CHAPTER 17

205 AGRICULTURE AND ANIMALS

§ 17.205.010 Purpose.

The purpose of this chapter is to list regulations relating to the conduct of agricultural uses and the keeping of animals under simplified headings.

§ 17.205.020 Agricultural land uses permitted.

Commercial horticulture may be conducted in the O-S, RS-40, and RS-20 zones subject to the provisions of this chapter. No other commercial agricultural activities are permitted in any zone. Non-commercial agriculture such as private orchards, gardens, and greenhouses shall be permitted ancillary to any permitted residential use. Community gardens, as defined in Chapter 17.105 of this title, are permitted in all residential and commercial zones, subject to the requirements of this chapter.
Agricultural products may be sold at roadside stands in the O-S, RS-40, and RS-20 zones with approval of an administrative zoning permit and provided that the product is grown or produced on the same property.

§ 17.205.030 Ordinary household pets.

The keeping of ordinary household pets shall be permitted at a residence, subject to the following regulations:
A. 
Not more than four ordinary household pets (dogs or cats) are permitted for each dwelling, together with offspring less than four months of age.
B. 
A fifth (5th) ordinary household pet may be authorized for an individual dwelling unit subject to the granting of an administrative zoning permit.

§ 17.205.035 Beekeeping.

The keeping of bees shall be permitted, subject to the following regulations:
A. 
Beehives shall be well maintained at all times.
B. 
Only docile bee species may be permitted.
C. 
Registration with the County of San Diego Department of Agriculture, Weights and Measures is required prior to beekeeping activities.
D. 
Beehives shall not be visible from the public right-of-way.
E. 
Beehives shall not be located in the exterior or front yards.
F. 
Up to four beehives may be permitted per property.
G. 
A beehive shall be no larger than 15 cubic feet in volume.
H. 
The beehive shall not be within the required setbacks of the underlying zone.

§ 17.205.040 Pot-bellied pigs.

The keeping of pet pot-bellied pigs shall be permitted, subject to the following regulations:
A. 
A maximum of two pot-bellied pigs are permitted on individual lots in the O-S, RS-40 and RS-20 zones.
B. 
A single pot-bellied pig may be kept on an individual lot in the RS-14, RS-9, RS-6, and RM-6000 zones, subject to the granting of an administrative zoning permit. The minor conditional use permit may also authorize one additional pot-bellied pig for properties in the RS-14, RS-9, RS-6, and RM-6000 zones with at least 20,000 square feet of lot area.

§ 17.205.050 Domesticated animals other than horses.

Domesticated animals other than horses may be kept as follows:
A. 
A maximum of one domesticated animal, not to exceed 125 pounds at maturity, shall be permitted in the O-S, RS-40 and RS-20 zones.
B. 
A maximum of two domesticated animals, not to exceed 125 pounds at maturity, and offspring less than six months of age, shall be permitted in the O-S, RS-40 and RS-20 zones, subject to the granting of an administrative zoning permit.
C. 
A maximum of one domesticated animal, not to exceed 125 pounds at maturity, shall be permitted in the RS-14, RS-9, RS-6, and RM-6000 zones, subject to the granting of an administrative zoning permit.

§ 17.205.060 Rabbits, geese, and ducks.

The keeping of rabbits, geese, and ducks for private use is permitted in the O-S, RS-40 and RS-20 zones, not to exceed six adult animals for each main dwelling, together with offspring until maturity.

§ 17.205.065 Chickens.

The keeping of chickens for private use is permitted in all single-family residential zones and also in the RM-6000 zone, subject to the following restrictions and requirements:
A. 
Chickens are only permitted accessory to a permitted, detached, single-family residential land use. This provision shall include Planned Residential Developments, and Planned Unit Developments when all of the other requirements of this section are satisfied.
B. 
Roosters are prohibited.
C. 
Chickens must be kept in a fully enclosed chicken run located in an unpaved area of the rear yard, which provides an outdoor area of at least ten square feet per chicken. A covered coop is required, which shall be attached to, or located inside of the chicken run, and which shall provide at least four square feet per bird, including a nest for each of the birds to roost. The coop must protect the animals from predation as well as exposure to sun, wind, and rain. Chicken runs shall be constructed of well-ventilated and durable wire mesh such as chicken wire or hardware wire. Runs and coops shall not exceed a height of eight feet and an area of 150 square feet.
D. 
Notwithstanding Subsection C, chickens may be permitted to roam free outside of the required chicken run and coop during daylight hours as long as they are confined to a completely fenced and unpaved rear yard. The enclosing fence must be at least six feet high. Chickens must be returned to the chicken run/chicken coop at sundown.
E. 
Chicken runs and coops must be located behind the main house on the lot and at least three feet from side and rear property lines. No chicken runs or coops are permitted in any exterior yard.
F. 
Chicken feed shall be kept in durable rodent-proof containers with tightly fitting covers.
G. 
All chicken runs and coops shall be maintained in a clean, sanitary condition, free from offensive odors at all times. Evidence of unsanitary conditions includes, but is not limited to: numerous flies or fly larvae in the vicinity of the chickens; accumulations of chicken litter, refuse, or manure; offensive odors; and rat droppings.
H. 
All chicken litter and manure and any material conducive to the breeding of flies, or which would create any offensive odor, that is removed from the chicken run or coop, shall be placed in sealed compost bins, air-tight containers, or air-tight bags until entirely removed from the premises or turned under the soil surface as fertilizer.
I. 
All dead chickens shall be removed from the property or buried within twenty-four hours of death at a depth of at least three feet underground. Pending disposal or burial, the chicken(s) shall be stored in fly-proof, air-tight containers or bags. The illegal disposal of dead chickens constitutes a public nuisance pursuant to the provisions of Chapter 1.16 of the El Cajon Municipal Code.
J. 
The number of chickens at any one site shall not exceed one bird per each 100 square feet of unpaved rear yard area, up to a maximum of 10 chickens.

§ 17.205.070 Horses.

Horses may be kept accessory to a permitted residential use as follows:
A. 
Horses are prohibited on lots with less than 20,000 square feet of net lot area, except horses may be kept on sub-lots with at least 10,000 square feet of area in the PRD-Low-Low zone.
B. 
Horses are permitted in the O-S, RS-40, RS-20, and PRD-Low-Low zones, on lots with at least 20,000 square feet of net lot area, not to exceed one animal over one year of age for each 10,000 square feet of net lot area, and offspring less than one year of age.
C. 
Horses may be kept in the RS-14, and RS-9 zones, on lots with at least 20,000 square feet of net lot area, subject to the granting of an administrative zoning permit, not to exceed one animal over one year of age for each 10,000 square feet of net lot area, and offspring less than one year of age.
D. 
Horses shall be kept within a fenced enclosure. Such a fenced enclosure may include stables, subject to the distance requirements listed in this chapter and the regulations for accessory buildings within residential zones. Within the PRD-Low-Low zone, horses shall be kept within a designated stable that is at least 50 feet from any structure used for assembly, the conduct of business, or human habitation.

§ 17.205.080 Distance requirements.

The keeping of animals, other than ordinary household pets, chickens, and pot-bellied pigs, are subject to the following minimum distance requirements:
A. 
Animals other than ordinary household pets and chickens may not be kept within 50 feet of any school, church, hospital, place of business, dwelling, mobile home, or building constructed or used for human habitation, with the exception that this required separation may be reduced to 20 feet in the case of a dwelling on the same lot occupied by the owner of the or animals.
B. 
Animals other than ordinary household pets and chickens may not be kept within 25 feet of any common property line shared with an adjacent lot, when the main dwelling or building has not been constructed on such adjacent lot.

§ 17.205.090 Animal related nuisances.

Animals shall be kept in a manner that prevents offensive odors, flies, dust, noise and other nuisances from affecting surrounding properties.

§ 17.205.100 Prohibited animals.

The following types of animals are prohibited:
A. 
Any animal prohibited by the California Department of Fish and Game.
B. 
Cattle.
C. 
Ferrets and other members of the weasel family.
D. 
Poisonous reptiles.
E. 
Roosters.
F. 
Swine (other than pot-bellied pigs kept as pets).
G. 
Wild animals.

§ 17.205.105 Community gardens.

Community gardens, as defined in Chapter 17.105, are permitted in all residential and commercial zones subject to the following standards:
A. 
Community gardens are exempt from the requirement for a Landscape Documentation Package described in Chapter 17.195. However, community gardens shall employ the applicable requirements of Section 17.195.200 (Preventing Water Waste). Additionally, all hoses at community gardens shall include trigger nozzles.
B. 
Structures used accessory to community gardens shall be considered accessory structures for the purpose of applying setback requirements, except that no such structures may be located within 20 feet of the public right-of-way.
C. 
Community gardens shall establish and maintain trash collection service from the city's solid waste contractor. When not out for collection, the trash and recycling bins may be located in a permitted accessory structure or may be stored in a neat and orderly manner at a location at least 20 feet from the front property line.
D. 
Compost at community gardens shall be covered or kept in covered containers located as close to the middle of the property as practicable in order to reduce odors. Composted material shall originate on-site or shall be provided by active members of the community garden. No other off-site material shall be accepted for composting at the community garden.
E. 
Community gardens shall be closed from sundown until sunrise.
F. 
Community gardens may include unlit monument signs subject to approval of a sign permit and the provisions of Chapter 17.190.
G. 
Community gardens shall display a sign at the entrance which provides the name and phone number of a person responsible for maintaining the garden and responding to complaints.
H. 
Non-compliance with these regulations constitutes a public nuisance pursuant to the provisions of Chapter 1.16 of the El Cajon Municipal Code.

§ 17.205.110 Agricultural buildings.

Accessory structures, used for the housing of animals, shall be located as described in this chapter. Green-houses and agricultural buildings shall be subject to the same location and area restrictions applicable to other accessory structures permitted in residential zones.
