The provisions contained in this Chapter shall apply in the same manner to a use which may become a nonconforming use due to a later amendment to these regulations. (Ord. 283, 1984)
10-12-2: NONCONFORMING USES:
Upon the effective date of this Title, the lawful use of a building, mobile home or premises may be continued although such use does not conform to all the provisions thereof, except as provided in this Chapter. (Ord. 283, 1984)
10-12-3: EXTENSION, CHANGE OR EXPANSION OF NONCONFORMING USE:
A. Extension Of Use: A nonconforming use may be extended throughout a building or mobile home provided no structural alterations are made therein.
B. Change To Another Use: A nonconforming use may be changed to another nonconforming use of the same or greater restrictions, provided no structural changes are made in the building or mobile home. Whenever a nonconforming use has been changed to a conforming use, it shall not thereafter be changed except in accordance with the requirements of the district in which it is located.
C. Expansion Or Alteration Of Use: Any building, mobile home, building and land in combination or mobile home and land in combination, in or on which a nonconforming use of a building or mobile home is existing, shall not hereafter be expanded or altered in any manner except in accordance with the requirements of this Chapter or of the district in which it is located. 10-12-4: DISCONTINUANCE OF NONCONFORMING USE:
In the event that a nonconforming use of any building or premises is discontinued for a period of one year, or in the case of a mobile home the premises become vacant and remain unoccupied for a period of two (2) consecutive months, the use of the same shall thereafter conform to the uses permitted in the district in which it is located. 10-12-5: DAMAGES, RESTORATION:
When a building or mobile home containing a nonconforming use is damaged by fire, explosion, or other act of God, to the extent of more than fifty percent (50%) of its assessed value, it shall not be restored except in conformity with the regulations of the district within which it is located. (Ord. 283, 1984)
10-12-6: MOBILE HOME LIMITATIONS:
A mobile home may replace an existing nonconforming mobile home within the period set forth in Section 10-12-4 of this Chapter, but in such case the size of the replacement mobile home must not be of greater dimension than the mobile home being replaced. Such replacement mobile home must, in addition, meet the setback, side yard and rear yard requirements of the district in which it is located. (Ord. 283, 1984)
