M-P Districts: Except as provided in Section 4.2 and at the discretion of the Planning and Zoning Commission there are no minimum yard requirements for P-C, M Districts, or M-P Districts. (Amended 7-10-06)
4.201: On lots fronting on two (2) nonintersecting streets, a front yard must be provided on both streets.
4.202: On corner lots in the R Districts, there shall be a yard along the side-street side of such tract of at least fifteen (15) feet, except that, in the case of separate tracts which are less than seventy-five (75) feet in width, only twenty (20) per cent of the width of the lot need be provided for such yard, so long as the buildable width of a corner lot shall never be less than thirty (30) feet. On corner lots in P-C and M Districts, there shall be a yard along the side-street side of such tract of at least five (5) feet. Provided that in a R District, where the rear yard of a corner lot abuts on the side yard of an adjacent lot, such corner lot shall provide a side yard along the side-street side of such tract which is equal in width to the depth required for the front yard of such adjacent lot. In those instances where the area adjacent to the rear yard of a corner lot in a R District has not been developed or the preliminary plat for such area has not been approved, such corner lot shall provide a side yard along the side-street side of as least twenty-five (25) feet, except that the Planning and Zoning Commission may in the exercise of its discretion, permit such side yard to be only fifteen (15) feet in width.
4.203: On corner lots in the P-C, M-P and M Districts that rear upon the R District, a ten-foot yard must be provided along the side-street side.
4.204: Where a block frontage is divided among districts with different front yard requirements, the deepest front yard as required by this Ordinance shall apply to the entire frontage.
4.205: Where a lot is in a P-C, O-P, M-P or M District and is next to an R District, the side or rear yard required in that R District must be provided along the common property lines adjacent to the lot in such P-C, O-P, M-P, or M Districts.
4.206: In the P-C, M-P and M Districts there may be more than one (1) commercial or industrial building on a lot provided that the required yards be maintained around the group of buildings.
4.207: There may be two (2) or more related multifamily, hotel, motel, or institutional buildings on a lot; provided that (a) the required yards be maintained around the group of buildings, and (b) buildings that are parallel, or that are within forty-five (45) degrees of being parallel, be separated by a horizontal distance that is at least equal to one-half (½) the height of the highest building, or fifteen (15) feet, whichever is greater.
4.208: Those parts of existing buildings that violate yard regulations may be repaired and remodeled, but not reconstructed or structurally altered, except as provided in Part Eight.
4.209: Required front yards shall be used only for landscaping, walkways, and driveways necessary for access to the parking areas. In the R-P, P-C, M-P and M Districts and any other planned districts, signs, and light standards may be only of such construction and shall be located only in accordance with plans approved by the Planning and Zoning Commission. No other structures are permitted. Required back yards and side yards shall be used only for landscaping in P-C, O-P, M-P, and M Districts that adjoin an R District.
4.301: On separate tracts of less than eighty (80) feet in width, the side yard may be reduced to ten (10) per cent of the tract width.
4.302: On separate tracts of less than one hundred (100) feet in depth, the rear yard may be reduced to twenty (20) per cent of the tract depth.
4.303: Where, on the effective date of this Ordinance, forty (40) per cent or more of a block frontage was occupied by two (2) or more buildings, then the front yard is established in the following manner:
A.
Where the building furthest from the street provides a front yard not more than ten (10) feet deeper than the building closest to the street, then the front yard for the frontage is and remains an average of the then existing front yards.
B.
Where this subsection A is not the case, and a lot is within one hundred (100) feet of a building on each side, then the front yard is a line drawn from the closest front corners of those two (2) adjacent buildings.
C.
Where neither A nor B is the case, and the lot is within one hundred (100) feet of an existing building on one (1) side only, then the front yard is the same as that of the existing adjacent building.
4.304: Sills, belt courses, cornices, and ornamental features may project only one (1) foot into a required yard.
4.305: Open fire escapes, fireproof outside stairways and balconies opening upon fire towers, and the ordinary projections of chimneys and flues into a rear yard for a distance of not more than three and one-half (3½) feet, when so placed as to not obstruct light and ventilation, may be permitted by the City of Woodway.
4.306: Open, unenclosed porches, (not glassed-in) and canopies may extend ten (10) feet into a front yard.
4.307: Terraces which do not extend above the level of the ground (first) floor may project into a required yard, provided these projections be distant at least two (2) feet from the adjacent lot line.
4.308: Single-family dwellings constructed before the effective date of this Ordinance shall not be considered nonconforming as to minimum yards.
4.309. To obtain an exception from the yard requirements of this Zoning Ordinance, the owner or developer must seek a special exception from the Board of Adjustment.
However, if the exception sought is a variance from a requirement of the Subdivision Ordinance so that the owner or developer can replat to meet the yard requirements of the Zoning Ordinance, the owner or developer must seek a variance from the Planning and Zoning Commission.(Amended 1-25-10; Amended 11-14-16)

A.

4.102: P-C, M, and M-P Districts: Except as provided in Section 4.2 and at the discretion of the Planning and Zoning Commission there are no minimum yard requirements for P-C, M Districts, or M-P Districts. (Amended 7-10-06)

On corner lots in P-C and M Districts, there shall be a yard along the side-street side of such tract of at least five (5) feet. Provided that in a R District, where the rear yard of a corner lot abuts on the side yard of an adjacent lot, such corner lot shall provide a side yard along the side-street side of such tract which is equal in width to the depth required for the front yard of such adjacent lot. In those instances where the area adjacent to the rear yard of a corner lot in a R District has not been developed or the preliminary plat for such area has not been approved, such corner lot shall provide a side yard along the side-street side of as least twenty-five (25) feet, except that the Planning and Zoning Commission may in the exercise of its discretion, permit such side yard to be only fifteen (15) feet in width.
4.203: On corner lots in the P-C, M-P and M Districts that rear upon the R District, a ten-foot yard must be provided along the side-street side.

4.307: Terraces which do not extend above the level of the ground (first) floor may project into a required yard, provided these projections be distant at least two (2) feet from the adjacent lot line.
4.308: Single-family dwellings constructed before the effective date of this Ordinance shall not be considered nonconforming as to minimum yards.
4.309. To obtain an exception from the yard requirements of this Zoning Ordinance, the owner or developer must seek a special exception from the Board of Adjustment.
However, if the exception sought is a variance from a requirement of the Subdivision Ordinance so that the owner or developer can replat to meet the yard requirements of the Zoning Ordinance, the owner or developer must seek a variance from the Planning and Zoning Commission.(Amended 1-25-10; Amended 11-14-16)
