PENALTIES, REMEDIES AND MISCELLANEOUS VIOLATIONS AND PENALTIES11

Sec. 1. - Generally.

No building, structure, land or water shall be used or occupied, and no building, structure or part thereof shall be erected, constructed, reconstructed, located, moved or structurally altered except in conformity with the regulations specified in applicable regulations of this Appendix "A" ZONING of the COCOA CITY CODE.

No building or structure shall be erected or altered in any manner contrary to the provisions of these zoning regulations and especially shall not:

(a)

Exceed height or bulk.

(b)

Provide a greater number of dwelling units.

(c)

Provide less lot area per dwelling unit, exceed allowable intensity or to occupy a smaller lot.

(d)

Occupy a greater percentage of the building site.

(e)

Provide narrower or smaller yards, courts or other open spaces.

(f)

Decrease space required between buildings or structures or portions of buildings and structures.

(g)

Violate performance standards or design feature requirements to any building, structure, land or water pursuant to article XI, section 6(E), (F), (G), (H); article XI, section 13 (E), (F), (G), (H), (I), (J); article XI, section 14 (G); article XI, section 18 (E), (F), (G), (H); and article XIII, section 24, or other provisions of this Appendix "A", or policies and procedures adopted pursuant to this Code.

Multiple Use of Required Open Space. No part of a required yard or other required open space or required off-street parking or off-street loading space provided in connection with a building, structure or use shall be included as meeting the requirements for any other building, structure or use except where specific provisions are established in this Appendix "A".

Violations of this Appendix "A" may be enforced in the alternative through the city code enforcement board, by civil court action, or by criminal action, as the city may elect. The code enforcement board shall have jurisdiction to hear and decide alleged violations of this Appendix. Any person who violates any of the provisions of this chapter, or any rule, regulation, adopted policy or procedure, order or decision made under this Appendix, shall upon Code Enforcement Action be punished as provided in Chapter 162, Florida Statutes. The jurisdiction of the code enforcement board shall not be exclusive. Any alleged violation of any of the provisions of this Appendix may be pursued by appropriate remedy, whether by injunctive, declaratory or other civil relief or criminal sanction, in court at the option of the city. As additional or alternative relief, any person who violates any of the provisions of this chapter, or any rule, regulation, adopted policy or procedure, order of decision made under this appendix shall upon conviction be punished by a fine not to exceed five hundred dollars ($500.00) or by imprisonment for a period not to exceed sixty (60) days, or both.
