CHAPTER 10

SIGNS AND OUTDOOR ADVERTISING STRUCTURES

10-10-1: GENERAL REGULATIONS:

Signs and outdoor advertising structures may be erected in the zoning districts where such use is permitted subject to the following provisions:
   A.   Traffic Obstructions: No sign or outdoor advertising structure shall be located so as to endanger the health and safety of operators of motor vehicles on the public streets.
   B.   Lighted, Flashing Signs: Signs or advertising structures may be lighted in a reasonable manner that makes the structure visible, but does not create substantial glare. No sign may be erected that flashes, uses sound or other mechanical devices, or that uses unusual lighting or other means of animation.
   C.   Projections Into Other Properties: No sign or advertising structure shall project into the public right of way or other adjacent property. (Ord. 123, 1979)
   D.   Conflicting Provisions: In any conflict between the provisions of Title 9, Chapter 4 of this Code, and this Chapter, the provisions of this Chapter shall prevail. In all other cases, the provisions of both Chapters shall be binding. (2000 Code)

10-10-2: OUTDOOR ADVERTISING STRUCTURES:

Outdoor advertising structures are permitted in certain zoning districts for the purpose of advertising businesses and uses not located on the premises with the structure, subject to the following restrictions:
   A.   Freestanding Signs Required: Outdoor advertising shall be freestanding and not attached to or painted on any part of a building or premises.
   B.   Height, Area Restrictions: No outdoor advertising structure shall be erected to have a total height greater than twenty feet (20') above the level of the street upon which the structure faces, nor shall the signable areas of any such outdoor advertising structure exceed one hundred fifty (150) square feet.
   C.   Double-Frontage Signs: Double-frontage signable areas are permitted.
   D.   One Sign Per Lot: Only one outdoor advertising structure shall be erected on any individual lot or parcel. (Ord. 123, 1979)

10-10-3: SIGNS IN RESIDENTIAL DISTRICTS:

In residential zoning districts, nonilluminated nameplates for home occupations are permitted; provided, the nameplate does not exceed one square foot in area and is used for indicating the name and address of the occupant or home occupation. (Ord. 123, 1979)

10-10-4: SIGNS IN COMMERCIAL AND INDUSTRIAL DISTRICTS:

In commercial and industrial zoning districts, signs are permitted for the purpose of identifying or describing the nature or type of use located on the premises, with the sign subject to the following restrictions:
   A.   Signs may be freestanding, attached to the building or painted on the wall of a building.
   B.   No sign shall be erected or located to have a total height greater than twenty feet (20') above the level of the street upon which the sign faces, nor shall the signable area of any such sign exceed one hundred (100) square feet.
   C.   Freestanding signs may contain double-frontage signable areas; however, only one sign may be located or painted on a building or premises. (Ord. 123, 1979)

10-10-5: SIGNS IN H-I DISTRICTS:

   A.   Purpose And Intent: The regulations of this Section apply to H-I Districts only and replace all other sign regulations of Chapter 9 of this Title and this Chapter for such Districts. These regulations recognize the need for a reasonable display of signs as a public service and to the conduct of competitive commerce and industry while attempting to provide standards which will ensure the public safety and the value and economic stability of adjoining property and the aesthetic integrity of the area and region of which the interchange development is a part.
   B.   Sign Restrictions: No sign shall be permitted on a lot unless:
      1.   The sign meets the conditions of this Section;
      2.   Written authorization has been received from the owner of the property or his agent; and
      3.   The sign meets all conditions of State, County and local regulations pertaining to the interstate highway system.
   C.   General Sign Regulations:
      1.   No sign or sign structure, other than official highway signs or markers, shall be placed upon or within any street or highway right of way;
      2.   Sign structure or columns shall be set back a minimum of ten feet (10') from the street line except as otherwise provided in this Section. Signs located on a corner lot shall not be located at the intersection of two (2) or more streets within a triangle at such intersection with two (2) sides extending from the intersection itself along each street at least fifteen feet (15');
      3.   Signs affixed to a building wall shall not project above the parapet or roof line of said building.
   D.   Illumination And Motion:
      1.   No rotating beam, beacon or flashing illumination resembling an emergency light shall be used in connection with any sign display;
      2.   Where reflecting, radiating or other illumination of signs is permitted, light shall not project onto residential property.
   E.   Commercial Signs Restrictions: Commercial signs shall be allowed in the H-I district, subject to the following restrictions:
      1.   Each business or use of the premises shall be entitled to wall signage, directional signage and information signage.
      2.   In addition, each business or use of the premises shall be entitled to one on-lot sign, with subject matter restricted to products, accommodations, services or activities that are available or occur on the premises, whose pole will not be greater than thirty five feet (35'). Such sign may be two-sided, each side to be no greater than two hundred (200) square feet. This sign will be installed on the same lot on which the business establishment is located.
      3.   Each business or use of the premises shall also be entitled to one additional sign, which may be either on-lot or off-lot, whose pole will be a maximum of seventy feet (70') in height. Such sign may be two-sided, each side to be no greater than four hundred (400) square feet. If off-lot, the sign will be installed in the zoning district.
      4.   Pole, tower or pylon signs may be illuminated or illuminating, but not contain flashing, beacon or animated parts.
      5.   All signs shall be subject to the review of the Zoning Board of the City 1 , which shall review such signs with the intention that such signage reflect a first-class business/commercial park and will not be garish or inconsistent with the appearance of the zoning district.
   F.   Advertising Signs, Off-Site: No off-site advertising signs or devices shall be permitted within the H-I Zoning District, except as specifically set forth herein.
   G.   Portable Signs And Advertising Displays:
      1.   Portable signs are prohibited except that there may be such portable signs on parking lots as permitted by the zoning administrator which are deemed necessary for the safe and satisfactory functioning of the lot and excepting also that each filling station may have one portable sign, not exceeding twelve (12) square feet in area, at opposite entrances to the station, and restricted to solely stating the price of gasoline.
      2.   Portable advertising displays, outside of structures and located on aprons, sidewalks, parking lots or driveways are prohibited.
   H.   Special Signs And Advertising Devices:
      1.   Temporary signs announcing the construction of new developments or rebuilding, sale, lease or rental shall be permitted provided they comply with the regulations of this Section.
      2.   Special events posters, including flags, pennants or bunting shall not be permitted out-of-doors except by permit. Such a permit may be issued by the zoning administrator for a period not to exceed thirty (30) days. An extension may be granted, however, by the zoning administrator not to exceed an additional thirty (30) days.
   I.   Sign Design, Safety And Maintenance: All signs and sign structures shall be designed and erected to withstand wind pressure of not less than thirty (30) pounds per square foot. (Ord. 230, 1987)
