CHAPTER 7

COMMERCIAL DISTRICTS

10-7A-1: PURPOSE:

The C-1 Local Business District is established to provide areas for a general range of retail and service shopping needs. (Ord. 123, 1979)

10-7A-2: PERMITTED USES:

The following uses shall be permitted in the C-1 District, plus such other uses as the Zoning Board may deem to be similar in nature; all uses shall be subject to the property development standards in Section 10-7A-5 of this Article and Section 10-3-3 of this Title:
Apparel store.
Bakery, retail.
Bank.
Barbershop.
Beauty shop.
Business or professional office.
Clinic.
Dairy, retail only (no processing).
Delicatessen.
Dressmaking shop.
Drugstore.
Dry-cleaning establishment.
Electric appliance service and sales.
Flower shop.
Funeral home.
Garden shop.
Gift shop.
Greenhouse.
Hardware store.
Jewelry store.
Laundry agency.
Meat market.
Millinery shop.
Motel.
Municipal or government building.
Pet shop.
Postal station.
Public library or museum.
Public park or recreational area.
Radio, television service and sales.
Record shop.
Reducing salon.
Restaurant.
Restaurant, drive-in.
Self-service laundry and dry cleaning.
Shoe repair shop.
Stationer.
Supermarket.
Tailor and pressing shop.

10-7A-3: SPECIAL USES:

The following uses may be permitted by special use permit as provided for in chapter 13 of this title:
   Assembly hall for use by nonprofit organizations.
   Body art establishments.
   Brew pub.
   Church.
   Craft brewery.
   Electronic communications transmission and reception tower.
   Filling or service station.
   Fish nursery.
   Kindergarten or day nursery (other than part of a school providing other grades).
   Open sales lot.
   Tavern.
   Tree nurseries.
   Welding, metal fabricating shop.

10-7A-4: PROPERTY DEVELOPMENT STANDARDS:

The property development standards set forth in this section shall apply to all land and structures in the C-1 local business district:
   A.   Minimum Lot Area: There is no minimum requirement.
   B.   Lot Dimensions: All lots hereafter created shall have a minimum width of fifty feet (50'). Curve and cul-de-sac lot widths shall be measured as chord distance at the building setback line.
   C.   Building Height: No building or structure located in this district may be changed or erected so as to have a height greater than thirty five feet (35').
   D.   Off Street Parking: The provisions of chapter 11 of this title shall apply.
   E.   Yard Requirements: No building shall be erected or enlarged unless the following yard setback requirements are provided:
      1.   Front Yard: A front yard shall be not less than ten feet (10').
      2.   Side Yards: The minimum width of each side yard for the principal building shall not be less than ten feet (10').
      3.   Rear Yard: The minimum depth of a rear yard for the principal building shall not be less than ten feet (10'). (Ord. 123, 1979)

10-7B-1: PURPOSE:

The C-2 central business district is established to provide areas for retail trade that are associated with Chenoa central business district. (Ord. 123, 1979)

10-7B-2: PERMITTED USES:

The following uses shall be permitted in the C-2 district, plus such other uses as the zoning board may deem to be similar in nature; all uses shall be subject to the property development standards in section 10-7B-4 of this article and section 10-3-3 of this title:
All uses permitted in the C-1 district.
Assembly halls or nonprofit organizations.
Billiard room.
Boarding or lodging house.
Charitable institutions.
Department store.
Dressmaking shop.
Flower shop.
Hotel or motel.
Municipal or government building.
Newsdealer.
Nightclub.
Nursing home.
Office supplies.
Open sales lot.
Photograph studio.
Print shop and newspaper.
Railway or motorbus station.
Residential uses shall be allowed on the first floor, so long as the residential use is: a) limited to one contiguous area in that portion of the building furthest removed from the front lot line; b) no part of the residential use shall include the room or rooms of the building closest to the front lot line; c) no basement area of any building shall comprise a residential use; and d) the area of residential use comprises no more than twenty five percent (25%) of the first floor building area. Prior to establishing such use, the user shall contact the zoning administrator and allow access to the premises to determine the character and area of such residential use.
Studio business (art, interior decorating, music, etc.).

10-7B-3: SPECIAL USES:

The following uses may be permitted by special use permit as provided for in chapter 13 of this title:
   Automobile repair (all indoors).
   Brew pub.
   Craft brewery.
   Electronic communications transmission and reception tower.
   Farm equipment sales and service.
   Filling or service station.
   Locker, cold storage for individual use.
   Residential uses shall be allowed on the second floor and above in accordance with the zoning code.

10-7B-4: PROPERTY DEVELOPMENT STANDARDS:

The property development standards set forth in this section shall apply to all land and structures in the C-2 central business district:
   A.   Minimum Lot Area: There is no minimum requirement.
   B.   Lot Dimensions: There is no minimum requirement.
   C.   Building Height: No building or structure located in this district may be changed or erected so as to have a height greater than forty feet (40').
   D.   Off Street Parking: The provisions of chapter 11 of this title shall apply.
   E.   Yard Requirements: No building shall be erected or enlarged unless the following yard setback requirements are provided:
      1.   Front yard: There is no minimum requirement.
      2.   Side yards: There is no minimum requirement.
      3.   Rear yard: There is no minimum requirement. (Ord. 123, 1979)
