ARTICLE 4

- AGRICULTURAL DISTRICT, A-13

Statement of intent. This district covers the unincorporated portions of the county primarily intended for agricultural and open space uses such as farms, forests, parks, and lakes. The district is established for the specific purpose of preserving the facilitating, existing and future farming operations, conservation of water and other natural resources, reducing soil erosion, protecting watersheds, and reducing hazards of flood and fire. At the same time, the district is intended to provide for rural residential development and to protect this environment where it occurs. Business development necessary to support agricultural or open space use is allowed with conditional use permits to ensure the preservation of quality development. Uses not consistence with the existing character of this district are not permitted.

4-1.- Use regulations.

In agricultural district, A-1, structures to be erected or land [to] be used shall be for one or more of the following uses:

4-1-1. Single-family dwelling. For purposes of this district, includes manufactured homes 19 or more feet in width on individual lots and on permanent foundations, i.e., double wide manufactured housing.

4-1-2. Manufactured homes that are less than 19 feet in width, with or without permanent foundation.

4-1-4. Manufactured home parks, with a conditional use permit.

4-1-5. Mobile home parks, with a conditional use permit.

4-1-6. Industrialized/modular buildings used for single-family residential occupancy.

4-1-7. Manufactured/mobile homes used for a family member requiring convalescent care.

4-1-9. General farming, agriculture, dairying and forestry.

4-1-10. Schools, churches, parks and playgrounds.

4-1-11. Preserves and conservation areas.

4-1-13. Sawmills and planing mills, with a conditional use permit.

4-1-14. Cemeteries.

4-1-15. Home occupations, as defined, conducted by the occupant.

4-1-16. Public utilities, with a conditional use permit.

4-1-17. Sporting facilities, including horseracing and ancillary facilities, with a conditional use permit.

4-1-18. Country general stores, with a conditional use permit.

4-1-19. Airports, with a conditional use permit.

4-1-20. Farmers' cooperatives, wholesale processing plants and storage warehouses, with a conditional use permit.

4-1-21. Wood and lumber yards, with a conditional use permit.

4-1-22. Farm supplies, agricultural equipment sales and service, with a conditional use permit.

4-1-23. Public garage, with a conditional use permit.

4-1-24. Seasonal roadside stands, with a conditional use permit. Roadside stands may be constructed on the farm of an owner/operator to permit the sale of farm products raised by the owner/operator.

4-1-25. Campgrounds, with a conditional use permit.

4-1-26. Sanitary landfills, with a conditional use permit.

4-1-27. Surface mining of clay and shale, with a conditional use permit.

4-1-28. Quarrying operations, with a conditional use permit.

4-1-29. Fire and rescue facilities, with a conditional use permit.

4-1-30. Accessory uses as defined; however, garages or other accessory structures such as carports, porches and stoops attached to the main building shall be considered part of the main building. No accessory building may be closer than five feet to any property line.

4-1-31. Church bulletin boards and church identification signs for church activities only.

4-1-32. Directional and other official signs and notices, with a conditional use permit, subject to section 1-7 of this ordinance.

4-1-33. Business signs, with a conditional use permit. A sign advertising the sale or rent of the premises upon which such sign is erected is exempt.

4-1-34. General advertising signs, subject to section 1-7 of this ordinance.

4-1-35. Facilities, activities, and operations which are provided by a duly constituted unit of government, with a conditional use permit.

4-1-36. Printing shops, with a conditional use permit.

4-1-47. Greenhouses and plant nurseries, at which the products thereof are sold or offered for sale, with a conditional use permit. This does not include greenhouses and plant nurseries uses solely for bona-fide agricultural purposes.

4-2. - Area regulations.

The minimum lot area for permitted uses shall be one acre or more. For permitted uses utilizing individual wells or sewage disposal systems, or both, the required area for any such use shall be approved by the health official. The administrator may require a greater area if determined necessary.

4-3. - Setback regulations.

Structures shall be located 75 feet or more from any street right-of-way which is 50 feet or greater in width, or 100 feet or more from the centerline of any street right-of-way less than 50 feet in width, except that signs advertising sale or rent of premises may be erected up to the property line. This shall be known as the "setback line".

4-4. - Frontage regulations.

For permitted uses, the minimum lot width at the setback line shall be 125 feet or more.

4-5. - Yard regulations.

4-5-1. Side. The minimum side yard for each main structure shall be 25 feet and the total width of the two required side yards shall be 50 feet or more.

4-5-2. Rear. Each main structure shall have a rear yard of 35 feet or more.

4-5-3. [Additional yards.] If the planning commission deems it necessary to protect public safety and welfare, additional yards, such as buffer zones with tree plantings, and further setback requirements may be required.

4-6. - Height regulations.

Buildings may be erected up to 35 feet, except that:

4-6-1. The height limit for dwellings may be increased up to 45 feet and up to three stories provided there are two side yards for each permitted use, each of which is 25 feet or more, plus one foot of each side yard for each additional foot of building height over 35 feet.

4-6-2. A public or semipublic building such as a school or church may be erected to a height of 60 feet from grade provided that required front, side and rear yards shall be increased one foot for each foot in height over 35 feet.

4-6-3. Uses which by definition may be considered commercial or industrial in nature permitted in section 4-1 with the approval of a conditional use permit, such as sporting facilities, public utilities, and airports, may be erected to a height of 100 feet provided front, side, and rear yards shall be increased one foot for each foot in height over 35 feet.

4-6-4. No accessory building which is within 25 feet of any party lot line shall be more than one story high. All structures and accessory buildings shall be no more than half the height of the principal building or 35 feet whichever is greater. Accessory buildings which are located closer to the front property line than the principal building shall not be taller than the main building height. Farm buildings are exempt.

4-6-5. Conditional use permits are required for buildings exceeding the maximum heights listed in this section.

4-7. - Special provisions for corner lots.

4-7-1. Of the two sides of a corner lot, the front shall be deemed to be the shortest of the two sides fronting on streets.

4-7-2. The minimum side yard on the side facing the side street shall be 35 feet or more for both main and accessory buildings.

4-8. - Off-street parking.

Off-street parking, as required by section 1-5 of this ordinance.
