CHAPTER 69

PARKING REGULATIONS

69.01 PARK ADJACENT TO CURB.

   No person shall stand or park a vehicle in a roadway other than parallel with the edge of the roadway headed in the direction of lawful traffic movement and with the right-hand wheels of the vehicle within 18 inches of the curb or edge of the roadway except as hereinafter provided in the case of angle parking and vehicles parked on the left-hand side of one-way streets.

69.02 PARKING ON ONE-WAY STREETS.

   No person shall stand or park a vehicle on the left-hand side of a one-way street other than parallel with the edge of the roadway headed in the direction of lawful traffic movement and with the left-hand wheels of the vehicle within 18 inches of the curb or edge of the roadway except as hereinafter provided in the case of angle parking.

69.03 ANGLE PARKING.

   Angle or diagonal parking is permitted only in the following locations:

   1.   2 nd Street SE, on both sides, from 1 st Avenue South to 2 nd Avenue SE.
   2.   Center Place, on both sides, from 5 th Avenue SW to 8 th Street SW.
   3.   3 rd Avenue SW, on the west side, from 6 th Street SW and 130 feet north.
   4.   6 th Street SW, on the north side, from 3 rd Avenue SW to 5 th Avenue SW.

69.04 MANNER OF ANGLE PARKING.

   Upon those streets or portions of streets that have been signed or marked for angle parking, no person shall park or stand a vehicle other than at an angle to the curb or edge of the roadway or in the center of the roadway as indicated by such signs and markings. No part of any vehicle or the load thereon, when said vehicle is parked within a diagonal parking district, shall extend into the roadway more than a distance of 16 feet when measured at right angles to the adjacent curb or edge of roadway.

69.05 PARKING FOR CERTAIN PURPOSES ILLEGAL.

   No person shall park a vehicle upon public property for more than 48 hours, unless otherwise limited under the provisions of this chapter, or for any of the following principal purposes:

   1.   Sale. Displaying such vehicle for sale.
   2.   Repairing. For lubricating, repairing, or for commercial washing of such vehicle except such repairs as are necessitated by an emergency.
   3.   Advertising. Displaying advertising.
   4.   Merchandise Sales. Selling merchandise from such vehicle except in a duly established marketplace or when so authorized or licensed under this Code of Ordinances.

69.06 PARKING PROHIBITED.

   No one shall stop, stand, or park a vehicle except when necessary to avoid conflict with other traffic or in compliance with the directions of a peace officer or traffic control device, in any of the following places:
   1.   Crosswalk. On a crosswalk.

   2.   Center Parkway. On the center parkway or dividing area of any divided street.

   3.   Mailboxes. Within 20 feet on either side of a mailbox that is so placed and so equipped as to permit the depositing of mail from vehicles on the roadway.

   4.   Sidewalks. On or across a sidewalk.

   5.   Driveway. In front of a public or private driveway.

   6.   Intersection. Within an intersection or within 10 feet of an intersection of any street or alley.

   7.   Fire Hydrant. Within five feet of a fire hydrant.

   8.   Stop Sign or Signal. Within 10 feet upon the approach to any flashing beacon, stop or yield sign, or traffic control signal located at the side of a roadway.

   9.   Railroad Crossing. Within 50 feet of the nearest rail of a railroad crossing, except when parked parallel with such rail and not exhibiting a red light.

   10.   Fire Station. Within 20 feet of the driveway entrance to any fire station and on the side of a street opposite the entrance to any fire station within 75 feet of said entrance when properly sign posted.

   11.   Excavations. Alongside or opposite any street excavation or obstruction when such stopping, standing, or parking would obstruct traffic.

   12.   Double Parking. On the roadway side of any vehicle stopped or parked at the edge or curb of a street.

   13.   Hazardous Locations. When, because of restricted visibility or when standing or parked vehicles would constitute a hazard to moving traffic, or when other traffic conditions require, the Council may cause curbs to be painted with a yellow color and erect no parking or standing signs.

   14.   Churches, Nursing Homes, and Other Buildings. A space of 50 feet is hereby reserved at the side of the street in front of any theatre, auditorium, hotel having more than 25 sleeping rooms, hospital, nursing home, taxicab stand, bus depot, church, or other building where large assemblages of people are being held, within which space, when clearly marked as such, no motor vehicle shall be left standing, parked or stopped except in taking on or discharging passengers or freight, and then only for such length of time as is necessary for such purpose.

   15.   Alleys. No person shall park a vehicle within an alley in such a manner or under such conditions as to leave available less than 10 feet of the width of the roadway for the free movement of vehicular traffic, and no person shall stop, stand, or park a vehicle within an alley in such a position as to block the driveway entrance to any abutting property. The provisions of this subsection do not apply to a vehicle parked in any alley that is 18 feet wide or less, provided that said vehicle is parked to deliver goods or services.

   16.   Ramps. In front of a curb cut or ramp which is located on public or private property in a manner which blocks access to the curb cut or ramp.

   17.   In More Than One Space. In any designated parking space so that any part of the vehicle occupies more than one such space or protrudes beyond the markings designating such space.

69.07 PERSONS WITH DISABILITIES PARKING.

   The following regulations shall apply to the establishment and use of persons with disabilities parking spaces:
   1.   Establishment. Persons with disabilities parking spaces shall be established and designated in accordance with Chapter 321L of the Code of Iowa and Iowa Administrative Code, 661-18. No unauthorized person shall establish any on-street persons with disabilities parking space without first obtaining Council approval.
   2.   Improper Use. The following uses of a persons with disabilities parking space, located on either public or private property, constitute improper use of a persons with disabilities parking permit, which is a violation of this Code of Ordinances:

      A.   Use by an operator of a vehicle not displaying a persons with disabilities parking permit.
      B.   Use by an operator of a vehicle displaying a persons with disabilities parking permit but not being used by a person issued a permit or being transported in accordance with Section 321L.2(1)(b) of the Code of Iowa.
      C.   Use by a vehicle in violation of the rules adopted under Section 321L.8 of the Code of Iowa.
   3.   Wheelchair Parking Cones. No person shall use or interfere with a wheelchair parking cone in violation of the following:
      A.   A person issued a persons with disabilities parking permit must comply with the requirements of Section 321L.2A(1) of the Code of Iowa when utilizing a wheelchair parking cone.
      B.   A person shall not interfere with a wheelchair parking cone that is properly placed under the provisions of Section 321L.2A(1) of the Code of Iowa.

69.08 NO PARKING ZONES.

   No one shall stop, stand, or park a vehicle in any of the following specifically designated no parking zones except when necessary to avoid conflict with other traffic or in compliance with the direction of a peace officer or traffic control signal.

   1.   6 th Street SW, on the south side, from the intersection of 6 th Street SW and 3 rd Avenue SW for a distance of 380 feet west, between the hours of 7:00 a.m. and 4:00 p.m. from August 15 to June 15 of each year.
   2.   8 th Avenue SE, on the west side, from 1 st Street East to 8 th Street SE.
   3.   8 th Street SW and 8 th Street SE, on both sides, within the City limits.
   4.   1 st Avenue, on both sides, from the north City limits to the south City limits.
   5.   Adventureland Drive NW and Adventureland Drive NE, on both sides, within the City limits.
   6.   17 th Avenue SW and 17 th Avenue NW, on both sides, within the City limits.
   7.   4 th Street SW, on the south side, commencing at the entrance to Lions Park, westbound for a distance of 250 feet.
   8.   4 th Street SW, on the south side, commencing at the entrance to Lions Park, eastbound for a distance of 200 feet.
   9.   4 th Street SW, on both sides, from 7 th Avenue SW to 9 th Avenue SW.
   10.   3 rd Street SW, on both sides, from 7 th Avenue SW east on 3 rd Street SW 160 feet.
   11.   On the inside of the circle formed by the following streets: 5 th Avenue SE south from 5 th Street SE to 8 th Street Place SE, 8 th Street Place SE from 5 th Avenue SE east to 6 th Avenue SE, 6 th Avenue SE north to 5 th Street SE, 5 th Street SE west to 5 th Avenue SE.
   12.   On the inside of the circle of 7 th Avenue Court NE from 100-140 7 th Avenue Court NE.
   13.   On the inside of the circle formed by the following streets: 7 th Street NW east from 5 th Avenue NW to 4 th Avenue NW, 4 th Avenue NW south to 6 th Street NW, 6 th Street NW west to 5 th Avenue NW, 5 th Avenue NW north to 7 th Street NW.
   14.   On the inside of the half circle formed by Rosa Drive from the 1,300 to 1,400 block of said named Rosa Drive.
   15.   On the inside of the circle formed by the following streets: 3 rd Street NW west from 5 th Avenue NW to 7 th Avenue NW, 7 th Avenue NW north from 3 rd Street NW to 4 th Street NW, 4 th Street NW east from 7 th Avenue NW to 5 th Avenue NW.
   16.   Timberline Road, on the north side, within City limits.
   17.   Brookview Drive, on the east side, and also on the north side and west side of the turnaround area at the northern end of Brookview Drive.
   18.   31 st Avenue SW on the east side.
   19.   Scenic View on the east side.
   20.   4 th Street SW from 17 th Avenue SW to a point approximately 260 feet west between the hours of 7:00 a.m. to 4:00 p.m. from August 15 to June 15 each year.
   21.   36 th Avenue SW and NW, on both sides, from 8 th Street to Hubbell Avenue.
   22.   Birch Lane (frontage road) on both sides.
   23.   8 th Street Court SW, on the south side, from Scenic View Boulevard to a point 40 feet east.
   24.   2 nd Street NW, on the south side, from 5 th Avenue NW to a point 95 feet east.
   25.   4 th Street SW, on the south side, from 3 rd Avenue SW to a point 120 feet west.
   26.   31 st Avenue SW, on the west side, from 8 th Street SW to the northern end of the street.
   27.   3 rd Street SW, on the south side, from 17 th Avenue SW to a point 80 feet east.
   28.   13 th Street SE, on the south side, 1 st Avenue S to a point 150 feet east.
   29.   9 th Street SE, on the south side, from 7 th Avenue SE to a point 75 feet west.
   30.   4 th Street NW, on the south side, from 17 th Avenue NW east to the east side of the 14 th Avenue NW intersection.
   31.   1 st Avenue, on the east side of the off-street parking area, between 2 nd Street NW and 7 th Street NW between the hours of 12:00 a.m. and 5:00 a.m.
   32.   Falcon Drive SE from 250 feet north and south of the intersection of the centerlines of Falcon Drive SE and 8 th Street SE.
   33.   9 th Street From 125 feet west of the intersection of the centerlines of 1 st Avenue N and 9 th Street to 14 th Avenue NE.

69.09 TRUCK PARKING LIMITED.

   The parking of truck or trailers or any combination thereof, weighing four tons or more, loaded or unloaded, is prohibited on or in the streets of the City and in the alleys of the City except for the purpose of loading and unloading.

69.10 PARKING LIMITED TO 15 MINUTES.

   It is unlawful to park any vehicle for a continuous period of more than 15 minutes between the hours of 7:00 a.m. and 4:00 p.m. on each weekday except Saturday, and between the hours of 7:00 a.m. and 10:00 p.m. on Saturday upon the following designated streets:

   1.   3 rd Avenue SW from the intersection of 6 th Street and 3 rd Avenue SW for a distance of 130 feet north.

69.11 SNOW REMOVAL.

   The snow removal parking ban is in effect from October though May or anytime snow or ice removal efforts are required. When the weather forecast predicts weather conditions that will require enforcement of the parking ban, a notice will be published on the City’s or Police Department’s Facebook and Twitter pages. When this section is in effect, no person, except physicians or other persons on emergency calls, shall park or leave unattended any vehicle on any public streets within the City limits. This section shall not be construed as suspending parking limitations or restrictions imposed by any other sections of this chapter.

69.12 SNOW ROUTES.

   The Council may designate certain streets in the City as snow routes. When conditions of snow or ice exist on the traffic surface of a designated snow route, it is unlawful for the driver of a vehicle to impede or block traffic.

69.13 NO PARKING ON NORTH SIDE OF STREETS.

   Parking of vehicles on the north side of all streets in the City running in an east to west direction is hereby prohibited, except on the following:
   1.   2 nd Street SE from 1 st Avenue S to 2 nd Avenue S.
   2.   4 th Street NW from 17 th Avenue NW to 14 th Avenue NW.
   3.   Center Place between 8 th Street SW and 5 th Avenue SW.
   4.   6 th Street SW between 5 th Avenue SW and 3 rd Avenue SE.
   5.   28 th Avenue SW at Oak Hill Park.

69.14 NO PARKING ON EAST SIDE OF STREETS.

   Parking of vehicles in the street on the east side of all streets in the City running in a north to south direction is hereby prohibited, except 8 th Avenue SE from 1 st Street E to 8 th Street SE.

69.15 FIRE LANES.

   No person shall stop, stand, or park a vehicle, except authorized emergency vehicles, in a designated fire lane established pursuant to Chapter 161.
