CHAPTER 12637.—(No. 832)

AN ACT to Authorize and Empower the City of Crystal River, Florida, to Drain Any Swamp, Body of Water, Low Overflow or Water-soaked Lands Lying Within or Without Said City, in Order to Better Health or Sanitary Conditions in Said City, and Prescribing the Methods of Accomplishing Such Drainage; and to Authorize Said City of Crystal River to Acquire, Own, Use, Control and Occupy Any Lands Within or Without Said City, or Easements or Rights of Way Over or Through the Same, for the Purpose of Draining Any Swamp, Body of Water, Low, Overflow of Water-soaked Lands Lying Within or Without Said City, in Order to Better Health or Sanitary Conditions in Said City; and to Authorize Said City to Issue Bonds to Pay Part or All of the Cost of Such Drainage, or Drainage Works or Improvements in Connection Therewith, or of Any Such Lands, Easements or Rights of Way, and Providing a Method of Issuing Such Bonds and Causing Same, When Issued, to Be a Lien on All Taxable Property in Said City and Authorizing Said City to Levy and Collect Taxes to Redeem and Pay Said Bonds; and Providing That Any Person or Corporation Who Shall Injure, Obstruct, Damage or Destroy Any Drainage Works or Improvements Constructed, Used or Maintained by Said City Under this Act, Shall Be Guilty of a Misdemeanor, and Prescribing Punishments Therefor, and Providing That Such Person or Corporation Shall Also Be Liable in Damages for Double the Cost of Removing or Repairing Such Injury, Obstruction, Damage or Destruction, and for the Amount of Injury to Property Caused Thereby.

Be It Enacted by the Legislature of the State of Florida:

Section 1. That the City of Crystal River, Florida, is hereby authorized and empowered to drain any swamp, body of water, low, overflow or water soaked lands, either within or without the corporate limits of said City, for the purpose of bettering health or sanitary conditions within said City, and in order to accomplish such drainage said City is hereby authorized and empowered to clean out, open, straighten, enlarge, change the course and flow, or alter any canal, ditch, drain, river, water course or stream, whether natural or artificial, and to concentrate, change or divide the flow of water therein; and to construct, operate and maintain main and lateral ditches, canals, levees, dikes, dams, sluices, revertments, reservoirs, drain pipes, holding basins, floodways, pumping stations and syphons, and may connect the same or any of them with any canal, stream, lake or watercourse; and to build, construct and maintain any other works deemed necessary in connection with such drainage improvements; and to build, rebuild and maintain roadways, fills and bridges over or upon such drainage improvements, across, through, under or over any public highway, railroad right-of-way, track, grade, fill or cut.

Section 2. The City of Crystal River, Florida, is hereby authorized and empowered to acquire by purchase, gift, grant or lease and to own, use, control and occupy any lands within or without the corporate limits of said City, or any easement or right of way over or through the same, which may be necessary or reasonably required for the purpose of draining any swamp, body of water, low, overflow or water soaked lands which lie within or without the corporate limits of said City and for the betterment of sanitary or health conditions within said City, and said City is further authorized to acquire said lands or rights of way, as aforesaid, by condemnation under the right of eminent domain, and in so doing it shall, as near as possible, follow the procedure which is now provided by law in Article 6, Division 2, Title 3 of the Revised General Statutes of Florida, and acts amendatory thereto; provided that after a suit has been instituted thereunder the City may pay into Court a sum to be fixed by the Judge thereof, and may thereupon take over, use and occupy the land or right of way to be condemned, and proceed at once with any work authorized by this Act before the value or damages have been assessed by a jury.

Section 3. That the City of Crystal River, Florida, is hereby authorized and empowered to issue general bonds of the City in an amount not to exceed Forty Thousand Dollars ($40,000) for the purpose of paying any part or all of the cost of any lands, easements or rights of way acquired for any drainage purpose authorized by this Act, and to pay any part or all of the cost of construction of any drainage or drainage works or improvements authorized by this Act and to levy and collect such taxes on the taxable property in said City, in the form and manner as other taxes are collected, as may be necessary to pay interest on and redeem said bonds. Such bonds shall be in such amounts, and shall bear such rates of interest and shall be payable at such times as may be prescribed by the City Council; and such bonds shall be a lien on the taxable property in said City.

Section 4. Any person or corporation who shall wilfully, wantonly or negligently obstruct the flow of water in, or injure, damage or destroy any ditch, drain, canal, water course, dam or any other drainage works or improvements which shall be constructed, used or maintained by the City of Crystal River, Florida, under this Act, shall be deemed guilty of a misdemeanor, and upon conviction shall be filed in a sum not exceeding five hundred dollars, or confined in the County Jail or at hard labor for a period not exceeding six months, and in addition thereto shall also be liable in damages to the City of Crystal River, Florida, or to any person injured for double the cost of removing such obstruction or repairing such injury or destruction, and for the full amount of injury to any land, crops or other property caused thereby, which said damages may be recovered in an action at law.

Section 5. Any provisions of this Act which for any reason may be declared invalid may be eliminated from this Act, and the remaining portion or portions thereof shall be and remain in full force and valid as if such invalid provision had not been incorporated therein.

Section 6. All laws or parts of laws in conflict herewith are hereby repealed.

Section 7. This Act shall become a law immediately upon its passage and approval by the Governor or upon its becoming a law without such approval.

HOUSE BILL NO. 783

AN ACT to declare, designate and establish as a Public Park certain property owned by the City of Crystal River, Citrus County, and providing an effective date.

Be It Enacted by the Legislature of the State of Florida:

Section 1. The following described property, owned by the City of Crystal River and located within the corporate limits of said city in Citrus County, is declared, designated and established as a public park, to-wit:

Lots 8 to 12 inclusive, lots 34 to 39 inclusive, lots 44 to 49 inclusive, lots 54, 58, 59, 60 and that part of lot 53 east of a line running north from the northeast corner of lot 55, all being in Sylvan Glen Addition to the City of Crystal River, Florida, and in section 21, township 18 S., and range 17 E.

Section 2. This act shall take effect immediately upon its becoming a law.

Became a law without the Governor's approval.

Section 1.01. - Creation and Powers.

The City of Crystal River is created and shall have all governmental, corporate and proprietary powers to enable it to conduct municipal government, perform municipal functions and render municipal services and may exercise any power for municipal purposes except as otherwise provided by law.

Section 1.02. - Term of Existence and Property Rights and Seal.

The City of Crystal River shall have perpetual succession, may sue and be sued, have the right of eminent domain; purchase, lease, receive and hold property, real and personal, within said City, and may sell, lease or otherwise dispose of the same for the benefit of the City, and may purchase, lease, acquire, receive and hold property beyond the limits of the said City to be used for cemeteries, for the disposal of sewerage and for the erection of waterworks, electric light or other power plants, for public parks and for other public purposes; and may sell, lease or otherwise dispose of such property for the benefit of said City to the same extent as a natural person may. The said City shall have the use of a common seal.

Section 1.03. - Public Improvements and Special Districts.

(a)

Public Improvements. The City Council shall have the power to open, construct, improve and repair streets, avenues, alleys, sidewalks and other public ways and thoroughfares. The establishment and maintenance of parkways, curbing, storm and sanitary sewers and the construction and maintenance of water mains, gas mains and other sewers or drains and may in the payment of such improvements, pay for same by direct taxation or by special assessment against the property benefitted by such improvements. In the event that any such improvements be made and it be intended to assess the cost or any part thereof against the benefitted property, then such assessments, and bonding if necessary, shall be handled consistent with all applicable State of Florida laws as amended.

It is provided that the section aforesaid shall not affect in any manner or apply to any improvements or assessments heretofore made or assessed by the City of Crystal River, but all of such assessments and the liens thereof shall be enforced in the manner as provided in and by the law under which said improvements were made and such assessments were levied or other laws applicable thereto.

In addition to the above, to better enable the City of Crystal River to provide public services to accommodate the city's growth and development and in order that the costs of these services be more fairly borne by those developing or improving property which requires services, the City Council is authorized to impose user charges and/or impact fees to be reasonably commensurate with the burden currently imposed or reasonably anticipated to be imposed on community services.

(b)

Special Districts. The City Council may, by ordinance, create special municipal service districts for the purpose of accomplishing municipal service and improvements and shall have the authority within said districts to make special assessments to pay for the furnishing of said municipal services or improvements, or any within the authority of the laws of the State of Florida levy ad valorem taxes to pay for said municipal services or improvements.

Section 1.04. - Construction.

The powers of the City shall be construed liberally, limited only by the Florida State Constitution, general laws and specific limitations contained herein. Special acts pertaining to the jurisdiction and exercise of powers by this City shall be considered amendments to this Charter and, pursuant to the provisions adopted for incorporation of other Charter amendments, shall be incorporated as official amendments to the Charter.

Section 1.05. - Public Emergencies.

(a)

To meet a public emergency affecting life, health, property or the public peace, the council may adopt one or more emergency ordinances, but such ordinances may not levy taxes, grant, renew or extend a franchise, regulate the rate charged by any public utility for its services, or authorize the borrowing of money. An emergency ordinance shall be introduced in the form and manner prescribed for ordinances generally, except that it shall be plainly designated as an emergency ordinance and shall contain, after the enacting clause, a declaration stating that an emergency exists and describing it in clear and specific terms. An emergency ordinance may be adopted with or without amendment or rejected at the meeting at which it is introduced, but the affirmative vote of at least four (4) members shall be required for adoption. After its adoption, the ordinance shall be posted as prescribed for other adopted ordinances. Every emergency ordinance shall automatically stand repealed as of the sixty-first day following the date on which it was adopted; but this shall not prevent reenactment of the ordinance in the manner specified in this section if the emergency still exists. An emergency ordinance may also be repealed by adoption of a repealing ordinance in the same manner specified in this section for adoption of emergency ordinances.

(b)

The City Manager will have the authority to act upon localized and temporary public emergencies. The Mayor and City Council will be advised immediately.

Section 2.01. - Description of Corporate Limits.

The corporate limits of the City shall be as described in Appendix A to this Charter and shall be modified from time to time in accordance with law.

Section 3.01. - Corporate Authority in Mayor and Council and Other Officers.

The corporate authority of said City shall be vested in the Mayor and City Council and in such other officers as may be provided for pursuant to this Charter. The Mayor and City Council shall have authority to create and establish such other offices of the said City of Crystal River as may be necessary, and to consolidate such offices so created by them, and to abolish the same upon the expiration of the term of the office so created.

Section 3.02. - City Council.

There shall be a City Council composed of five (5) Councilpersons elected by the electors of the City. The City Council shall constitute the governing body with powers as hereinafter provided to pass ordinances, adopt resolutions, appoint the officers and exercise the powers as hereinafter provided. It is responsible to the electorate for the proper conduct of all municipal operations. It shall appoint and give direction to a qualified, professional chief executive officer who shall be known as the City Manager. As the legislative body of the City, the Council shall review, amend if necessary and approve the budget and shall appropriate all monies of the City.

The Council, by ordinance, shall define and set limits on the amount of any purchase or contract which shall not require Council approval. No commitment or purchase above such limits can be made unless the Council makes an appropriation and approves the expenditure.

Section 3.03. - Election and Terms.

The regular election of councilpersons and Mayor shall be held concurrent with the general national and state election dates pursuant to Fla. Stat. §100.031, and in the manner provided in Section 3.04 of this Charter. The term of office of all councilpersons and the mayor shall run from the first Monday in December following and commence four years hence until the first Monday in December at 7 p.m., four years following their election.

Section 3.04. - Elections.

Effective December 1, 2012 Council seats shall be numbered "1", "2", "3", "4" and Mayor. The term of the office of a councilperson and the Mayor shall be per Sections 3.03 and 4.01 of this Charter.

In one election, the qualified electors shall elect three (3) Councilpersons (Seats Nos. 1, 3, and 5) and in the following election, the qualified electors shall elect one (1) Councilperson (Seat No. 2) and Mayor. Future elections shall be held in the same sequence. The candidate receiving the highest number of votes for the specific seat to be filled or for Mayor shall be declared elected. Elected Councilpersons and the Mayor shall be sworn in and assume their offices on the date their term commences in accordance with Section 3.03 of this Charter.

The Council shall prescribe by ordinance the method and manner of conducting all municipal elections in accordance with state statutes.

Section 3.05. - Qualifications of Elected Officers; Vacancies and Special Elections.

No person shall be eligible for election to public office who shall not at the time of their election be United States citizen, be a minimum of twenty-one (21) years old, be a qualified elector of the City and have resided within the corporate limits of said City for a period of six (6) months prior to election, and in case any officer shall remove their residence beyond the limits of the said City, their office shall thereupon immediately become vacant. In case any vacancy shall occur in any city office, such vacancy shall be filled by a majority vote of all members of the City Council, and the person so appointed by the City Council shall hold office until the next regular election of officers and until his/her successors are elected and qualified; provided that if a regular election of officers of the said City be not held within ninety (90) days after such vacancy in any office shall occur as aforesaid, a special election shall be held to fill such vacancy to be called by the City Council.

Section 3.06. - Mayor and Vice Mayor.

The Mayor shall preside at meetings of the Council, and he/she shall have the responsibilities to enforce such rules that may be adopted by the City Council. The Council shall select from among themselves a Vice Mayor who will have the duty of presiding at Council meetings in the absence of the Mayor.

The Vice Mayor shall be elected at the first meeting of the newly elected council after the regular city election; and, in non-election years, at the first regular Council meeting in November.

Section 3.07. - Salary and Expenses.

The salary of the members of the City Council and Mayor shall be established by ordinance of the City Council.

Section 3.08. - Limitations.

(a)

Appointments and Removals. Except as herein provided, no Council members shall dictate the appointment or removal of any City administrative officers or employees whom the manager or any of his/her subordinates are empowered to appoint in accordance with this Charter. Appointment and discharge of department heads shall be directed by the City Manager.

(b)

Holding Other Office. No member of the Council or the Mayor, during the term for which he/she has been elected or appointed or for one (1) year thereafter, shall be eligible to hold any office, position or employment in the City which carries compensation other than on the Council.

(c)

Interference with administration. Except for the purpose of official inquiries and investigations, the Mayor, the Council or its members shall deal with City Officers and employees who are subject to the direction and supervision of the Manager solely through the Manager, and neither the Council nor its members shall give orders to any such Officer or emmployee, either publicly or privately.

Section 3.09. - City Council, Rules, Quorum, Committees and Meetings.

The City Council shall, by ordinance, determine and define its rules of procedure, therein prescribing sanctions for non-attendance or disorderly conduct. Three (3) of its members concurring, it may expel a member for misfeasance, malfeasance or nonfeasance. The majority of the members of the City Council shall be required to form a quorum for the transaction of business, but a smaller number may adjourn from day to day. The Mayor or City Manager shall have the power to administer necessary oaths and may call such special meetings of the City Council as maybe necessary for the conduct of official business provided, however, that the forty-eight (48) hours' notice shall be given to each Council member and the public. The City Council shall hold regular meetings at such times as it may determine but not less than one regular meeting per month.

Section 3.10. - Ordinances.

Ordinances and resolutions shall be adopted in accordance with the requirements of the state law.

Section 3.11. - Amendments after Adoption.

(a)

Supplemental Appropriations. If during the fiscal year the Manager certifies that there are available for appropriation revenues in excess of those estimated in the budget, the Council by resolution may make supplemental appropriations for the year up to the amount of such excess. Such resolution must be introduced and action taken at a regular meeting of the Council.

(b)

Emergency Appropriations. To meet a public emergency affecting life, health, property or the public peace, the Council may make emergency appropriations. Such appropriations may be made by resolution in accordance with the provisions of Section 1.05 of this Charter. To the extent that there are no available unappropriated revenues to meet such appropriations, the Council may by such resolution authorize the issuance of emergency notes, which may be renewed from time to time, but the emergency notes and renewals of any fiscal year shall be paid not later than the last day of the fiscal year next succeeding that in which the emergency appropriation was made.

(c)

Reduction of Appropriations. If at any time during the fiscal year it appears probable to the Manager that the revenues available will be insufficient to meet the amount appropriated, he/she shall report to the Council without delay, indicating the estimated amount of the deficit, any remedial action taken by him/her and his/her recommendations as to any other steps to be taken. The Council shall then take such further action as it deems necessary to prevent or minimize any deficit, and for that purpose it may by resolution reduce one or more appropriations.

(d)

Transfer of Appropriations. At any time during the fiscal year, the Manager may transfer part or all of any unencumbered appropriation balance among programs within a department, office or agency; and upon written request by the Manager, the Council may by resolution transfer part or all of any unencumbered appropriation balance from one department, office or agency to another.

(e)

Limitations; Effective Date. No appropriation for debt service may be reduced or transferred, and no appropriation may be reduced below any amount required by law to be appropriated or by more than the amount of the unencumbered balance thereof. The supplemental and emergency appropriations and reductions or transfer of appropriations authorized by this section may be made effective immediately upon adoption.

Section 4.01. - Mayor's Term of Office.

The Mayor's term of office shall be for a term of four (4) years. The Mayor shall be elected as provided in Sections 3.03, 3.04 and 7.05 of this Charter.

Section 4.02. - Mayor's Jurisdiction and Duties.

The Mayor shall be recognized as head of the City government for all ceremonial purposes, by the Governor for purposes of military law, and for service of process. The Mayor is authorized to execute contracts, deeds and other documents approved by City Council.

Section 4.03. - Power and Duties of the Mayor.

The Mayor shall be a voting member of the City Council and shall attend and preside at meetings of the Council, represent the city in intergovernmental relationships, present an annual state of the city message during the month of January, and perform other duties specified by the Council. The Mayor shall have no administrative duties, except as specified in this Charter.

Section 4.07. - Mayor's Absence or Inability to Act.

In the event of the absence of the Mayor from the City the Vice Mayor shall assume and perform the duties of Mayor. In the event of the Mayor's death or inability from sickness or other cause to discharge the duties of office, the Vice Mayor shall assume and perform the duties of Mayor until a new Mayor is elected.

Section 5.01. - City Manager.

There shall be a City Manager who shall be the chief administrative officer of the City. He/she shall be responsible to the Council for the administration of all City affairs placed in his/her charge by the Council or under this Charter, and he/she shall serve at its pleasure.

Section 5.02. - Acting City Manager.

By letter filed with the Mayor and Council, the Manager shall designate, subject to confirmation of the Council, a qualified City administration officer to exercise the powers and perform the duties of Manager during his/her temporary absence or disability. During such absence or disability, the Council may revoke such designation at any time and appoint another officer of the City to serve until the Manager shall return or his/her disability shall cease.

Section 5.03. - Powers and Duties of the City Manager.

The City Manager shall:

(a)

See that all laws, provisions of the Charter and acts of the Council, subject to his/her discretion and supervision, are faithfully executed.

(b)

Direct and supervise the administration of all departments and offices of the City, except as otherwise provided by this Charter or by law.

(c)

Appoint and, when he/she deems it necessary for the good of the City, suspend or remove all City employees, except as otherwise provided by law, this Charter, or personnel rules adopted pursuant to this Charter.

(d)

Make changes in any and all department organizations, including combinations, deletions, creation of departments, units or divisions, and transfer responsibilities between departments, units, or divisions.

(e)

Attend all Council meetings and have the right to take part in discussion but may not vote.

(f)

Prepare, submit to the Council and, after approval of the Council, administer the budget and capital program as provided by this Charter or by law. The obligation or disbursement of any fund shall be specifically prohibited unless there is or will be a sufficient unexpended and unencumbered balance in the proper appropriation subject to Article III, Section 3.02 and any ordinance implemented thereunder.

(g)

Submit to the Council and make available to the public a complete report on the finances and administrative activities of the City as of the end of each fiscal year, and provide a detailed operating statement as to each enterprise fund with the annual budget message.

The City Manager shall address audit discrepancies and report progress to the City Council within sixty (60) days after the audit report.

(h)

Keep the Council currently advised in matters affecting policy and make such other reports as the Council may require concerning the operations of City departments and offices subject to his/her direction and supervision.

(i)

Keep the Council fully advised as to the financial condition and future needs of the City and make such recommendations to the Council concerning the affairs of the City as he/she deems desirable.

(j)

In the absence, inability or reluctance of the Mayor to do so, sign contracts on behalf of the City pursuant to the provisions of the budget and appropriation ordinances, on approval of ⅘ vote of the Council.

(k)

Subject to Council approval, develop and keep current an administrative code which shall set forth the organizational and operational procedures of the government, and develop and keep current a comprehensive plan in accordance with state law.

(l)

Perform such other duties as are specified in this Charter or may be required by the Council.

(m)

The power and authority of the City Manager is expressly limited to that described herein, and he/she shall enter into no agreements, negotiations or other arrangements with any groups, organizations, governmental bodies or individuals requiring policy-making decisions by the Council without the prior knowledge and approval of that body.

(n)

The City Manager shall have the autority to hire and fire administrative department heads for just cause without prior authorization of the City Council.

Section 5.04. - Supervision of Departments.

Except as otherwise provided in this Charter or by general law, the City Manager will have authority over and will be responsible for the supervision and direction of all departments and offices of the City. All departments and offices under the direction and supervision of the City Manager shall be administered by an officer or department manager appointed by and subject to the direction and supervision of the City Manager. The City Manager may serve as the head of one or more such departments or offices or may appoint one person as the head of two (2) or more of them.

Section 5.05. - City Clerk.

The City Clerk shall perform all those functions, duties and responsibilities as follows:

(a)

Be custodian of all records, documents and papers of the City.

(b)

Attest all contracts and agreements to which the City is a party.

(c)

Be custodian of the Seal of the City and is authorized to affix same to such instruments of writing as necessary.

(d)

Supervise the City elections.

Section 6.01. - Charter Amendment.

This Charter may be amended as provided by general law.

Section 6.02. - Charter Review.

At least once every ten (10) years, the council shall appoint a Committee to review the City Charter and to make recommendations to the City Council for changes to the provisions of the City Charter.

The Council shall advertise within the City of the creation of the Charter Review Committee and solicit residents to serve thereon.

The Council will appoint five (5) members to this committee. Each of the five (5) members of City Council shall appoint one (1) member to the committee from any registered elector of the City of Crystal River, with the consent of at least 3 other members of the City Council. These five (5) appointments shall constitute the Charter Review Committee.

The committee shall be formed on or before March 1 st and shall make it recommendations to council in sixty (60) days of its appointment.

Section 6.03. - Ordinance Review.

At least once every ten (10) years, the City Council shall direct that a review of City ordinances be conducted to determine their legality or obsolescence.

Section 6.04. - Standards of Ethics.

All elected officials and employees of the City shall be subject to the standards and conduct for public officers and employees set by general law.

Section 6.05. - Advisory Committees.

The Council may appoint such boards, commissions, and advisory committees as may be necessary. Any boards, commissions, or committees appointed pursuant to this section shall be established by appropriate resolution setting forth the purpose of the boards, commissions, or committees, the number of regular and/or alternate members, qualifications of members, diversification of background, term of office and procedure for appointment. No member of said boards, commissions and advisory committees shall serve more than two (2) consecutive terms unless agreed by ⅘ vote of the council.

Section 6.06. - Future Direction.

(a)

It shall be incumbent upon the City Council to maintain, and expand if necessary, the ordinances and zoning codes having to do with building restrictions which control structure elevations and density of population so as to maintain both the aesthetics of the community and the control of traffic from area to area.

(b)

The City Council shall pursue a positive approach to the inclusion of lands peripheral to the present City boundaries into the City boundaries, which shall include waterfront property, to enhance the opportunity for the orderly growth of the City itself. This positive approach should also include efforts to promote the growth of areas of the City which now include undeveloped taxable properties already within the City boundaries.

Sec. 6.015. - Correction of Scribner's Errors.

A.

Definitions: Scribner's Error: An error resulting from a minor mistake or inadvertence, esp. in writing or copying something on the record, and not from legislative reasoning or determination. Among the examples of clerical errors are omitting an appendix from a document; typing an incorrect number; and mistranscribing a word.

B.

The City Council has the authority, to correct Scribner's Errors in the Charter via a non emergency ordinance.

Section 7.01. - Ordinances and Acts Preserved.

All ordinances and legislative acts in effect upon the adoption of this Charter, to the extent not inconsistent with it, shall remain in force until repealed or changed as provided herein.

Section 7.02. - Rights of Officers and Employees.

Nothing in this Charter, except as otherwise specifically provided, shall affect or impair the rights or privileges of persons who are City officers or employees at the time of adoption. Elected officers shall continue to hold their offices and discharge the duties thereof until their successors are elected.

Section 7.03. - Pending Matters.

All rights, claims, actions, orders, contracts and legal or administrative proceedings involving the City shall continue except as modified pursuant to the provisions of this Charter.
