42 - T TEMPORARY CLASSIFICATION ZONE
To ensure that the property to be rezoned will conform to all specified standards and conditions deemed necessary to protect the best interests of the surrounding property or neighborhood and secure an appropriate development in harmony with the objectives of the general plan.

A temporary classification which is combined for a specified period of time with another zone and which, according to the terms of the ordinance, either terminates and returns the property to its underlying zone classification, or becomes final, in which case the (T) classification symbol and the underlying zone classification are removed and the proposed or tentative zone classification becomes finally effective.

When the planning commission or city council finds that an application for a zone change is consistent with the objectives of this chapter, provided certain dedications of land, waivers of access, or installations of improvements in a public right-of-way or on private property are completed or security for improvements is offered and accepted within a specified time period, it shall recommend or adopt the zone change subject to compliance with specified conditions. In such cases, the ordinance changing the zone of the property concerned shall, instead of immediately and finally rezoning the property, place it in the (T) tentative zone change classification. Such ordinance shall specify the change in zone, the conditions to be met, and the time allowed for satisfying the conditions.

The (T) tentative zone change classification shall be shown on the zoning map by the symbol "T", in parenthesis, immediately followed by the proposed zoning designation, a comma, and the underlying zoning designation, for example, (T) RM 400, RS 6000. When the rezoning proceedings are completed in accordance with this article, the (T) symbol and the underlying zone designation shall be removed leaving only the proposed zoning designation on the property, for example, RM 400. When the rezoning proceedings terminate in accordance with this chapter, the (T) symbol and the proposed zone designation shall be removed leaving only the original zoning designation on the property, for example, RS 6000.

Where either a final map or a parcel map is required by the rezoning, the (T) tentative zone change classification may remain on the property for up to two and one-half years after the effective date of the ordinance creating said temporary classification. The planning commission may extend such periods of time for one additional period not to exceed one year, provided a written application requesting such extension is filed not less than thirty (30) days prior to the expiration of the originally specified period. Applications for time extensions shall set forth all applicable facts and evidence supporting such request.

If all conditions are met within the specified time period, or an authorized extension thereof, the rezoning proceedings shall be deemed to be complete, the (T) tentative zone classification shall be removed in accordance with Section 17.42.040 (Zoning map designation), and the new zone designation shall finally become effective. If all conditions are not met within the specified time period, or an authorized extension thereof, the rezoning proceedings shall terminate, the (T) tentative zone change classification shall become null and void and shall be removed in accordance with Section 17.42.040 (Zoning map designations), and the property shall be restricted to its previously designated zone classification. Notwithstanding any other provisions of this chapter to the contrary, no public hearing need be held nor further notice be given as a requisite to the completion or termination of the rezoning proceedings as provided in this chapter.

Prior to the finalization of the zone change proceedings and the removal of the (T) tentative zone change classification, the planning department shall have received a report from the city engineer, or other appropriate city agency, verifying that all required dedications of land or installations of improvements on public or private property have been completed or security for such improvements has been offered and accepted, or that any other applicable requirement has been satisfactorily met in compliance with the specified conditions of the (T) tentative zone change ordinance.

While property remains in the (T) tentative zone change classification, it may continue to be used only for the purposes permitted in the zone applicable to the property prior to the establishment of, such (T) classification; and no permits shall be issued, no structures shall be erected or constructed, and no land shall be used for any other purpose; provided, however, that grading or other improvements required as conditions of the zone change may be accomplished. In addition, no new structures or uses shall be established for the duration of the (T) temporary classification which would become nonconforming upon the finalization of the zone change and no such existing structure or use shall be enlarged or increased in intensity of use during such period. Such limitation on the use of the property shall continue until the building department has received notification from the planning department of the removal of the (T) tentative zone change classification and the finalization or termination of the zone change proceedings.
