ARTICLE VII

400.700 - Intent.

Sec. 700. The RME Elderly Housing Residential Districts are designed to provide sites for housing for the elderly and related uses which will provide for the special needs of senior citizens. The district recognizes a reduction in the need for off-street parking and allows a relatively high density because of reduced family size.

400.701 - Principal uses permitted subject to special conditions.

Sec. 701. In an Elderly Housing Residential District, no building or land shall be used and no building shall be erected except for one or more of the following specified uses subject to the review and approval of the site plan by the Planning Commission:

1.

Housing for the elderly provided that:

a.

The owner shall file with the Township a covenant, reviewed as to form by the Township Attorney and approved by the Township of Bedford, in which said owner shall covenant on behalf of himself, his heirs, executors, and assigns that the occupancy of such project shall be limited to the elderly, and that the project shall comply with all federal and state regulations relating to housing for elderly persons including, but not limited to, the Fair Housing Act, 42 USC § 3604, et seq. (or its successor), and the Michigan Elliot Larsen Civil Rights Act, MCL § 37.2101, et seq. (or its successor).

b.

All dwellings shall consist of at least 300 square feet per unit (not including kitchen and sanitary facilities).

c.

The maximum height may exceed 35 feet provided that a minimum setback of 200 feet shall be maintained from any one-family residential district and provided that the minimum requirements of Section 1800, [Section 400.1800] footnote (g) shall also apply. Height in excess of 35 feet shall require special approval of the Planning Commission after review and approval of the site plan and a public hearing in accordance with the procedures of Section 2206 [Section 400.2206].

d.

All access to the site shall be in accordance with Section 1915 [Section 400.1915].

e.

Housing for the elderly shall further be subject to the required conditions of Section 602 [Section 400.602] of the Multiple-Family Residential Districts.

2.

Convalescent homes provided that:

a.

There shall be provided on the site, not less than 1,000 square feet of open space for each bed in the home. The 1,000 square feet of land area shall provide for landscaped setting, off-street parking, service drives, loading space, yard requirement and accessory uses, but shall not include the area covered by main or accessory buildings.

b.

All access to the site shall be in accordance with Section 1915 [Section 400.1915].

3.

Adult Foster Care Facilities for the Aged, approved and licensed by the Michigan State Department of Social Services, or its successor, under the "Adult Foster Care Facility Licensing Act", (Act 218 of the Public Acts of 1979), or any succeeding Act in substantially similar form, but only for adults who are aged, provided that:

a.

All licenses, rules, codes, plans, procedures, regulations, laws, conditions, requirements, orders, or directives issued by, or approved by, or promulgated by the Michigan State Department of Social Services, or its successor, or any person or entity acting by or through said Department, are complied with and maintained at all times.

b.

There shall be provided not less than 125 square feet of building space, and not less than 1,000 square feet of open space (land area) for each bed in a facility. The 1,000 square feet of open space (land area) shall provide for landscape setting, off-street parking, service drives, loading space, yard requirement and accessory uses, but shall not include the area covered by main or accessory buildings.

c.

All access to the site shall be in accordance with Section 1915 [Section 400.1915].

4.

Accessory buildings and uses customarily incident to any of the above permitted uses.

400.702 - Area and bulk requirements.

Sec. 702. See Article XVIII, Schedule of Regulations limiting the height and bulk of buildings, the minimum size of lot by permitted land use, maximum density permitted and providing minimum yard setback requirements.
