Signs and Billboards 1
§ 80-68 Permitted signs in business districts.
A.
In any Business District within the Incorporated Village of Bayville, advertisements may be posted or otherwise erected or displayed, provided that such advertisements are a necessary part of or incident to a lawful business properly transacted on the premises upon which such advertisements are so posted, erected or displayed.
B.
Any billboard, signboard or other structure, either used or to be used primarily in connection with the posting or painting thereon of bills, placards, pictures, symbols or any other advertising matter, shall be deemed a building within the meaning of the provisions of this chapter and shall not be erected unless a permit shall have been duly issued therefor by the Mayor with the approval of the Board of Trustees, upon written application to him setting forth the descriptive specifications, dimensions and location of the proposed sign structure.
§ 80-69 Signs prohibited in residence districts.
No person shall, upon or near any street or other public place in any of the residential zones within the Incorporated Village of Bayville, erect, construct, build, relocate or maintain any billboard, signboard or other structure to be used primarily for or in connection with the posting or painting thereon of bills, signs, placards, pictures or other advertising matter or post, affix, paint or otherwise display on any post, board, building or other structure any letter, work, reading matter, model, sign, device or presentation constituting an advertisement of any property, article or matter whatsoever. No owner of real property within said residential districts shall permit any of the acts herein specified.
§ 80-70 Signs permitted by right.
Nothing in this chapter shall be construed to prohibit or prevent the following:
A.
The posting, erection, maintenance or use, upon any parcel or lot of real property, of not more than one sign facing each street upon which such parcel or lot abuts, not longer than two feet and not wider than 18 inches, solely advertising the real property on which said sign is located to be for sale or rent, provided that such sign shall be at least five feet away from any public street, and provided further that no sign shall be so placed as to obstruct the clear view of the highway in any direction.
B.
The nameplate or other sign of a physician, surgeon, dentist, lawyer or notary public, provided that such nameplate or other sign shall not exceed two feet in length and eight inches in width.
C.
A flagpole, provided that the same shall not be used for displaying any commercial flag or advertisement.
D.
Any traffic signs, bulletin board or other signs or signposts now or hereafter installed or maintained by the Incorporated Village of Bayville or any other municipality or governmental agency having jurisdiction or the posting, affixing or other display upon such signposts or bulletin boards of any official notices by the Incorporated Village of Bayville or any other municipal or governmental agency having jurisdiction.
E.
The posting, erection, maintenance or use upon or adjacent to any private road or other private passage of signs, not longer than two feet and not wider than eight inches, designating such private road or passage or the name of the owner of the property to which such private road or passage leads and other noncommercial direction signs within the above dimension limitation, private or public, for the convenience of travel.
F.
Signs or advertisements or advertising devices maintained and displayed inside a building or within a show window actually and chiefly used for the articles described in the advertisement and notices.
G.
The posting, erection, maintenance or use of a sign or signs not longer than three feet and not wider than two feet, maintained and used for the purpose of prohibiting or preventing trespassing, shooting, fishing and trapping upon the property upon which the signs are located, and carrying or containing only such words or other reading matter as may be necessary or appropriate for the purpose of preventing such trespassing, shooting, fishing or trapping.
