ARTICLE 9

- BUSINESS DISTRICT, B-17

Statement of intent. This district is established to provide areas dedicated primarily for retail business, professional services, and other activities generally associated with business transactions, including highway services. The intent of this district is to promote centralization of services around incorporated areas of the county to which the public requires frequent access. Uses not consistent with the existing character of this district are not permitted.

9-1.- Use regulations.

In business district, B-1, structures to be erected or land to be used shall be for one or more of the following uses:

9-1-1. Retail stores and shops, as defined.

9-1-2. Laundries and dry cleaners.

9-1-3. Laundromats.

9-1-4. Theaters, assembly halls.

9-1-5. Funeral homes.

9-1-6. Hotels and motels.

9-1-7. Office buildings.

9-1-8. Restaurants.

9-1-9. Drive-in restaurants and food sales.

9-1-10. Churches.

9-1-11. Libraries.

9-1-12. Hospitals, general.

9-1-13. Medical and dental clinics.

9-1-14. Nursing homes.

9-1-15. Rest or convalescent homes.

9-1-16. Tourist homes.

9-1-17. Animal hospitals, clinics, or kennels, with a conditional use permit.

9-1-18. Service stations (with major repair under cover).

9-1-19. Laboratories, with a conditional use permit.

9-1-20. Clubs and lodges.

9-1-21. Auto sales and service.

9-1-22. Lumber and building supply (with storage under cover).

9-1-23. Plumbing and electrical supply (with storage under cover).

9-1-24. Wholesale and processing, not objectionable because of dust, noise, or odors, with a conditional use permit.

9-1-25. Machinery sales and service, with a conditional use permit.

9-1-26. Fire and rescue facilities.

9-1-27. Public utilities, with a conditional use permit.

9-1-28. Public billiard parlors and pool rooms, bowling alleys, dance halls, and similar forms of public amusement, with a conditional use permit.

9-1-29. Business signs.

9-1-30. Directional and other official signs and notices, subject to section 1-7 of this ordinance.

9-1-31. General advertising signs, subject to section 1-7 of this ordinance.

9-1-32. Church bulletin boards and church identification signs for church activities only.

9-1-33. Facilities, activities, and operations which are provided by a duly constituted unit of government, with a conditional use permit.

9-1-34. Satellite wagering facilities, with conditional use permit.

9-1-37. Child care center, with a conditional use permit.

9-1-38. Greenhouses and plant nurseries, retail or wholesale, provided nothing except plant materials are stored outside of a completely enclosed building, with a conditional use permit.

9-1-39. Marinas, with approval of a conditional use permit.

9-1-40. Data centers.

9-2. - Area regulations.

None, except for permitted uses utilizing individual sewage disposal systems, the required area for any such use shall be approved by the health official. The administrator may require a greater area if determined necessary.

9-3. - Setback regulations.

Buildings shall be located 30 feet or more from any street right-of-way which is 50 feet or greater in width, or 50 feet or more from the centerline of any street right-of-way less than 50 feet in width.

9-4. - Yard regulations.

For permitted uses, the minimum side yard or rear yard adjoining or adjacent to a residential district shall be 100 feet. The side yard of corner lots shall be 30 feet or more.

9-5. - Height regulations.

9-5-1. Buildings and accessory structures may be erected up to 45 feet from grade except office buildings, hospitals, and hotels which may be constructed to a height of 12 stories or 120 feet whichever is less.

9-5-2. Conditional use permits are required for buildings exceeding the maximum heights listed in this section.

9-6. - Requirements for permitted use.

Before a building permit shall be issued or construction commenced on any permitted use in this district, or a permit issued for a new use, all requirements of article 27, site plan requirements, shall be met.

9-7. - Off-street parking.

Off-street parking, as required by section 1-5 of this ordinance.
