17.06.020 - Definitions beginning with "A".

"Abandoned automobile." See "Automobile, abandoned."

"Abut" or "abutting" means the same as "Adjoining."

"Access" means the place or way by which pedestrians and vehicles shall have safe, adequate and suitable ingress and egress to a property or use as required by this chapter.

"Accessory" means the same as "Accessory use or accessory structure."

"Accessory building" means the same as "Accessory structure."

"Accessory structure" means a detached subordinate structure or building, the use of which is customarily incidental to that of the main structure or building, or to the main, use of the land, and which is located in the same or less restrictive zone and on the same lot with the main structure, building or use. See "dwellings, living quarters," "dwellings, servants quarters," "guest house."

"Accessory use." An accessory use is a use conducted on the same lot as the principal use or structure to which it is related, except that where specifically provided in the parking and loading regulations, accessory off-street parking or loading need not be located on the same lot; and

Is a use which is clearly incidental to and customarily found in connection with such principal use; and is either in the same ownership as such principal use or is maintained and operated on the same lot substantially for the benefit or convenience of the owners, occupants, employees, customers, or visitors of the principal use.

An accessory use includes: living or sleeping accommodations for servants; living or sleeping accommodations for caretakers in connection with specified uses and district regulation; living or sleeping accommodations for employees in connection with commercial or manufacturing uses; keeping of domestic animals, but not for sale or hire; (commercial stable or kennel is not an accessory use); swimming pools not located within a building; home occupations; a newsstand primarily for the convenience of the occupants of a structure and which is located wholly within such structure and has no exterior signs or displays; accessory off-street parking stalls open or enclosed; accessory off-street loading berths; accessory signs; accessory radio or television towers; adult education classes.

"Accessory vehicle." See "vehicle, accessory."

"Acre" means the same as "acre, net" unless otherwise specified.

"Acre, net" means forty-three thousand five hundred sixty (43,560) square feet of area, net. See "area, net."

"Addition" means the result of any work that increases the volume of an existing structure or replaces a demolished portion. Compare "alteration" and "structural alteration."

"Adjacent" means two or more lots or parcels of land separated only by an alley, or two or more objects that lie near or close to each other. Compare "adjoining."

"Adjoining" means two or more lots or parcels of land sharing a common boundary line, or two or more objects in contact with each other. Synonyms are "contiguous" or "abutting."

"Adult education classes" means accessory use in residential district, provided classes meet only one day per week for not more than three hours and class size does not exceed thirty (30) persons.

"Advertising." See "signs."

"Agricultural" or "agriculture" means the use of land for agricultural purposes including fanning, dairying, pasturage, apiculture, horticulture, floriculture, viticulture and animal and poultry husbandry, and the necessary accessory uses for handling, treating or storing the produces; provided however that the operation of any such accessory use shall be secondary to that of the normal agricultural activity.

"Airport" or "aircraft landing field" means any area of land or water which is used or intended to be used either publicly or privately for the arrival or departure of one or more aircraft, and any appurtenant areas used or intended to be used for airport buildings or other airport facilities or right-of-way, together with all airport buildings and facilities located thereon. Airport includes "heliport" and "helistop."

"Alley" means a public or private right-of-way other than a street or highway which affords the means of vehicular access to the side or rear of properties abutting a street or highway. See also "streets" and "highways."

"Alteration" means any work on a structure that does not result in any addition to the structure. Compare "addition" and "structural alteration."

"Amplitude" means the maximum displacement of the earth from the normal rest position. Amplitude is usually reported as inches or mills.

"Animals and fowls" means any animal, poultry, bird, reptile, fish or any other dumb creature.

"Animal, domestic" means any domesticated animal or household pet commonly maintained in residence with man.

"Animal, wild." The following are wild animals for the purpose of this chapter: alligator, badgers, bear, bobcats, buffalo, civet, cougar, coyote, crocodile, eagle, eland, elephant, elk, foxes, giraffe, gnu, gorilla, hyena, hippopotamus, jaguar, leopard, lion, lynx, moose, orangutan, poisonous reptile, possums, puma, raccoons, rhinoceros, sea lion, skunks, tiger, vulture, walrus, wart hog, weasel, wolf or yak.

"Apartment" means the same as "dwelling unit."

"Apartment, bachelor" means a dwelling that combines kitchen, living and sleeping rooms into one room, located within an apartment house or apartment hotel and subject to minimum floor area and occupancy requirements.

"Apartment hotel" means a residential building designed or used for both two or more dwelling units and six or more guest rooms or suites of rooms.

"Apartment house" means a residential building designed or used for two or more dwelling units, or combination of two or more dwelling units and not more than five guest rooms or suites of rooms.

"Arcade" means a contiguous area with access to a street or other public way which: Is open and unobstructed to a height of not less than twelve (12) feet; and, is accessible to the public at all times; and, has an area of not less than five hundred (500) square feet including portions occupied by building columns; and has a minimum dimension of ten (10) feet; and, is not more than three feet above the level of the street which it adjoins.

"Architectural projection." See "projection, architectural."

"Area" means the same as "area, net" unless otherwise specified.

"Area, net" means that area of a lot or parcel of land exclusive of: public alleys, highways or streets; or proposed public facilities such as alleys, highways, streets or other necessary public sites when included within a proposed development project; or, other public or private easements where the owner of the tenement does not have the right to use the entire surface of the land.

"Artisan manufacturing/flex space" means limited fabrication, assembly, or light industrial activities that provide ancillary warehousing and storage, require minimal outdoor storage, and require minimal heavy vehicle delivery/pick-up, and are in support of a primary research and development and/or industrial permitted land use in the applicable zone. Also includes any commercial use (charitable or for profit) or space for the creation, exhibition, or production of artistic or craft pieces, including art installations, ceramic products manufacturing, crafts, glass work, jewelry, painting, sculpture, and welding activities limited to the production of art.

"Assembly, places of" means any structure or premise, or portion thereof (except a theater, motion picture theater, little theater, school or special school) having an assemblage capacity of fifty (50) or more persons, designed or used for entertainment, amusement, instruction, worship, deliberation, display, meeting, awaiting transportation, or the consumption of food or drink.

"Attic" means space between a roof and the ceiling beneath, and not appropriated to any occupancy.

"Automobile." See "motor vehicle," "vehicle," "recreation vehicles" as well as automobile-related terms.

"Automobile, abandoned" means any motor vehicle, which is required to be registered by the California Vehicle Code when operated upon a highway and whose registration has been expired for a period of six months or more. However, a motor vehicle stored within a permitted building or structure shall not be considered to be an abandoned automobile.

"Automobile and trailer sales area" means an open area other than a street used for the display, sale or rental of new or used automobiles or trailers and where no repair work is done except minor incidental repairs of automobiles or trailers to be displayed, sold or rented on the premises.

"Automobile dismantling or wrecking yard" means any premises used for the dismantling or wrecking of vehicles required to be registered under the California Vehicle Code, including the buying, selling or dealing of such vehicles or the integral parts or component materials thereof or the storage, sale or dumping of dismantled, partly dismantled or wrecked inoperative vehicles. Automobile dismantling shall not include the incidental storage of inoperative or disabled vehicles in connection with a legal operation of an automobile repair garage, automobile body and fender repair shop or automobile impound yard.

"Automobile fueling station" means any lot or parcel of land or portion thereof used partly or entirely for storing or dispensing flammable liquids, combustible liquids, liquefied flammable gas or flammable gas into the fuel tanks of motor vehicles. Compare "automobile service station."

"Automobile impounding yard" means facilities designated or maintained by a governmental agency for the temporary storage of vehicles legally removed or impounded by a peace officer from public or private property as prescribed by law.

"Automobile laundry" or "car wash" means a building or portion thereof containing facilities for washing more than two automobiles using production line methods with chain conveyors, blowers, steam cleaning device or other mechanical means.

"Automobile, minor emergency repairs" means those repairs to a currently state-licensed motor vehicle owned by the occupants of the property, which do not require the complete immobilization of the vehicle in excess of twenty-four hours duration or do not require the removal of the engine, transmission, rear end or more than one wheel. "Minor emergency repairs" does not include body and fender work.

"Automobile parking." See "parking lot" and parking-related definitions.

"Automobile repair business" means the activity of doing repair work on motor vehicles, or the replacing of, or the adding of parts thereto for compensation. Tire changing, brake adjustments, tire repairing, lamp globe changing, fan belt changing, the changing or charging of batteries, changing or installing of ornamental accessories and lubricating motor vehicles and such activity is incident to the business of selling motor fuel or ornamental accessories shall not be deemed to be engaging in the automobile repair business.

"Automobile service station" means structures or premises where gasoline, oil, grease, batteries, tires and automobile accessories may be supplied and dispensed at retail, and where in addition, the following services may be rendered and sales made, and no other:

1.

Sale and servicing of spark plugs, batteries, and distributors and distributor parts;

2.

Tire servicing and repair, but not recapping or regrooving;

3.

Replacement or adjustment of automobile accessories;

4.

Radiator cleaning and flushing, provision of water, antifreeze and other additives;

5.

Washing and polishing, and sale of automobile washing and polishing materials;

6.

Greasing and lubrication;

7.

Providing and repairing fuel pumps; exterior oil pumps and lines;

8.

Servicing and repair of carburetors;

9.

Adjusting and repairing brakes;

10.

Emergency wiring repairs;

11.

Motor adjustments not involving removal of the head or crankcase;

12.

Provision of cold drinks, packaged foods, tobacco, and similar convenience goods for gasoline supply station customers, but only as accessory and incidental to the principal operation;

13.

Provision of road maps and other information material to customers;

14.

Provision of restroom facilities;

15.

Parking lot as an accessory use only.

Uses permissible at a service station do not include body work, straightening of frames or body parts, steam cleaning, painting, nor welding.

"Awning" means a temporary shelter supported by an exterior wall of a building and of a type which can be retracted, folded or collapsed against the face of the supporting building. Compare "canopy," "marquee."

17.06.030 - Definitions beginning with "B".

"Bachelor apartment." See "apartment, bachelor."

"Balcony" means an unroofed platform enclosed by a railing or parapet projecting from the wall of a building for the private use of tenants or for exterior access to the above-grade living units. When a balcony is roofed and enclosed with operating windows, it is considered part of the room it serves.

"Basement." That portion of a building between floor and ceiling which is partly below and partly above grade, but so located that the vertical distance from grade to the floor below is less than the vertical distance from grade to ceiling. See also "cellar."

"Billboard" or "outdoor advertising structure." See "signs."

"Block" means the land adjoining one side of a street between two consecutive junctions of such street with streets, railways, right-of-way, or waterways crossing or meeting such side of such street.

"Boarding or rooming house" means a residential building containing a single dwelling unit and not more than five guest rooms or suites of rooms where lodging is provided with or without meals, for compensation.

"Boats and boat trailers." See "recreational vehicles."

"Buildable area" means the same as "area, net."

"Building" means any structure having a roof supported by columns or walls, for the housing, shelter, or enclosure of persons, animals, chattels, or property of any kind. See also "structure."

"Building, accessory." See "accessory Structure."

"Building, addition to." See "addition."

"Building, residential." See "residential building."

"Building coverage." See "lot coverage."

"Building height." See "height, building or structure."

"Building line" means a line established by law or agreement usually parallel to the property line beyond which a structure may not extend. See also "street line, planned."

"Building site" means the same as "lot."

"Bulk" means the size of buildings or other structures and their relationships to each other and to open areas and lot lines. Regulations controlling bulk include: maximum height; maximum lot coverage; maximum floor area ratio; minimum size of yards and setbacks.

The shape of buildings or other structures and the area of the lot upon which a residential building is located and the number of dwelling units or rooms within such building in relation to the area of the lot.

"Bulk distributing stations" means hazardous materials" means any distributing station for hazardous materials where there is located a loading rack and which is not an integral part of a refinery, natural gasoline plant or crude petroleum producing or pipeline operation.

17.06.040 - Definitions beginning with "C".

"Camp, tourist." See "tourist camp."

"Camp, youth." See "youth camp."

"Camper." See "recreational vehicles." Compare "mobilehome."

"Canopy" means a fixed shelter without enclosing walls used only as a roof and attached to the exterior wall or walls of a building and used only for purposes accessory to the building to which it is attached. A canopy may have column support in addition to the support provided by the building to which it is attached. Compare "awning" and "marquee."

"Car." See automobile-related definitions, "motor vehicle" and "vehicles."

"Car wash." See "automobile laundry" or "car wash."

"Carport" means an accessory structure or portion of a principal structure, consisting of a roof and supporting members such as columns or beams, unenclosed from the ground to the roof on at least two sides, and designed or used for the parking or temporary storage of motor vehicles of owners or occupants of the structure to which it is accessory.

"Cellar" means the portion of a building between floor and ceiling which is wholly or partly below grade and so located that the vertical distance from grade to the floor below is equal to or greater than the vertical distance from grade to ceiling. See also "basement."

"Cemetery" means land used or intended to be used for the burial or interment of the dead and dedicated for such purposes, including columbariums, crematories, mausoleums and mortuaries when operated in conjunction with and within the boundary of such cemetery.

"Certificate of occupancy" means a required document issued by the building department prior to the occupation or use of vacant land, except for agricultural uses, or prior to occupation or use of buildings erected or structurally altered.

"Child day care center" or "child care nursery" means any building or other premises or portion thereof appropriated to the day care, apart from their parents or guardian, of more than six ambulatory children between the ages of two and five years inclusive and between the hours of six a.m. and seven p.m. The establishment shall be licensed by the state and conducted in accordance with state requirements. Similar terms are day nursery, nursery school and child day care nursery. Rooms accessory to a church and used for religious education on not more than two days a week are not considered child day care centers. Compare "family day care home," "family foster care home," and "children's home," "philanthropic institution."

"Children's home" means one or more buildings used for the semi-permanent, twenty-four hour care of orphans or other children deprived of parental care, operated by a public agency or a philanthropic or charitable organization, but shall not include commercial enterprises operated by such organization or a correctional institution.

"Clinic" means any facility used for the care, diagnosis and treatment of sick, active, infirm or injured persons and those who are in need of medical, dental or surgical attention, but who are not provided with board or room or kept overnight on the premises. "Clinic" includes dental clinic, health clinic, medical clinic and doctors' offices and may include laboratory facilities in conjunction with normal clinic services.

"Club, country" means a private club organized and operated for social purposes and possessing outdoor recreational facilities, such as golf courses, tennis courts or polo grounds.

"Club, private" means any building or premises used by an association of persons whether incorporated or unincorporated, organized for some common purpose, but not including a group organized solely or primarily to render a service customarily carried on as a commercial enterprise.

"Colleges" and "universities." See "educational institutions."

"Commercial psychic activities" means any activity which for a fee, donation, gratuity, reward, compensation or consideration of any kind purports to predict or foretell the future or fate of any individual, group, business or nation or attempts or promises to influence the future or performance of any person, group, business or nation by analysis of parts, products, or personal characteristics of a person, including, but not limited to palm reading, crystal ball, celestial body, tea leaves, playing of cards or through the exercise of any purported psychic, mediumistic, prophetic, occult, clairvoyant or supernatural power.

"Commercial district" means a zoning district whose designation begins with the letter "C".

"Communication equipment building" means a building housing operating mechanical or electronic switching equipment of a telephone or similar communication system and personnel necessary for operation of such equipment. See also "utilities."

"Compressed gas" means any gas which is compressed to a pressure in excess of fifteen (15) pounds per square inch, gage (psig) at ambient temperature.

"Conditional use" means a use which requires a special degree of control because of characteristics peculiar to it, or because of size, technological processes or type of equipment, or because of the exact location with reference to surroundings, streets and existing improvements or demands upon public facilities.

Such control is to ensure that the particular use at the particular site on which such use is proposed to be located, is compatible with other existing or permitted uses surrounding the site.

"Contiguous" means the same as "adjoining."

"Convalescent home" means the same as "health facility, long-term."

"Convenience establishments" means small establishments designed and intended to serve the daily or frequent trade or service needs of surrounding population. Such establishments include grocery stores, variety stores, drugstores, coin-operated laundry and dry cleaning establishments, beauty shops, barbershops and medical and dental offices. Specifically excluded are automobile service stations and repair garages and drive-in eating and drinking establishments.

"Corner lot." See "lot, corner."

"Corrosive material" means any acid, alkaline, caustic or other liquid or solid material which when in contact with living tissue will cause damage to such tissue by a chemical action, or which may cause fire when in contact with other materials.

"Court" means an open unoccupied space, bounded on three sides by the walls of a building. An inner court is a court entirely enclosed within the exterior walls of a building. All other courts are outer courts.

"Coverage." See "lot coverage."

"Curb level" means the level of the established curb in front of the building measured at the center of such front. Where no curb level has been established, the city engineer shall establish such curb level or its equivalent.

17.06.050 - Definitions beginning with "D".

"Dairy" means any premises where three or more cows or goats or any combination thereof equaling three or more animals are kept or maintained for the purpose of producing milk or milk products.

"Day care center" or "day nursery" means the same as "child day care center."

"Day care home" means the same as "family day care home."

"Decibel" means a unit which describes the sound pressure level or intensity of sound. The sound pressure level in decibels is twenty (20) times the logarithm to the base ten (10), of the ratio of the pressure of the sound to a reference pressure of 0.0002 microbar.

"Density" means the number of dwelling units that may be constructed per acre or per square foot of lot area.

"Dental clinic." The same as "clinic."

"Depth of lot." See "lot, depth."

"Design" means street alignment, grades and width, alignment and width of easements and rights-of-way for drainage and sanitary sewers and minimum lot area depth and width.

Design shall also include the alignment, grade and width of easements and rights-of-way for utilities as well as grading and general layout of the lots and streets within the area.

"Detached living quarters" means the same as "guest house."

"Developer" means a person or agency proposing to initiate and carry out a project.

"Development" means the activity of preparing land and constructing buildings, facilities, or other improvements in order to establish a land use. Development also means a lot or parcel together with the buildings, facilities, or other improvements located thereon.

"Discrete impulses" means a ground-transmitted vibration stemming from a source where specific pulses do not exceed sixty (60) per minute or one per second.

"Dormitory" means a guest room designed, intended or occupied as sleeping quarters for more than two persons. Every hundred (100) square feet of superficial floor area in a dormitory shall be considered as a separate guest room.

"Drive-in restaurants" or "drive-in eating and drinking establishments" means any commercial establishment serving food or drinks, making provisions encouraging consumption of food or beverages in automobiles, whether such consumption in automobiles is on the premises or at the curb adjacent to the premises.

"Duplex" means the same as "dwelling, two-family."

"Dust, fugitive sources" means sources of dust other than from a stack, chimney or vent such as from open piles, conveyors, loading, etc.

"Dust, windborne" means particulate matter which is solid at standard conditions and released into the atmosphere by the action of wind.

"Dwelling" means a building or portion thereof designed or used exclusively for residential purposes or occupancy. For the purposes of this title, dwellings do not include apartment houses, hotels, apartment hotels, mobilehomes, motels, rooming houses, nursing homes, housing for the elderly, rest homes, university owned or leased housing or institutions. See also "residential building."

"Dwelling, accessory." See "servants quarters" and "guest house."

"Dwelling living quarters" means the same as "guest house."

"Dwelling, servants quarters." See "servants quarters."

"Dwelling, single-family detached," means a detached building designed or used exclusively for occupancy by one family and containing one dwelling unit.

"Dwelling, two-family" means a building designed or used exclusively for occupancy by two families and containing two dwelling units.

"Dwelling, multi-family" means the same as "Apartment house."

"Dwelling, townhouse" means a residential building designed for or containing one or two dwelling units and structurally separated in accordance with the provisions of this title, and which may be sold jointly with a lot upon which the dwelling unit is situated.

"Dwelling, group" means two or more one-family or multiple-family dwellings, apartment houses or boarding or rooming houses located on the same lot.

"Dwelling unit" means a group of two or more one-family or multiple-family dwellings, apartment houses or boarding or rooming houses located on the same lot.

"Dwelling unit" means a group of two or more rooms, one of which is a kitchen, designed for occupancy by one family for living and sleeping purposes.

"Dwelling unit efficiency" means the same as "apartment, bachelor."

17.06.060 - Definitions beginning with "E".

"Earthborne vibration." See "vibration, earth borne."

"Easement, private road." See "streets and highways," "private road easement."

"Educational institutions" means colleges or universities supported wholly or in part by public funds, and other colleges or universities giving general academic instruction as prescribed by the state board of education.

"Efficiency dwelling unit" means the same as "apartment, bachelor."

17.06.070 - Definitions beginning with "F".

"Family" means a person or persons living together as a single housekeeping unit in a residential building.

"Family day care home" means a single family home that provides non-medical care to children under eighteen (18) years of age in need of personal services, supervision, or assistance essential for sustaining the activities of daily living or for the protection of the individual on less than a twenty-four-hour basis, for up to fourteen (14) children, including children under the age of ten (10) years who reside at the home.

"Family foster care home" means a dwelling unit, where full-time foster care is provided for unrelated children as part of the family, where the total number of children, sixteen (16) years or under, does not exceed six, the total number of people (excluding servants) does not exceed eight, and the dwelling unit is licensed by the state as a full-time foster home.

"Fence" means a free-standing structure of metal, masonry, composition or wood or any combination thereof resting on or partially buried in the ground and rising above ground level, and used for confinement, privacy, protection, screening or partition purposes. See also "landscaping," "screening."

"Filling station." See "automobile service station."

"Final map" means a map prepared in accordance with the subdivision ordinance and with any applicable provisions of the Subdivision Map Act, designed to be recorded with the county recorder.

"Fire protection" means such fire hydrants and other protective devices as required by the chief of the Coachella fire protection district.

"First story." See "story, first."

"Flood hazard" means a hazard to land or improvements due to overflow water having sufficient velocity to transport or deposit debris, scour the surface soil, dislodge or damage buildings, or erode the banks of water courses.

"Floor area" means the sum of the gross areas of the several floors of a building or buildings, measured from the exterior faces of exterior walls or from the center lines of walls separating two buildings. In particular, floor area includes:

1.

Basement space, except as specifically excluded in his or her definition.

2.

Elevator shafts or stairwells at each floor.

3.

Floor space in penthouses.

4.

Attic space (whether or not a floor has been laid) providing structural headroom of eight feet or more.

5.

Floor space in interior balconies or mezzanines.

6.

Floor space in open or roofed terraces, exterior balconies, breezeways or porches, if more than fifty (50) percent of the perimeter of such terrace, balcony, breezeway or porch is enclosed, and provided that a parapet not higher than three feet, eight inches, or a railing not less than fifty (50) percent open and not higher than four feet, six inches, shall not constitute an enclosure.

7.

Any other floor space used for dwelling purposes, no matter where located within a building, when not specifically excluded.

8.

Floor space in accessory buildings, except for floor space used for accessory off-street parking.

9.

Floor space used for permitted or required accessory off-street parking spaces located more than twenty-three (23) feet above curb level.

10.

Floor space used for accessory off-street loading berths in excess of two hundred (200) percent of the amount required by the applicable district regulations.

11.

Any other floor space not specifically excluded.

12.

However, the floor area of a building shall not include:

a.

Cellar space, except that cellar space used for retailing shall be included for the purpose of calculating requirements for accessory off-street parking spaces and accessory off-street loading berths.

b.

Elevator or stair bulkheads, accessory water tanks, or cooling towers.

c.

Uncovered steps.

d.

Attic space, whether or not a floor actually has been laid, providing structural headroom of less than eight feet.

e.

Floor space in open or roofed terraces, exterior balconies, breezeways, or porches, provided that not more than fifty (50) percent of the perimeter of such terrace, balcony, breezeway or porch is enclosed, and provided that a parapet not higher than three feet, eight inches, or a railing not less than fifty (50) percent open and not higher than four feet, six inches, shall not constitute an enclosure.

f.

Floor space used for permitted or required accessory off-street parking spaces located not more than twenty-three (23) feet above curb level.

g.

Floor space used for accessory off-street loading berths, up to two hundred (200) percent of the amount required by the applicable district regulation.

h.

Floor space used for mechanical equipment.

"Floor area ratio" means the total floor area on a lot divided by the lot area. For example: a building containing twenty thousand (20,000) square feet of floor area on a zoning lot of ten thousand (10,000) square feet has a floor area ratio of two.

"Freeway." See "streets and highways."

"Frequency" means the number of times that a displacement completely repeats itself in one second of time. Frequency may be designated in cycles per second or hertz (Hz).

"Front yard." See "yard, front."

"Frontage" means all property fronting on one side of a street between intersecting or intercepting streets, or between a street and right-of-way, waterway, end of dead-end street, or city boundary measured along the street line. An intercepting street shall determine only the boundary of the frontage on the side of the street which it intercepts.

"Frontage road." See "streets and highways, service road."

"Future street or alley." See "streets and highways, future street."

17.06.080 - Definitions beginning with "G".

"Garage, private." See "parking garage, accessory."

"Garage, repair" means a structure or portion thereof, other than a storage or parking garage, designed or used for repairing, equipping or servicing of motor vehicles. Such garages may also be used for housing, storage or sale of motor vehicles.

"Garage, storage" means a structure or portion thereof designed and used exclusively for the storage of motor vehicles, and within which temporary parking may also be permitted.

"Gas." See "flammable gas."

"General plan" means a comprehensive declaration of purposes, policies and programs for the development of the city and including, where applicable, diagrams, maps and text setting forth objectives, principles, standards, and other features, and which has been adopted by the city council. Compare "specific plan."

"Geological exploratory core hole, temporary" means a seismic test hole or exploratory core hole used or intended to be used exclusively for geophysical or geological exploratory work preliminary to possible exploration for oil, natural gas or other hydrocarbons, to be drilled and abandoned within ninety (90) days from the time of commencement of actual drilling operations.

"Grade" means the lowest point of elevation of the finished surface of the ground between the exterior wall of a building and a point five feet distant from said wall, or the lowest point of elevation of the finished surface of the ground between the exterior wall of the building and the property line if it is less than five feet distant from said wall. In ease walls are parallel to and within five feet of a public sidewalk, alley or other public way, the grade shall be the elevation of the sidewalk, alley or public way.

"Guest house" means an accessory structure used solely as a temporary dwelling of guests of the occupants of the premises and containing not more than five guest rooms or suites of rooms, but with no kitchen facilities and not rented or otherwise used as a separate dwelling unit. See also "accessory structure" and "servants quarters."

"Guest room" means any habitable room which does not contain cooking facilities and is designed or used for occupancy by one or more persons and is not in a dwelling unit. See also "room, light housekeeping," "suite."

17.06.090 - Definitions beginning with "H".

"Habitable room." See "room, habitable."

"Health facility, long-term" means an institution or premises licensed by the state and used for the housing and care of the ambulatory, aged, or infirm and offering or providing lodging, meals, nursing, dietary or other personal services, but not including the care and treatment of persons with contagious or communicable disease or persons insane or addicted to narcotics or alcohol. There shall be no surgery, physical therapy or other similar activities such as is customarily provided in hospitals. Also called rest homes, convalescent homes, homes for the aged, veteran's homes, institutions for the feebleminded, cerebral palsied and the like, plus other similar names, signifying long-term care, which is personal and at most, nursing help, rather than medical or surgical care. See also "hospital."

(Note: A senior citizens project or housing for the elderly project is to be distinguished from a long-term health facility in that the senior citizens project or housing is primarily of a residential character with only incidental nursing facilities while a nursing home is primarily designed and used for the care of convalescent or ill persons.)

"Height, building or structure" means the vertical distance from the grade to the highest point of the coping of a flat roof, or to the deck line of a mansard roof or to the average height of the highest gable of a pitch or hip roof.

"Heliport" means an area of land or water or a structural surface which is used or intended for use for the landing and take-off of helicopters, and any appurtenant areas which are used or intended for use for heliport buildings and other heliport facilities.

"Helistop" means the same as a heliport except that no refueling, maintenance, repairs or storage of helicopters is permitted.

"Highways." See "streets and highways."

"Home for aged" means the same as "health facility, long-term."

"Home, child care" means the same as "family day care home."

"Home, children's." See "children's home."

"Home convalescent" means the same as "health facility, long-term."

"Home, daily care" means the same as "family day care home."

"Home, family daily care." See "family day care home."

"Home foster care." See "family foster care home."

"Home, long-term convalescent." Same as "health facility, long-term."

"Home, mobile." See "mobilehome."

"Home, model." See "model home."

"Home, motorized." See "recreational vehicles."

"Home, nursing" means the same as "health facility, long-term."

"Home, rest." The same as "health facility, long-term."

"Home occupation" means an accessory use which:

1.

Is clearly incidental to or secondary to the residential use of a dwelling unit;

2.

Is not the principal office;

3.

Is carried on within a dwelling unit or accessory structure by one or more occupants of such dwelling unit, except that in connection with the practice of a profession, one person not residing in such dwelling unit may be employed; and

4.

Occupies not more than twenty-five (25) percent of the total floor area of such dwelling unit and in no event more than five hundred (500) square feet of floor area.

A.

In connection with the operation of a home occupation, it shall not be permitted:

1.

To sell articles produced elsewhere than on the premises;

2.

To have exterior displays or a display of goods visible from the outside;

3.

To store materials or products outside of a principal or accessory structure;

4.

To display in an R-1 District a nameplate or other sign, except as permitted in connection with the practice of a profession;

5.

To make external structural alterations which are not customary in residential buildings;

6.

To produce offensive noise, vibration, smoke, dust or other particulate matter, odorous matter, heat, humidity, glare or other objectionable effects.

B.

Home occupations include, but are not limited to:

1.

Fine arts studios;

2.

Professional offices, including offices of physician, dentist or other person licensed by law to practice medicine or healing, and ministers of religion;

3.

Teaching of not more than four pupils simultaneously or in the case of musical instruction of not more than a single pupil at a time;

C.

However, home occupation shall not include uses such as:

1.

Advertising or public relations agencies;

2.

Barbershops;

3.

Beauty parlors;

4.

Commercial stables or kennels;

5.

Depilatory electrolysis or similar offices;

6.

Interior decorator's offices, or workshops;

7.

Ophthalmic dispensing;

8.

Pharmacy;

9.

Real estate or insurance offices;

10.

Stockbroker offices;

11.

Veterinary medicine.

"Hospital" means an establishment which provides accommodations, facilities and services over a continuous period of twenty-four (24) hours or more, for observation, diagnosis and care, of two or more individuals, not related by blood or marriage to the operator, who are suffering from illness, injury, deformity or abnormality, or from any condition requiring obstetrical, medical or surgical services. The term "hospital" includes "hospital, special" services unless otherwise specified.

"Hospital, long-term convalescent" or "nursing and convalescent" means the same as "health facilities, long-term."

"Hospital, psychiatric" means the same as "hospital, special."

"Hospital, special" means a hospital which treats primarily people with communicable disease, insane or feebleminded patients, epileptics, drug addicts or alcoholic patients.

"Hotel" means a residential building designed or used for occupancy by transients for dwelling, lodging, or sleeping purposes or containing six or more guest rooms or suites of rooms, which may also contain not more than one dwelling unit, but not including any institution in which human beings are housed or detained under legal restraint.

"Hotel, apartment." See "apartment hotel."

"House, apartment." See "apartment house."

"House, boarding or rooming." See "boarding or rooming house."

"House, guest." See "guest house."

"House, rooming." See "boarding or rooming house."

"House trailer." See "mobilehome."

"Household pet." The same as "animal, domestic."

"Housing for the elderly" or "senior citizen housing" means a project specially designed for elderly persons and providing living unit accommodations and spaces for common use by the occupants in social and recreational activities and, when needed, incidental facilities and space for the project residents.

17.06.100 - Definitions beginning with "I".

"Impact" means an earthborne impact vibration generally produced by two or more objects striking each other so as to cause separate and distinct pulses.

"Impact noise" means relatively short duration noise, generally produced by the striking of two or more objects so as to be heard as separate distinct noises. See also "noise" and "sound."

"Impact noise analyzer" means an instrument which measures the peak sound pressure of an impact noise and meets the standards of the American National Standards Institute (or the International Electrotechnical Commission).

"Improvement" means such street work and utilities to be installed, or agreed to be installed by the developer on the land to be used for public or private streets, highways, alleys, pedestrian-ways, ways and easements, a are necessary for the general use of the residents in the project and local neighborhood traffic and drainage needs and required as a condition precedent to the approval and acceptance of the project. Such street work and utilities include necessary monuments, street name signs, guardrails, barricades, safety devices, fire hydrants, grading, retaining walls, storm drains and flood control channels and facilities, erosion control structures, sanitary sewers, street lights, street trees, traffic warning devices (other than traffic signals and relocation of existing traffic signal systems directly affected by other subdivision improvements) and other facilities as are required in conformance with other applicable provisions of this chapter, or as are determined necessary by the planning director for the necessary and proper development of the project.

"Impulses, discrete." See "discrete impulses."

"Industrial district" means any zoning district whose designation begins with the letter "M".

"Industrial park" means a special or exclusive type of industrial area designed or equipped to accommodate a community of industries, or approved under the procedure for planned developments.

"Inner court." See "court."

"Institution, educational." See "educational institution."

"Institution, health." See "clinics," "health facilities, long-term" and "hospitals."

"Institution, philanthropic." See "philanthropic institution."

"Inundation" means ponded water or water in motion of sufficient depth to damage property due to the presence of the water or to deposits of silt.

17.06.110 - Definitions beginning with "J".

"Junk or salvage yard" means any premises used for the keeping or storage of junk, including but not limited to, iron and scrap metals, paper, rags, glass, wood and similar materials and shall include the dismantling of machinery or the storage or keeping for sale of parts and equipment resulting from dismantling or wrecking operations on said property or elsewhere. Junk and salvage yards shall also include the baling of cardboard, cardboard boxes, paper and paper cartons. Compare "automobile dismantling and wrecking yard."

17.06.120 - Definitions beginning with "K".

"Kennel" means any lot or structure whereon or wherein four or more dogs are kept or maintained for any purposes.

"Kitchen" means any room or any portion of a dwelling unit, whether an enclosing subdivision thereof or otherwise, used or intended or designed to be used for cooking and preparing food, except a light housekeeping room or that portion of a recreation room in a multiple residential use, or in an accessory building appurtenant thereto, containing facilities for the cooking and preparation of food.

17.06.130 - Definitions beginning with "L".

"Land reclamation project" means a project established to restore otherwise unsuitable land to useful purposes such as recreational areas through the use of fill materials such as rubbish, waste, soil and other unwanted materials. "Land reclamation project" shall include a "dump" or "waste disposal facility."

"Landscaping" means the planting and maintenance of some combination of trees, ground cover, shrubs, vines, flowers or lawns. In addition, the combination or design may include natural features such as rock and stone and structural features including, but not limited to fountains, reflecting pools, art work, screens, walls, fences and benches. See also "fence" and "screening."

"Light housekeeping room." See "room, light housekeeping."

"Liquid." See "combustible liquid" and "flammable liquid."

"Liquor, off-sale establishment" means any retail establishment which requires a Type 20, Type 21 or similar retail license from the California Department of Alcoholic Beverage Control (ABC) to sell liquor to customers for their consumption off the establishment's premises.

"Liquor, on-sale establishment" means any retail establishment which requires a Type 41 (restaurant), Type 42 (bar/tavern), Type 47 (restaurant), type 48 (bar/nightclub), or similar retail license from the California Department of Alcoholic Beverage Control (ABC) to sell liquor to customers for their consumption on the establishment's premises.

"Living quarters" means the same as "dwelling unit."

"Loading berth" means a space within a loading facility, exclusive of driveways, aisles, maneuvering areas, ramps, columns, landscaped areas, office and work areas for the temporary parking of a commercial vehicle while loading or unloading goods or materials, and which abuts upon a street, alley, or other appropriate means of access.

"Loading facility" means an area, either open or enclosed, or partially enclosed within a structure or portion thereof, designed or used for the temporary parking of commercial vehicles while loading or unloading goods or materials.

"Long-term convalescent home" or "health facility." See "health facility, long-term."

"Lot" means a piece or parcel of land of at least sufficient size to meet minimum zoning requirements for use, coverage and area, and to provide such yards and other open spaces as are required by this chapter. Such lot shall have frontage on an improved public street, or on an approved private street, and may consist of:

1.

A single lot of record;

2.

A portion of a lot of record;

3.

A combination of complete lots of record, of complete lots of record and portions of lots of record, or of portions of lots of record;

4.

A parcel of land described by metes and bounds;

Provided that no case of division or combination shall any residual lot or parcel be created which does not meet the requirements of this chapter. The word lot includes the words "plot" or "parcel."

"Lot of record" means a lot which is part of a subdivision recorded in the office of the county recorder, or a lot or parcel described by metes and bounds, the description of which has been so recorded.

"Lot area" means the total area measured in a horizontal plane, included within the lot lines of a lot or parcel of land.

"Lot coverage" means that percentage of a lot which, when viewed directly from above would be covered by a structure or structures, or any part thereof, excluding projecting roof eaves.

"Lot depth" means the distance between the midpoint of the front lot line and the midpoint of the rear lot line.

"Lot frontage." See "frontage."

"Lot line, front" means a line separating an interior lot from a street or highway, or a line separating the narrower street frontage of a corner lot from the street or highway, unless otherwise specified by deed restrictions.

"Lot line, rear" means a lot line which is opposite and most distant from the front lot line and, in the case of an irregular, triangular, or gore-shaped lot, a line ten (10) feet in length within the lot, parallel to and at the maximum distance from the front lot line.

"Lot line, side" means any lot boundary line, not a front lot line or a rear lot line. On a corner lot, the street right-of-way line with the greatest amount of street frontage shall be the side lot line.

"Lot width" means the horizontal distance between the side lot lines measured at right angles to the lot depth at a point midway between the front and rear lot line.

"Lot, corner" means a lot situated at the intersection of two or more streets having an angle of intersection of not more than one hundred thirty-five (135) degrees.

"Lot, reversed corner" means a corner lot, the side street of which is substantially a continuation of the front lot line of the first lot to its rear.

"Lot, flag" means a lot so shaped and designed that the main building site area is set back from the street on which it fronts and includes an access strip not less than twenty (20) feet in width at any point connecting the main building site area to the frontage street.

"Lot, interior" means a lot bounded by a street on one side only, or a lot other than a corner lot.

"Lot, key" means the first interior lot to the rear of a reversed corner lot and not separated therefrom by an alley.

"Lot, through" means an interior lot having a frontage on two parallel or approximately parallel streets.

"Lot, transitional" means generally, the first one hundred (100) feet of a lot in an R district having a side line adjoining or separated only by an alley from a lot in a C or M zone.

17.06.140 - Definitions beginning with "M".

"Major highway." See "streets and highways."

"Map." See "final map," "parcel map," "tentative map," "tentative map revised," and "zoning map."

"Final map" means a map prepared in accordance with the subdivision ordinance and with any applicable provisions of the Subdivision Map Act, designed to be recorded with the county recorder.

"Parcel map" means a map showing the division of land as described in the State Subdivision Map Act, (Section 11535, subdivisions (b) and (c)), and prepared in accordance with the provisions of the subdivision ordinance of the city, and the Subdivision Map Act.

"Tentative map" means a map made for the purpose of showing the design of a proposed subdivision and the existing conditions in and around it and need not be based upon an accurate or detailed final survey of the property.

"Tentative map revised," means a map involving a revised arrangement of the streets, alleys, easements or lots within property for which a tentative map has been previously approved, or a modification of the boundary of the property.

"Zoning map" means designated official map or maps which show the location and boundaries of the districts established by this chapter and are referred to as the "zoning map" and incorporated as a part of this chapter. The "zoning map" together with everything shown thereon and all amendments thereto, are as much a part of this chapter as if fully set forth and described in context.

"Marquee" means a fixed shelter used only as a roof and extended over a building line, and which is entirely supported by the building to which it is attached. Compare "awning," "canopy."

"Medical clinic" means the same as "clinic."

"Mental care." See "hospital, special" and "health facility, light mental care."

"Microwave station" means a structure housing equipment necessary for the receiving, amplifying or transmitting of microwave signals, including necessary antenna systems along a communications route which employs microwave frequencies assigned by the Federal Communications Commission.

"Mineral production" means the mining, quarrying, excavating, processing and stockpiling of rock and gravel within a district, but not including the removal of such materials from an area in order to prepare it for building or street construction.

"Minor emergency repairs." See "automobile, minor emergency repairs."

"Mobilehome" means a structure or vehicle, without its own motive power, used or designed for living or sleeping purposes. It is equipped with wheels for the purpose of transporting such from place to place, but is generally located on a fixed or semipermanent base. A mobilehome or house trailer is not a dwelling unit. In addition, a travel trailer is not to be considered as a mobilehome. Compare "recreational vehicles."

"Mobilehome park" means any lot or parcel of land where trailer or mobilehome sites are rented or leased or offered for rent or lease for one or more house trailers or mobilehomes. Compare "tourist camp."

"Mobilehome site" means that portion of a mobilehome park set aside and designated for the occupancy of a mobilehome and including the area set aside or used for parking or building structures which are accessory to the mobilehome.

"Model home" means a dwelling or residential building having all of the following characteristics:

1.

Such dwelling is constructed upon a proposed lot previously designated as a model home site by the planning commission in a subdivision for which the planning commission has approved or conditionally approved a tentative map, but for which a final map has not yet been recorded. The proposed lot upon which the model home is constructed is recognized as a legal building site for the duration of the model home permit.

2.

No certificate of occupancy for such dwelling has been issued by the building department.

3.

Where applicable, temporary access thereto is permitted over future streets previously restricted to public, access.

4.

Such dwelling is intended to be temporarily utilized as an example of the dwellings which have been built or which are proposed to be built in the same subdivision.

"Motel" means a group of attached or detached buildings containing individual sleeping or living units designed or used temporarily by tourists or transients traveling by automobile, with the garage attached or parking space conveniently located to each unit, commonly referred to as auto courts, motels, motor lodges, tourist courts and similar designation. Otherwise, the same as "hotel."

"Motor vehicle" means a self-propelled device used or intended to be used for the transportation of freight or passengers upon a street or highway, excepting a device moved by human power or a device used exclusively upon stationary rails or tracks. See also "recreational vehicle" and automobile-related definitions plus "vehicle, accessory" and "vehicle, commercial."

"Multi-tenant retail" means collective sales or exchange of merchandise by individual vendors occupying separate sales spaces that are not divided by permanent walls. This classification includes both indoor and outdoor swap meets, conducted on either a permanent or recurring basis.

17.06.150 - Definitions beginning with "N".

"Net acre." See "acre, net."

"Net area." See "area, net."

"Noise" means a subjective description of an undesirable or unwanted sound. See also "sound" and "impact noise."

"Nonconforming uses, lots, structures and characteristics of use" means Section 070.05.

"Nursery, day." The same as "child day care center."

"Nursery school" means the same as "child day care center."

"Nursing home" means the same as "health facility, long-term."

17.06.160 - Definitions beginning with "O".

"Octave band analyzer" means an instrument to measure the octave band composition of a sound, by means of band-pass filters. It shall meet the specifications of the American National Standards Institute and should be calibrated in the preferred frequencies. (ANSI S1.4-1961, ANSI S1.6-1967, ANSI S1.111966). See also "preferred center frequency."

"Odor threshold concentration" means the lowest concentration of odorous matter that produces an olfactory response in normal human beings. Odor thresholds shall be determined in accordance with the American Society for Testing and Materials Test Method D1391-57 (reconfirmed to 1967) or in an equivalent manner acceptable to the zoning administrator.

"Odor threshold limit value" means the maximum allowable concentration of odorous matter to which an industrial worker may be exposed for eight hours per day, five days a week as adopted by the American Conference of Governmental Industrial Hygienists.

"Odorous matter" means material suspended in the atmosphere that produces an olfactory response in normal human beings.

"Office" means the following types of uses are typical office functions:

1.

Agricultural, business, and personal credit services;

2.

Security and commodity brokers, dealers, exchanges, and services;

3.

Employment services;

4.

Insurance carriers, agents, brokers, and services;

5.

Real estate and related services;

6.

Holding and investment companies;

7.

Advertising services;

8.

Consumer and mercantile credit reporting services;

9.

Adjustment and collection services;

10.

Direct mail advertising services;

11.

Stenographic services and other duplicating and mailing services;

12.

News syndicate services;

13.

Business and management consulting services;

14.

Detective and protective services;

15.

Motion picture distribution and services;

16.

Physician services;

17.

Dental services;

18.

Legal services;

19.

Engineering and architectural services; and

20.

Office activities only of business organizations involved in manufacturing, wholesale and retail trade, transportation, communication and utilities, public and semipublic.

"Oil well" means any shaft or hole already drilled, being drilled or to be drilled into the surface of the earth which is used or intended to be used in connection with coring, or the drilling for, prospecting for, or the production of petroleum, natural gas, or other hydrocarbon substances; or is used or intended to be used for the subsurface injection into the earth of oil field waste, gases, water or liquid substances; including any such existing hole, shaft or casing which has not been abandoned.

"Open space, major" means any space or area characterized by great natural scenic beauty or whose existing open space, natural condition, or present state of use, if retained, would enhance the present or potential value of abutting or surrounding urban development, or would maintain or enhance the conservation of natural or scenic resources.

"Open space, minor" means that portion of a lot including courts or yards, which:

1.

Is open and unobstructed from the ground upward, except for permitted projections into yards; and

2.

Is accessible to and usable by all residents of the lot or premises;

3.

Has no dimension less than twenty (20) feet; and

4.

Is not used for private streets, driveways, parking or loading.

"Open space" shall include such terms as "usable open space," "recreational space" and "public open space."

"Open space, common" means open space substantially free of structures, but possibly containing improvements which are part of a general development plan and are appropriate for the recreation of residents of a planned residential development. Percentages of required common open space and proportion of level open space may be set by the district regulations or by the authorized agency. The common open space shall be land within the total development site used for recreational or environmental purposes by occupants of the development, or dedicated to the city for public park or inclusion within a park maintenance district.

"Common open space" shall not include private streets, driveways, private yards or patios, parking or loading spaces or utility easements where the ground surface cannot be used appropriately for active or passive recreation, nor other areas primarily designed for other operational functions.

"Open space, usable roof area" means that part of a roof which:

1.

Is usable by all residents of the building and is accessible to all residents by a passageway from the buildings;

2.

Is enclosed by a parapet or ground rails adequate for the safety of the occupants;

3.

Has no dimension less than twenty (20) feet; and

4.

Is developed for active or passive recreational use.

"Orphanage." See also "philanthropic institution." The same as "children's home."

"Outdoor advertising structure." See "signs."

"Outdoor court." See "court."

"Outdoor storage" means storage of goods and materials outside of any building or structure, but not including storage of a temporary or emergency nature.

"Oxidizing material" means any chemical element or compound which may yield oxygen or violently react when involved in a fire or when in contact with water or which may increase the intensity of a fire even though it may be relatively noncombustible.

17.06.170 - Definitions beginning with "P".

"Parcel" means a contiguous quantity of land in the possession of or owned by or recorded as the property of, the same claimant or person. See also "lot."

"Parcel map" means a map showing the division of land as described in the State Subdivision Map Act, (Section 11535, subdivisions (b) and (c)), and prepared in accordance with the provisions of the Subdivision ordinance of the city, and the Subdivision Map Act.

"Park maintenance district" means a district established pursuant to the provisions of the Park and Playground Act of 1909, as set forth in West's Annotated Government Code 38000.

"Parking building" means the same as "parking garage, public."

"Parking facility" means an area either open or enclosed within a structure or portion thereof, designed or used for the parking of motor vehicles.

"Parking facility, accessory" means a parking facility which is accessory to a structure or use on the same or other lot, and may include both required or permitted parking stalls.

"Parking garage, accessory" means the same as "parking garage, private."

"Parking garage, private" means an accessory structure or portion of a principal structure designed or used for the parking or temporary storage of motor vehicles of patrons, occupants, or employees of the structure or use served.

"Parking garage, public" means a structure or portion thereof designed or used for the parking of motor vehicles and some or all of whose parking stalls are nonaccessory. Commercial or public parking garages may include accessory off-street parking stalls limited to such stalls which are accessory to other structures or uses on the same lot.

"Parking lot, public" means an open parking facility which is not accessory to a structure or use on the same or another lot.

"Parking stall" means space within a parking facility exclusive of driveways, aisles, maneuvering or landscaped areas, ramps, columns, office and work areas, for the parking of one motor vehicle.

"Parkway." See "streets and highways."

"Particulate matter" means airborne material except water which exists in a finely divided form as a liquid or solid at standard conditions.

"Particulate velocity" means a characteristic of vibration that depends on both displacement and frequency. If not directly measured it can be computed by multiplying the frequency by the amplitude times the factor 6.28. The particulate velocity would be in inches per second, when the frequency is expressed in cycles per second and the amplitude in inches.

"Pedestrian way" means a right-of-way for pedestrians, free from vehicular traffic, and including access ramps, stairs, and mechanical lifts and routes through buildings which are available for public use.

"Pedestrian ways, plan of" means a plan of pedestrian ways which has been adopted by the city council.

"Performance standards." See specific definitions dispersed throughout this chapter.

"Pet shop" means any store or department of any store or any place of business where dogs, cats, monkeys, birds, reptiles, or any other animals are kept for sale, for hire, or sold.

"Philanthropic institution" means a nonprofit, charitable institution devoted to the housing, training or care of children, or of aged, indigent, handicapped or underprivileged persons, but not including the following:

1.

Office buildings, except as an accessory to and located on the same lot with an institutional activity, as listed above;

2.

Hospitals, clinics or sanitariums, correctional institutions;

3.

Institutions or homes for the insane or those of unsound mind;

4.

Lodging houses or dormitories providing temporary quarters for transient unemployed persons;

5.

Organizations devoted to collecting and salvaging new or used materials; or

6.

Organizations devoted principally to distributing food, clothing or supplies on a charitable basis.

"Plan." See "general plan," "specific plan," "pedestrian ways, plan of."

"Planned unit development" means the planning, construction or implementation and operation of any use or structure, or a combination of uses and structures, on a single parcel of land based on a comprehensive and complete design or plan treating the entire complex of land, structures and uses as a single project. See also specific sections dealing with planned unit developments.

"Planned street line." See "street line, planned."

"Polanco park" means mobile home parks developed under the provisions of the 1992 bill AB 3526, commonly known as the Polanco Bill. These MHPs are intended to serve as farmworker housing and may not contain more than twelve (12) units.

"Pool" means any structure used for swimming, bathing or wading or as a fish pond or similar use.

"Portable container" means a container for flammable or combustible liquids capable of being easily and readily borne or carried, not stationary or fixed and having a maximum capacity of five gallons.

"Pre-application review." See Chapter 17.77.

"Preferred center frequency" means the octave band designated by a single number which corresponds to the geometric center frequency. Nine octave bands cover the entire range of frequencies of interest in industrial noise and are described in the American National Standards Institute Standard No. S1.6-1967.

"Private club." See "club, private."

"Private road easement." See "streets and highways."

"Project" means an action undertaken to change the use or character of use of land or structures, said action requiring a permit or other action on the part of the city. Project includes, but is not limited to subdivision, lot split, building construction, planned unit development, rezoning of land, variance from this chapter, request for conditional use, and change of land use requiring a permit.

"Projection, architectural" means anything attached to and extended outside the outer face of the exterior wall of a structure and not intended for shelter or occupancy.

"Property line" means a line separating parcels of real property having separate legal descriptions, but not including a building line.

"Public utility." See "utilities."

"Public way" means any street, alley, pedestrian way, channel, viaduct, subway, tunnel, bridge, easement, right-of-way or other way of which a public agency has a right of use. See also "streets and highways."

"Public utility facilities (city-initiated)" means public utilities include, but are not limited to, reservoirs, utility substations, including electrical distribution and transmission substations.

17.06.180 - Definitions beginning with "Q".

"Quarry" means any place on a lot or parcel of land where dirt, soil, sand, gravel, rock, clay, decomposed granite, or other similar material is removed by excavation or otherwise. Quarry shall include mining operations for the removal of ores, precious stones, or other solid minerals, but shall not include:

1.

Excavation and removal of materials from a lot or parcel of land preparatory to construction of a building for which a building permit has been issued and remains in full force and effect, provided that such excavation is confined to that necessary for such building construction, but in no event shall more than five thousand (5,000) cubic yards of soil or other excavated materials be removed from the premises; or

2.

Excavation, on a lot, parcel of land or subdivision, necessary to grading, building construction or operation on the premises, where a building permit is not in full force and effect, provided that such grading is necessary to prepare a site for a lawful use permitted thereon, but in no event shall more than five hundred (500) cubic yards of soil or other excavated materials be removed from such premises.

17.06.190 - Definitions beginning with "R".

"Real estate tract sales office" means a sales office established and maintained in one model home as approved by the planning director, or in a single-family dwelling on a recorded lot previously designated as a model home site by the planning director and serving temporarily as an example of houses in the same subdivision, and subject to the provisions of this chapter.

"Rear lot line." See "lot line, rear."

"Rear yard." See "yard, rear."

"Recreational room" means a room, contained in either a main building or an accessory building, designed to be utilized primarily for games, the pursuit of hobbies, social gatherings and such activities. Such a room may contain such plumbing fixtures as are utilized in a bar or hobby activities. Such a room in a single-family or two-family dwelling or in an accessory building appurtenant to a single-family or two-family dwelling, may not include facilities for the cooking and preparation of food. However, in a multiple residential use or in an accessory building appurtenant thereto, a recreation room which is for the common use of all the dwelling units therein, may contain facilities for the cooking and preparation of food.

"Recreational vehicles" include the following:

1.

"Travel trailer" means a vehicular portable structure built on a chassis designed to be used as a temporary dwelling for travel, recreational and vacation uses permanently identified as a travel trailer by the manufacturer;

2.

"Camper" means a structure designed primarily to be mounted upon a motor vehicle and with sufficient facilities to render as suitable for use as a temporary dwelling for camping, travel, recreational and vacation purposes;

3.

"Motorized home" means a portable dwelling designed and constructed as an integral part of a self-propelled vehicle;

4.

"Full tent trailer" means a canvas folding structure mounted on wheels and designed for travel and vacation use;

5.

"Boats" and "boat trailers" includes boats, floats, and rafts plus the normal equipment to transport the same on a highway. See also "motor vehicles," "mobilehome."

"Repair garage." See "garage, repair."

"Resident" means the present or future user of and which are the subject of the final product of a considered to be the ultimate user of a project.

"Residential building" means a building or portion thereof designed or used for human habitation and including the following types with respect to permitted numbers of dwelling units and guest rooms:

"Residential district" means any zoning district whose designation begins with the letter "R".

"Rest home" means the same as "health facility, long-term."

"Retail sales, retail store" means the sale of goods, merchandise or commodities for consumption or use by the purchaser.

"Right-of-way." See "streets and highways."

"Roadway." See "streets and highways."

"Room, guest." See "guest room."

"Room, habitable" means an enclosing subdivision in a residential building commonly used for living purposes, but not including any lobby, hall, closet, storage space, water closet, bath, toilet, slop sink, general utility room, or service porches.

For the purposes of applying the automobile parking stall requirements of this chapter, any kitchen shall be considered a habitable room and if it is a part of a room designed for other than food preparation or eating purposes, such remaining portion shall also be considered a separate habitable room.

For the purposes of applying the lot area requirements of this chapter, a kitchen less than one hundred (100) feet in area shall not be considered a habitable room.

For the purpose of computing the minimum allowable floor area of the room, the minimum width of every habitable room except the kitchen shall be not less than seven feet at any point within that portion of the room included in any computation of minimum allowable floor area of the room.

"Room, light housekeeping" means Any guest room which is designed and used both as a bedroom and for the cooking and preparing of food.

For the purposes of applying the lot area and automobile parking space requirements of the various zones, each light housekeeping room shall be considered as a separate guest room. See also "guest room."

"Rooming house." See "boarding or rooming house."

17.06.200 - Definitions beginning with "S".

"Sanitarium" or "sanatorium" means the same as "hospital."

"School, elementary and high" means institutions of learning which offer instruction in the several branches of learning and study required to be taught in the public schools by the Education Code of the State of California. High schools include junior and senior.

"Screening" means solid walls, solid fences or dense living hedges, together with a wire fence, for the purpose of concealing from view the area behind such structure or hedges. Such screening shall be maintained in an attractive manner at all times. See also "fence" and "landscaping."

"Secondary highway." See "street and highways."

"Secondary housing unit" means a separate dwelling unit incidental to a single family home that provides a sleeping quarters or a separate residence for a family. It may include permanent improvements for living, sleeping, eating, cooking, and sanitation on the same site as the primary unit is situated.

"Seismograph" means an instrument which measures vibration characteristics simultaneously in three mutually perpendicular planes. The seismograph may measure amplitude and frequency, particulate velocity or acceleration.

"Senior citizen housing" means the same as "housing for the elderly."

"Servants quarters" means an accessory structure located on the same premises with the main building used solely as a dwelling of persons employed on the premises; such quarters having no kitchen facilities and not rented or otherwise used as a separate dwelling unit.

"Setback" means a minimum horizontal distance between the planned street line, or the lot line if there is no planned street line, and the building line, or a line parallel to the lot line if there is no building line. See also "yard" and "building line."

"Shopping center" means a group of commercial establishments planned and developed, owned or managed as a unit, with off-street parking and loading provided on the property, and related in its location, size and type of shops, to the trade area which the unit serves.

"Side yard." See "yard, side."

"Sidewalk" means that portion of a thoroughfare other than a roadway set apart by curbs, barriers, markings or other delineations for pedestrian travel.

"Sign" means any printed or written text (including letter work or numeral), pictorial representation (including illustration, decoration or figure), emblem (including device, symbol or trademark), commercial flag (including advertising banner or pennant), or any other object which:

1.

Is a structure or any part thereof; or is attached to, painted on, or in any other manner represented on a building, fence, wall, post or any other structure or surface; and

2.

Is used to identify, instruct, attract, guide or advertise.

"Sign, advertising decoration" means various sign materials used for temporary display and decoration including streamers, banner, pennant, pinwheels, commercial flags, bunting and the like.

"Sign, advertising statuary" means an imitation, representation or similitude of a person or thing which is sculptured, molded, modeled or cast in any solid or plastic substance, material or fabric which for advertising or identifying purposes is erected or attached to the surface of the ground.

"Sign, area" means the total surface area of the sign face including any decorative borders.

"Sign, area of cutout letters and displays" means the area measured within the periphery of the cutout letters of displays.

"Sign, directional" means a sign containing words or symbols indicating an entrance to, exit from, location of or distance to structures or sites.

"Sign, ground" means a sign, the lower part of the base of which is resting entirely or in part on the ground.

"Sign, identification." An on-site sign which carries only the name or address of the firm, the major enterprise or the principal product offered on the premises.

"Sign, nameplate" means a small on-site sign located at an entrance to a building and indicating the name and/or address of an occupant.

"Sign, off-site" means a sign delivering a message or advertisement other than the name, occupation or nature of the activities conducted on such premises or the products sold or manufactured thereon.

"Sign, on-site" means a sign indicating the name, occupation or nature of the activities conducted, services offered or the products sold or manufactured on a property.

"Sign, post" means a sign whose face is above ground level and affixed to poles or posts.

"Sign, poster panel" means an off-site sign comprising a series of small connected panels arranged in the form of a pylon or similar structure, and designed primarily for the application of advertising post displays for pedestrian viewing.

"Sign, project directory" means an on-site sign containing the names and locations, in list or map form, of the individual components making up a planned unit development, shopping center or similar project.

"Sign, project title" means an on-site sign which carries the overall name of a residential subdivision, shopping center, industrial park, medical complex, planned unit development, mobilehome park and similar projects.

"Sign, projecting" means an on-site sign other than a wall sign suspended from or supported by a building or structure and projecting out at any angle to the plane of the wall.

"Sign, real estate" means an on-site sign displayed for the purpose of offering real property for sale, lease or rent.

"Sign, roof" means an on-site sign erected upon or above roof or parapet of a building or structure.

"Sign, wall" means an on-site sign attached to, erected against, or painted onto a wall of a building with the exposed face of the sign in a plane parallel to said wall.

"Site, building" means the same as "lot."

"Solid fill" means any noncombustible material insoluble in water, such as soil, rock, sand, or gravel that can be used for grading land or filling depressions.

"Solid fill project" means any operation on a parcel of land where more than one thousand (1,000) cubic yards of solid fill materials are deposited for any purpose, including the grading or reclaiming of land.

"Sound" means rapid fluctuations of atmospheric pressure which are audible to persons. See also "noise," "impact noise."

"Sound level meter" means an instrument to measure the overall sound pressure level. It shall comply with the applicable specifications of the American National Standards Institute (ANSI S1.4-1961).

"Specific plan" means a definite statement adopted by ordinance of policies, standards and regulations, together with a map or description defining the location where such policies, standards, and regulations are applicable.

"Stable, private" means a detached accessory building for the keeping of horses owned by the occupants of the premises but not kept for remuneration, hire or sale. See also "accessory structure."

"Stable, public" means a stable other than a private stable.

"Stall." See "parking stall."

"Standard condition" or "standard cubic feet" means a volume of gas expressed at a temperature of seventy (70) degrees Fahrenheit and a pressure of fourteen and seven-tenths (14.7) pounds per square inch absolute.

"Steady state." See "vibration, steady state."

"Storage." See "outdoor storage."

"Storage, garage." See "garage, storage."

"Story" means that portion of a building included between the upper surface of any floor and the upper surface of the floor next above, except that the topmost story shall be that portion of a building included between the upper surface of the topmost floor and the ceiling or roof above. If the finished floor level directly above a basement, cellar or unused underfloor space is more than six feet above grade as defined herein for more than fifty (50) percent of the total perimeter, or is more than twelve (12) feet above grade as defined herein at any point, such basement, cellar, or unused underfloor space shall be considered as a story. Compare "basement" and "cellar."

"Story, first" means the lower-most story which is primarily above exterior grade on one or more sides, containing at least fifty (50) percent living accommodations or related nonresidential uses and from which there is direct egress to the exterior. Stories below grade used for storage, parking, mechanical equipment or other services are not considered basement stories. Related nonresidential uses include laundry space, recreation, or hobby room, commercial use and related corridor space.

"Street" and "highways." See also "alley," "public way."

1.

"Freeway" means a divided highway or through traffic with full control of access and with grade separations at intersections, and declared to be such in compliance with the State Streets and Highways Code.

2.

"Arterial, major" means any street, existing or proposed, designated as a major arterial on the "circulation element" of the general plan.

3.

"Arterial, minor" means any street, existing or proposed, designated as a minor arterial on the "circulation element" of the general plan.

4.

"Street" or "public street" means any public thoroughfare, other than an alley or walk. Where a subdivision has been recorded containing lots which abut only on an alley or walk, said alley or walk may be considered to be a street.

5.

"Parkway" means that portion of street or highway other than a roadway or sidewalk.

6.

"Right-of-way" means area of land reserved for public or private easements.

7.

"Roadway" means that portion of a right-of-way for a street, arterial or alley designed or used for accommodating the movement of vehicles.

8.

"Service road" or "frontage road" means a street lying adjacent and approximately parallel to and separated from a freeway or arterial and which affords access to abutting property.

9.

"Street, collector" means a street (including the principal access streets of a subdivision) which carries traffic from local streets either directly, or via other existing or proposed collector streets, to a major or minor arterial.

10.

"Street, local" means any street other than a collector street, major or minor arterial or freeway, providing access to abutting property and serving local as distinguished from through traffic.

11.

"Street, private" means a private road easement that the planning official determines to be adequate for access and which conforms to such dimensional and improvement standards adopted by the city council.

"Private road easement" means a parcel of land not dedicated as a public street, or other private street, and for which:

a.

A private easement for road purposes has been proposed or granted to the owners of property contiguous or adjacent thereto; and

b.

An instrument creating the easement has been duly recorded and filed with the county recorder.

"Street or alley, future" means any real property which the owner thereof has offered for dedication to the city for street or alley purposes, but which has been rejected by the city council, subject to the right of the council to rescind its action and accept by resolution at any later date and without further action by the owner, all or part of said property as public street or alley.

"Street line, planned" means the proposed boundary of a street or highway as shown on the "planned street line map" or as otherwise designated in the ordinance.

"Structural alteration" means any change other than incidental repairs which would prolong the life of the supporting members of a structure or building such as bearing walls or bearing partitions, columns, beams or girders. Compare "alteration."

"Structure" means anything constructed or erected which is supported directly or indirectly on the earth, but not including any vehicle which conforms to the California Vehicle Code. Structure includes any building or accessory building which can be used for the housing, shelter, or enclosure of persons, animals, chattels or property of any kind, plus fences, wall, billboards, platforms, towers, poster panels and signs.

"Structure, accessory." See "accessory structure."

"Subdivider" means any person, firm, corporation, partnership or association who causes land to be divided into a subdivision for himself, herself or others.

"Subdivision Map Act" means the Subdivision Map Act of the state of California, Chapter 2, Part 2, of Division 4 of the Business and Professions Code, commencing with Section 11500 thereof.

"Suite" means a group of habitable rooms designed as a unit, and occupied by only one family; but not including a kitchen or other facilities for the preparation of food, with entrances and exits which are common to all rooms comprising the suite. Compare "guest room" and "room, light housekeeping."

"Surveyor" means a licensed land surveyor authorized to practice in California.

"Swap meet, indoor" means collective sales or exchange of merchandise by individual vendors occupying separate sales spaces that are not divided by permanent walls. This classification includes both indoor and outdoor swap meets, conducted on either a permanent or recurring basis.

17.06.210 - Definitions beginning with "T".

"Telephone repeater station" means a building used for housing amplifying equipment along aerial or underground telephone cable routes. See also "utilities."

"Temporary use." See "use, temporary"

"Tentative map" means a map made for the purpose of showing the design of a proposed subdivision and the existing conditions in and around it and need not be based upon an accurate or detailed final survey of the property.

"Tentative map, revised" means a map involving a revised arrangement of the streets, alleys, easements or lots within property for which a tentative map has been previously approved, or a modification of the boundary of the property.

"Tourist camp" means any place, area or tract of land upon which are located two or more campers, trailer coaches, trailers, automobiles used for sleeping purposes or other camping outfits commonly referred to as tourist camp, trailer camp, and similar designations. Compare "mobilehome park."

"Townhouse." See "dwelling, townhouse."

"Toxic matter" means material which is capable of causing injury to living organisms by chemical means when present in relatively small amounts.

"Trailer." See "mobilehome and recreational vehicles."

"Trailer, full tent." See "recreational vehicles."

"Trailer park." See "mobilehome park."

"Trailer site." See "mobilehome site."

"Transient" means any person who exercised occupancy for a reason of concession, permit, right of access, license, or other agreement for a period of thirty (30) consecutive calendar days or less, counting portions of calendar days as full days. See "hotel."

"Transitional." See "lot, transitional."

"Travel trailer." See "recreational vehicles."

17.06.220 - Definitions beginning with "U".

"Under floor space" means a space between the ground and the floor directly above.

"Use" means the purpose for which land or structures are arranged, designed or intended, or for which either land or structures are, or may be, occupied or maintained. Use includes construction, establishment, maintenance, alteration, moving onto, enlargement, operation or occupancy.

"Use, accessory." See "accessory use."

"Use, conditional." See "conditional use."

"Use, principal" means the main or primary purpose for which a structure or lot is designed, arranged or intended, or for which either may be used, occupied or maintained under this chapter.

"Use, temporary" means a use of land or structures not intended to be of permanent duration.

"Utilities, public utility service center" means any buildings or premises used for the administration of public utility repair, maintenance and installation crews including parking for vehicles, not to exceed one and one-half tons rated capacity, but not including warehouses or storage yards.

"Utilities, public utility service yard" means any buildings or premises used for the office, warehouse, storage yard, or maintenance garage or a public utility including microwave repeater stations when incorporated as a part of the service yard use. 17.06.230 - Definitions beginning with "V".

"Variance." See Section 17.76.010.

"Vehicle." See also "motor vehicle," "mobilehome," "recreational vehicles" and automobile-related definitions.

"Vehicle, accessory" means any motor vehicle used in connection with the operation of any structure or use.

"Vehicle, commercial" means a vehicle, which when operated upon a highway is required to be registered as a commercial vehicle by the California Vehicle Code, and which is used or maintained for the transportation of persons for hire, compensation, or profit or designed, used or maintained primarily for the transportation of property.

"Vehicle, recreational." See "recreational vehicle."

"Vehicular access right" means the right of easement for access of owners or occupants of abutting lands to a public way other than as pedestrians.

"Vibration, earthborne" means a reciprocating movement transmitted through the earth, both in horizontal and vertical planes.

"Vibration, steady state." Vibration which is continuous as from a fan, compressor or motor.

17.06.240 - Definitions beginning with "W".

"Walk" means any right-of-way for pedestrians, including sidewalks and inner-block walks.

"Washroom" means a room or place where clothes, etc. are laundered.

"Water supply" means such water system supply and distribution facilities as are necessary to provide a reliable and adequate water supply for private use and public fire protection services.

"Way." See "alley," "pedestrian way," "public way" or "streets and highways."

"Wholesale store, sales" means a business establishment engaged in selling to retailers or jobbers, rather than consumers.

17.06.260 - Definitions beginning with "Y".

"Yard" means an open space other than a court, on a lot or parcel of land, unoccupied and unobstructed from the ground upward, except as otherwise provided in this chapter.

"Yard, front" means a yard extending across the full width of the lot, the depth of which is the minimum horizontal distance between the front lot line and a line parallel thereto on the lot. Where there is a building line farther back from the yard line, the building line, not the front lot line, shall be controlling. In addition, if there is a planned street line beyond the lot line, the planned street line shall be the point of measurement rather than the lot line.

"Yard, rear" means a yard extending across the full width of the lot, the depth of which is the minimum horizontal distance between the rear lot line and a line parallel thereto on the lot.

"Yard, side" means a yard more than six inches in width between a main building and the side lot line, extending from the front yard or front lot line where no front yard is required, to the rear yard. The width of the required side yard shall be measured horizontally from the nearest point of the side lot line toward the nearest part of the main building.

"Yard, special" means a special yard is any yard other than a yard adjacent to a public street, required to perform the same function as side or rear yards, but adjacent to a lot line so placed or oriented that neither the term side yard nor the term rear yard clearly applies.

"Youth camp" means any place with programs established for the primary purpose of providing an outdoor group living experience with social, spiritual, educational or recreational objectives for persons under twenty-one (21) years of age.

"Zoning map" means the designated official map or maps which show the location and boundaries of the districts established by this chapter and are referred to as the "zoning map" and incorporated as a part of this chapter.
