66 - PLANNED HIGHWAY RIGHT-OF-WAY LINES

17.66.010 - Planned highway right-of-way lines.

A.

Intent and Purpose. The establishment and protection of planned highway right-of-way lines is essential to insure that there will be adequate amounts of light and air, to provide adequate visibility when entering or leaving streets, to provide for adequate highway rights-of-way in accordance with the general plan for the city to provide a proper setting for buildings away from the noise and fumes of traffic, and to provide space for landscaping and community appearance features both now and in the future, when all streets and highways have been widened to their planned ultimate width.

B.

Establishment. The city council may, pursuant to state law, designate planned highway right-of-way lines, and upon the establishment of such lines the provisions of this section shall apply.

C.

All Yards, Setbacks, and other Measurements. They shall be from the planned highway right-of-way line, except as otherwise specified in this title.

D.

Use of Land within the Planned Highway Right-of-Way Line.

1.

No structure or building or any portion thereof shall be erected on any property within the planned highway right-of-way lines.

2.

Agricultural or landscaping use may be made of such area, provided that no trees or other permanent landscape architectural features are installed.
