CHAPTER 6

RESIDENTIAL DISTRICTS

10-6A-1: PURPOSE:

The R-1 single-family residential district is established to provide areas for single-family residential development. (Ord. 123, 1979)

10-6A-2: PERMITTED USES:

The following uses shall be permitted in the R-1 district, plus such other uses as the zoning board may deem to be similar in nature; all uses shall be subject to the property development standards in section 10-6A-4 of this article, and section 10-3-3 of this title:
Dwelling, single-family.
Home occupation.
Manufactured or modular home, provided that the requirements of section 10-3-5 of this title are met.
Municipal or government building.
Public park or recreational facilities. (Ord. 123, 1979; amd. Ord. 339, 6-20-1996)

10-6A-3: SPECIAL USES:

The following uses may be permitted by special use permit as provided for in chapter 13 of this title:
Church.
Country club or golf course.
Kindergarten or day nursery, other than as a part of a school providing other grades. (Ord. 123, 1979)

10-6A-4: PROPERTY DEVELOPMENT STANDARDS:

The property development standards set forth in this section shall apply to all land and structures in the R-1 single-family residential district:
   A.   Minimum Lot Area: All lots hereafter created in this district shall contain an area of not less than ten thousand (10,000) square feet.
   B.   Lot Dimensions: All lots hereafter created shall have a minimum width of seventy five feet (75') and a minimum depth of one hundred twenty feet (120'). Curve and cul-de-sac lot widths shall be measured as chord distance at the building setback line.
   C.   Lot Coverage: The buildings on a lot, including accessory buildings, along with any structure may not exceed in coverage fifty percent (50%) of the total lot area.
   D.   Building Height: No building or structure located in this district may be changed or erected so as to have a height greater than thirty feet (30').
   E.   Minimum Ground Floor Area: No single-family dwelling may be changed or erected so that its ground floor area is less than seven hundred fifty (750) square feet.
   F.   Off Street Parking: The provisions of chapter 11 of this title shall apply.
   G.   Yard Requirements: No building shall be erected or enlarged unless the yard setback requirements set forth in this subsection are provided:
      1.   Front Yard: A front yard shall be not less than twenty feet (20').
      2.   Side Yards: The minimum width of each side yard for the principal building shall not be less than ten feet (10').
      3.   Rear Yard: The minimum depth of a rear yard for the principal building shall not be less than twenty feet (20'). (Ord. 123, 1979; amd. Ord. 557, 11-10-2008; Ord. 561, 1-12-2009; Ord. 848, 11-8-2022; Ord. 871, 8-13-2024)

10-6B-1: INTENT AND PURPOSE:

   A.   Intent: The intent of this R-1A Single-Family Manufactured Home Residential District is to allow primarily for the establishment of a manufactured mobile home subdivision or manufactured home park where lots are provided in a manner and with single-family residence district criteria, safe and compatible to surrounding land uses and densities, in conformance with the subdivision regulations of this Code 1 , and where manufactured homes, as defined in Section 10-2-1 of this Title, are to be placed on permanent foundations.
   B.   Purpose: The R-1A District is established to provide areas for single-family manufactured home residential development. (Ord. 348, 4-3-1997)

10-6B-2: ZONING MAP AMENDMENT GUIDELINES:

Prior to the establishment of an R-1A Single-Family Manufactured Home Residential District, the following guidelines shall be applied to the proposal under consideration:
   A.   The capacity of existing and proposed community facilities and utilities including water, sewer and transportation systems to serve the proposed development;
   B.   The adequacy of public services including police and fire protection, solid waste collection and public schools that would serve the development and the impact the proposal would have upon these;
   C.   The extent to which the proposed residential development will promote balanced growth in the community and will be consistent with the City's goals for equal housing opportunities and a variety of housing types;
   D.   The compatibility of the proposal to both existing and permitted uses on surrounding properties;
   E.   The impact any natural disaster, including flooding, will have upon the proposed development;
   F.   The impact the proposed development would have upon the natural environment including noise, air and water pollution; and
   G.   The conformance of the proposal to the official comprehensive development plan and official map. (Ord. 348, 4-3-1997)

10-6B-3: PERMITTED USES:

The following uses shall be permitted in the R-1A District, plus such other uses as the Zoning Board may deem to be similar in nature. All uses shall be subject to the property development standards as set forth in this Section and in Section 10-3-3 of this Title:
Accessory uses and buildings.
Dwelling, single family.
Home occupation.
Manufactured home park.
Municipal or government building.
Public park or recreational facilities.
Single-family manufactured home dwelling. (Ord. 348, 4-3-1997)

10-6B-4: SPECIAL USES:

The following uses may be permitted by special use permit as provided for in chapter 13 of this title:
Agricultural uses as defined in section 10-2-1 of this title.
Church.
Country club or golf course.
Kindergarten or day nursery, other than as part of a school providing other grades.
Parking lot, noncommercial.
Religious education facilities.

10-6B-5: PROPERTY DEVELOPMENT STANDARDS:

   A.   Standards:
      1.   General: The property development standards set forth in this section and section 10-3-3 of this title shall apply to all land and structures in the R-1A single-family manufactured home residential district. However, the standards of any applicable Illinois or federal statutes pertaining to manufactured homes shall supersede these standards if the standards included in such statutes are more stringent. All references to public streets in applicable sections herein shall apply to private streets and drives in manufactured home parks, even though not dedicated to the public.
      2.   Applicability To Manufactured Home Park: A manufactured home park must be subdivided into individual lots, notwithstanding single ownership of all such lots, in order to determine compliance with the property development standards as set forth herein. (Ord. 348, 4-3-1997)
      3.   Singlewide Mobile Homes: Nothing in this title shall preclude the use of singlewide manufactured homes in R-1A districts. However, use of same shall specifically be limited in the following manner:
         a.   At no time shall the number of singlewide manufactured homes, as a percentage of the total manufactured homes then located in any contiguous R-1A district, be greater than fifty percent (50%).
         b.   No singlewide manufactured home shall be installed in an R-1A district which is, at the time of such installation, more than ten (10) years old from the date of the manufacturer. (Ord. 666, 7-14-2014)
   B.   Lot Dimensions: All lots hereafter shall have a minimum width of sixty feet (60') and a minimum depth of ninety feet (90'). Curve and cul-de-sac lot widths shall be measured as chord distance at the building setback line.
   C.   Lot Coverage: The buildings on a lot, including accessory buildings, may not exceed in coverage forty percent (40%) of the total lot area.
   D.   Building Height: No building or structure located in this district may be changed or erected so as to have a height greater than fifteen feet (15'). (Ord. 348, 4-3-1997)
   E.   Minimum Ground Floor Area: No single-family dwelling may be changed or erected so that its ground floor area is less than nine hundred ten (910) square feet. (Ord. 666, 7-14-2014)
   F.   Off Street Parking: The provisions of chapter 11 of this title shall apply.
   G.   Yard Requirements: No buildings shall be erected or enlarged unless the yard setback requirements set forth in this subsection are provided:
      1.   Front Yard: A front yard shall be not less than fifteen feet (15'). (Ord. 348, 4-3-1997)
      2.   Corner Lot Setbacks: Corner lots shall be required to have only one front yard setback, the identity of which shall be determined pursuant to the definition of "lot line, front" in section 10-2-1 of this title. The setback requirement for the other front lot line in an R-1A district shall be as for a side yard in such district. (Ord. 312, 1994)
      3.   Side Yards: The minimum width of each side yard for the principal building shall not be less than six feet (6').
      4.   Rear Yard: The minimum depth of a rear yard for the principal yard shall be not less than seven feet (7'). (Ord. 348, 4-3-1997)

10-6C-1: PURPOSE:

The R-2 Medium Density Residential District is established to provide areas for single-family, two-family and medium density multi-family residences. (Ord. 123, 1979)

10-6C-2: PERMITTED USES:

The following uses shall be permitted in the R-2 District, plus such other uses as the Zoning Board may deem to be similar in nature; all uses shall be subject to the property development standards in section 10-6C-4 of this article and section 10-3-3 of this title:
Advertising signs at funeral homes only, to advertise for funeral home use on the same premises, provided that the provisions of section 10-10-2 of this title are followed, and with the further restriction that the sign shall not have a total height greater than five feet (5') above the level of the street, nor shall it exceed eighteen (18) square feet. On corner lots, one such sign shall be allowed in each yard facing a street.
Advertising structures oriented to I-55 billboard signage, provided that all the structures conform to all State of Illinois rules and regulations and the provisions of title 9, chapter 4 of this Code (provided that compliance with section 9-4-4 of this Code shall not be construed to require additional owner's or frontage consents), that such structures be limited to property immediately adjacent to Interstate Route 55, and that the number of such structures be limited to one structure in total on the west side of Interstate Route 55 in the R-2 District.
Dwelling, one-family.
Dwelling, two-family.
Home occupation.
Kindergarten or day nursery.
Manufactured or modular home, provided that the requirements of section 10-3-5 of this title are met.
Municipal or government building.

10-6C-3: SPECIAL USES:

The following uses may be permitted by special use permit as provided in chapter 13 of this title:
Boarding or lodging house.
Bookkeeping and accounting office.
Charitable institution.
Church.
Dwelling, multiple-family.
Electronic communications transmission and reception tower.
Funeral home.
Home for the aged.
Laundromat.
Nursing home.
Orphanage.
Parking lot, provided that where the parking lot is adjacent to a residence, there shall be a solid fence at least four feet (4') high, between the lots.
Wallpaper, drapery and related accessories store. (Ord. 123, 1979; amd. Ord. 156, 1981; Ord. 160, 1981; Ord. 398, 2-28-2000; Ord. 569, 6-8-2009; Ord. 625, 9-10-2012)

10-6C-4: PROPERTY DEVELOPMENT STANDARDS:

The property development standards set forth in this section shall apply to all land and structures in the R-2 Medium Density Residential Districts:
   A.   Minimum Lot Area: All lots hereafter created in this district shall contain an area of not less than eight thousand (8,000) square feet.
   B.   Lot Dimensions: All lots hereafter created shall have a minimum width of seventy five feet (75') and a minimum depth of one hundred feet (100'). Curve and cul- de-sac lot widths shall be measured as chord distance at the building setback line.
   C.   Lot Coverage: The building on a lot, including accessory buildings, along with any structure may not exceed in coverage fifty percent (50%) of the total lot area.
   D.   Building Height: No building or structure located in this district may be changed or erected so as to have a height greater than forty feet (40').
   E.   Minimum Ground Floor Area: No single-family dwelling may be changed or erected so that its ground floor area is less than seven hundred fifty (750) square feet.
   F.   Off Street Parking: The provisions of chapter 11 of this title shall apply.
   G.   Yard Requirements: No building shall be erected or enlarged unless the yard setback requirements set out in this subsection are provided:
      1.   Front Yard: A front yard shall be not less than twenty feet (20').
      2.   Side Yards: The minimum width of each side yard for the principal building shall not be less than ten feet (10').
      3.   Rear Yard: The minimum depth of a rear yard for the principal building shall not be less than ten feet (10').
   H.   Zero Lot Line Development Requirements: Notwithstanding any other provision of this section, a lot of record in an R-2 District may contain side yards of reduced size in the following particulars:
      1.   Two Lot Zero Lot Line Developments:
         a.   One side yard of at least ten feet (10') and one side yard of zero feet (0'), provided that the side yard of zero feet (0') abuts another lot with a side yard of zero feet (0') and the two (2) lots share the same side yard lot of zero feet (0'). Such configuration shall be referred to for the purpose of this subsection as a two (2) lot zero lot line development.
         b.   In all such two (2) lot zero lot line developments, the minimum total lot size of the two (2) lots comprising the two (2) separate zero lot line lots shall be eight thousand (8,000) square feet, and the combined minimum lot width of the said two (2) lots shall be sixty feet (60'), but there shall be no minimum lot size for the individual lots.
      2.   Three Lot Zero Lot Line Developments:
         a.   One side yard of at least ten feet (10') and one side yard of zero feet (0') on end lots, and two (2) side yards of zero feet (0') for the middle lot, in the case of three (3) consecutive adjoining lots, provided the side yards of zero feet (0') abut another lot in the same development with a side yard of zero feet (0'). Such configuration shall be referred to for purposes of this subsection as a three (3) lot zero lot line development.
         b.   In all such three (3) lot zero lot line developments, the minimum total lot size of the three (3) lots comprising the three (3) separate zero lot line lots shall be twelve thousand (12,000) square feet, and the combined minimum lot width of the said three (3) lots shall be ninety feet (90'), but there shall be no minimum lot size for the individual lots.
      3.   Other Standards Still Apply: All other property development standards for R-2 Districts except as specifically modified in this subsection H shall remain applicable for two (2) lot and three (3) lot zero lot line developments. (Ord. 409, 8-28-2000)
   I.   Metal Exteriors: No building shall have a metal exterior, other than a standard metal residential siding.
   J.   Widest Dimension: The widest dimension of a principal building shall be the dimension most nearly parallel to the front lot line of the lot on which the principal building is located. (Ord. 123, 1979; amd. Ord. 557, 11-10-2008; Ord. 561, 1-12-2009; amd. Ord. 848, 11-8-2022)

10-6D-1: PURPOSE:

The MH district is established to provide areas for mobile homes and mobile home parks. (Ord. 123, 1979)

10-6D-2: PERMITTED USES:

The following uses shall be permitted in the MH district, plus such other uses as the zoning board may deem to be similar in nature; all uses shall be subject to the property development standards in section 10-6D-3 of this article and section 10-3-3 of this title:
Accessory uses and buildings.
Home occupation.
Mobile home.
Mobile home park. (Ord. 12, 1979)

10-6D-3: PROPERTY DEVELOPMENT STANDARDS:

The property development standards set forth in this section shall apply to all land and structures in the MH district. However, the standards of the Illinois mobile home park act 1 shall supersede these standards if the standards included in the act are more stringent: (Ord. 123, 1979)
   A.   Minimum Lot Area: The minimum area required for each mobile home district shall be five (5) acres. All mobile home spaces shall contain a minimum of five thousand (5,000) square feet; provided, however, that a new mobile home district may consist of less than five (5) acres if the proposed area is comprised of at least three (3) contiguous lots on which, at the time of rezoning, three (3) or more mobile homes, whether nonconforming uses or not, are located.    B.   Off Street Parking: The provisions of chapter 11 of this title shall apply.
   C.   Yards: No building shall be erected or enlarged unless the following yard setback requirements are provided:
      1.   Front Yard: A front yard shall be not less than twenty feet (20').
      2.   Side Yards: The minimum width of each side yard for the principal building shall not be less than ten feet (10').
      3.   Rear Yard: The minimum depth of a rear yard for the principal building shall not be less than ten feet (10'). (Ord. 123, 1979)

10-6D-4: SPECIAL USES:

The following uses may be permitted by special use permit as provided for in chapter 13 of this title:
Electronic communications transmission and reception tower. (Ord. 625, 9-10-2012)

10-6E-1: PURPOSE:

The R-3 higher density residential district is established to provide areas for single-family, two-family and higher density multi-family residential development. (Ord. 525, 5-1-2007)

10-6E-2: PERMITTED USES:

The following uses shall be permitted in the R-3 district, plus such other uses as the zoning board may deem to be similar in nature; all uses shall be subject to the property development standards in section 10-6E-4 of this article and section 10-3-3 of this title:
All uses permitted in the R-2 district; and
Dwelling, multiple-family, subject to the provisions of subsection 10-6E-4B of this article. (Ord. 525, 5-1-2007)

10-6E-3: SPECIAL USES:

The following uses may be permitted by special use permit as provided in chapter 13 of this title:
All uses allowed as special uses in the R-2 district.
Electronic communications transmission and reception tower. (Ord. 525, 5-1-2007; amd. Ord. 625, 9-10-2012)

10-6E-4: PROPERTY DEVELOPMENT STANDARDS:

   A.   The property development standards set forth in section 10-6C-4 of this chapter pertaining to R-2 districts, including minimum lot area, lot dimensions, lot coverage, building height, minimum ground floor area, off street parking, yard requirements, and zero lot line development requirements, and any amendments hereafter enacted to said section, shall apply to all land and structures in the R-3 district, except as modified in subsection B of this section.
   B.   With regard to "dwelling, multiple-family(ies)" (as defined in this code), such units shall be allowed as a permitted use herein, provided that there shall be a maximum of ten (10) such units on any one acre portion of the district. "Dwelling, multiple-family" (including, without limitation, "for rent" apartments) shall be permitted as multiple buildings on the same zoning lot provided the limitation on density as set forth in this section is adhered to.
