Sec. 7-1. - General.

The regular election of councilpersons shall be held concurrent with the general national and state election date per F.S. § 100.031 and in the manner provided in section 3.03 et seq. of the City Charter.

Editor's note— At the election held on December 8, 1998, the voters approved a charter amendment to change the city election date to coincide with the general election date, being the first Tuesday after the first Monday in November, such change to become effective in the year 2000 (see Char. § 3.03); hence, § 7-1 has been changed to conform with the charter amendment. The user's attention is also directed to § 2-41.

Sec. 7-2. - Special.

(a)

Special elections may be held under the call of the mayor at any time when directed by the city council.

(b)

The manner of holding such elections and the notices thereof, shall be the same as provided for general elections held in November of each year.

(c)

No special election shall be called to fill any vacancy unless ninety (90) days shall intervene between such special election and the next general election.

Sec. 7-9. - Qualification of elected officers.

Every person elected at any election shall qualify, take the oath of office and assume their respective duties on election night immediately following tabulation of the votes.

Sec. 7-36. - Who may become a candidate.

(a)

Any qualified elector of the city may become a candidate for the office of mayor or councilman.

(b)

Each candidate for office of city council of Crystal River at the time of qualifying shall affirm and state that they have been a resident residing in corporate limits of the City of Crystal River for six (6) months prior to the time of election.

Sec. 7-37. - Qualifying period; filing requirements.

(a)

A qualified elector who seeks candidacy for any office in the city shall:

(1)

File a candidate's written acceptance in the form provided by the city clerk;

(2)

Complete a candidate's oath, which complies with and is in the form established by Section 99.021 (2002), Florida Statutes;

(3)

Designate the office or city council seat for which the candidate seeks to qualify; and

(4)

Pay the qualifying fee, or submit the required number of candidate petition cards, as established by Florida law.

(b)

The requirements of subsection (a) shall be complied with no sooner than 12:00 p.m. (noon) on the twenty-second day prior to the date of the first primary election and no later than 12:00 p.m. (noon) on the eighteenth day prior to the date of the first primary election. Provided, however, that if the first day of qualifying falls on a Saturday, Sunday, or holiday wherein the office of the city clerk is closed, then the first day to qualify shall begin on the next immediate working day, and shall continue for the next five (5) working days.

(c)

In the event a special election is needed to fill a vacated council member seat, the qualifying period for such special election shall be established by resolution of the city council to apply solely for that special election.
