5-1.- Purpose.

This district is intended to provide for low density residential development while being protective of the county's rural character by preserving open space and productive farm and timber lands. This district is intended to provide for areas of residential development which will protect the general agricultural areas of the county from sprawling land consumptive residential development that often displaces substantial areas of high quality agricultural land for a small number of dwelling units. In accordance with the comprehensive plan, residential development in the rural residential district will utilize larger acreage lots or parcels for single-family residential type development, referred to as "mini-farms" by some people. This type of low density residential development will appeal to those desiring the controls and restrictions normally associated with residentially zoned development coupled with larger tracts of land.

5-2. - Permitted uses; by right.

1.

Single-family dwellings detached.

2.

Manufactured homes 19 or more feet in width on individual lots and on permanent foundations with masonry skirting and with a four inch by 12 inch or greater roof pitch.

3.

Schools.

4.

Churches.

5.

Parks and playgrounds.

6.

Accessory uses and structures, as defined, however, garages and other accessory structures such as carports, porches, and stoops attached to the main building shall be considered part of the main building. No one-story detached accessory structure may be located closer than ten feet to any property line, nor in any front or corner side yard.

7.

Home occupations, as defined, provided that all activities associated with the home occupation shall be conducted solely within the main building.

8.

Modular buildings, used for single-family residential occupancy only.

9.

Noncommercial gardening.

10.

Family day home (one to five children).

11.

Private stables, accessory to the principle use, subject to the following:

a)

If not more than two horses are kept, the stable shall be located on a tract of not less than three acres.

b)

If three or four horses are kept, the stable shall be located on a tract of not less than five acres.

12.

Family cemeteries.

5-3. - Conditional uses.

1.

Duplex (two-family dwelling).

2.

Group homes, not more than eight people.

3.

Family day home (six to 12 children).

4.

Social, fraternal clubs and lodges, union halls and similar places of assembly.

5.

Commercial greenhouse operations with no on-premises sales.

6.

Private airports.

7.

Nondistrict serving utilities.

8.

Fire and rescue facilities.

9.

Roadside stand for produce raised on premises.

10.

Private cemeteries.

11.

Home occupation, as defined, where any activities associated with the home occupation are conducted in areas other than solely within the main dwelling.

5-4. - Temporary uses.

1.

Manufactured homes, less than 19 feet in width, used as a temporary residence during the construction, emergency repair, or renovation of a permanent permitted residential structure on-site, in accordance with sections 1-10-4 and 1-10-5, with a conditional use permit.

2.

Manufactured homes, less than 19 feet in width, to be occupied by family members for convalescent care in accordance with section 1-10-2(g), with a conditional use permit.

3.

Office trailers occupied as real estate sales offices within residential developments in accordance with section 1-10-4, with a conditional use permit.

5-5. - Required conditions.

The conditions specified in this section shall be met for all uses and structures in the rural residential (RR) zoning district.

(a)

Area regulations. The minimum lot area for permitted uses, together with its accessory uses, shall be five acres or more. For permitted uses utilizing individual wells and/or sewage disposal systems, the required area for any such use shall be approved by the health official. The zoning administrator may require a greater area if determined necessary.

(b)

Minimum lot width. For permitted uses, the minimum lot width at the front building setback line shall be 300 feet or more.

(c)

Front yard. Each lot shall have a front yard having a depth of not less than 150 feet.

(d)

Side yard. Each lot shall have two side yards, each having a width of a minimum of 50 feet.

(e)

Corner side yard. Each corner side yard shall not be less than 70 feet. Of the two sides of a corner lot, the front shall be deemed to be the shortest of the two sides fronting on streets.

(f)

Rear yard. Each lot shall have a rear yard not less than 70 feet in depth.

(g)

Additional yards. If the board of supervisors, upon a recommendation by the planning commission, deems it necessary to protect public safety and welfare, additional yards, such as buffer zones with tree plantings and greater setbacks for structures, may be required.

(h)

Heights. Buildings may be erected up to 35 feet, except that:

i)

The height limit for dwellings may be increased up to 45 feet and up to three stories provided that a minimum side yard of 50 feet plus one foot or more for each additional foot of building height over 35 feet is provided.

ii)

A public or semi-public building such as a school or church may be erected to a height of 60 feet from grade provided that required front, side, and rear yards shall be increased one foot for each foot the building height exceeds 35 feet.

iii)

iv)

Detached accessory buildings which are more than one story shall meet the same minimum setback requirements as the main building. All structures and accessory buildings shall be no more than half the height of the principal building or 35 feet whichever is greater.

v)

Conditional use permits are required for buildings exceeding the maximum heights listed in this section.
