CHAPTER 17

16 - USE DISTRICTS

17.16.010 - District classifications.

In order to carry out the purposes and provisions of this Title, the Village of Buffalo Grove, Illinois, is hereby divided into the following districts:

Residential Districts

R-E (43,560 square feet minimum) One-Family Dwelling District
R-1 (20,000 square feet minimum) One-Family Dwelling District
R-2 (15,000 square feet minimum) One-Family Dwelling District
R-3 (10,000 square feet minimum) One-Family Dwelling District
R-3-A (10,000 square feet minimum) One-Family Dwelling District
R-4 (8,750 square feet minimum) One-Family Dwelling District
R-4-A (8,750 square feet minimum) One-Family Dwelling District
R-5 (7,200 square feet minimum) One-Family Dwelling District
R-5-A (7,200 square feet minimum) One-Family Dwelling District
R-6 (6,600 square feet minimum) One-Family Dwelling District
R-6-A (6,600 square feet minimum) One-Family Dwelling District
R-7 Dwelling District
R-8 Multiple-Family Dwelling District

17.16.020 - Zoning maps.

The locations and boundaries of the districts established herein are shown upon the zoning map which is incorporated into this Title. The zoning map, together with all notations, references and other information shown thereon and all amendments thereto, shall be a part of this Title and shall have the same force and effect as if the zoning map, together with all notations, references, and other information shown thereon, were fully set forth and described herein.

17.16.030 - New or annexed land.

Any territory hereafter annexed to the municipality which is not shown on the zoning map made a part of this Title shall automatically, upon such annexation, be classified as within the R-E (forty-three thousand five hundred sixty square feet minimum) One-Family Residential District, and be subject to all conditions and regulations applicable to territory in such district, until said territory is later zoned in a manner provided by law or ordinance; provided that in the event the owner or owners of property to be annexed desire another zoning district classification, in harmony with density and land use designations shown for said property on the Official Plan for the environs of the Village, to be adopted at the time of the annexation, the owner may petition for said zoning classification simultaneously with the petition for annexation. The public notice of zoning hearing, as required by Chapter 17.64, may be advertised on or before the publication of the required legal notice for annexation. After the zoning hearing and recommendation of the Planning and Zoning Commission, the Corporate Authorities may either adopt or deny the report of the Planning and Zoning Commission for the proposed zoning amendment, at the time of adoption of the final ordinance annexing the territory.

17.16.040 - Zoning of streets, alleys, public-ways and railroad rights-of-way.

All streets, alleys, public-ways and railroad rights-of-way, if not otherwise specifically designated, shall be deemed to be in the same zone as the property immediately abutting upon such streets, alleys, public-ways and railroad rights-of-way. Where the center line of a street, alley, public-way or railroad right-of-way serves as a district boundary. The zoning of such areas, unless otherwise specifically designated, shall be deemed to be the same as that of the abutting property up to such center line.

17.16.050 - Boundary lines.

Wherever any uncertainty exists as to the boundary of any use district as shown on the zoning map incorporated herein, the following rules shall apply:

A.

Where district boundary lines are indicated as following streets, alleys, or similar rights-of-way, they shall be construed as following the center lines thereof;

B.

Where district boundary lines are indicated as approximately following lot lines, such lot lines shall be construed to be such boundaries;

C.

Where a lot held in one ownership and of record at the effective date of this Title is divided by a district boundary line, the entire lot shall be construed to be within the less restrictive district; provided that this shall not apply if it increases the area of the less restrictive portion of the lot by more than twenty percent.

17.16.060 - Minimum areas for zoning districts.

The minimum areas that may constitute a separate or detached part of any of the following zoning districts on the zoning map or subsequent amendments to said zoning map shall be as shown in the following table. When a zoning district is directly across the street from or abuts a district which is in a similar zoning classification, the area of the land directly across the street or abutting the property may be included in the calculations in meeting the minimum requirements.
