CHAPTER XI

ADMINISTRATION

§ 11.01 Zoning official.

The planning and zoning commission consists of five (5) members, which shall be appointed by the mayor and approved by the city council. There shall be a chairman of the planning and zoning commission who is elected by the members of the planning and zoning commission. This elected chairman shall be the zoning official of the planning and zoning commission.
The zoning official shall, in connection with his office, have authority to perform the following:
(1) 
Appear on behalf of the city in all public hearings before the board of adjustment and present facts and information to assist the board of adjustment.
(2) 
Review and prepare a report on all applications for amendment of applications of development plans submitted to the city. The completed report shall be forwarded to the submitter within fourteen (14) days after receiving the development plans. The report should have the concurrence of the planning and zoning commission.

§ 11.02 Planning and zoning commission.

The planning and zoning commission consists of five (5) members and first and second alternate members which shall be appointed by the mayor and approved by the city council. The terms of office of the regular and alternate members of the commission shall be two (2) years, concurrent with the term of the mayor.

§ 11.03 Duties and authority of planning and zoning commission.

(1) 
Post notice of meetings three (3) days in advance of meeting.
(2) 
A public hearing notice shall be posted fifteen (15) days in advance.
(3) 
Keep and maintain official zoning maps.
(4) 
Establish and administer rules and regulations, not inconsistent with law, in order to carry out the provisions of this ordinance and to establish regular forms and records.
(5) 
Maintain a record of all action taken in connection with their duties of this ordinance.
(6) 
Review development plans submitted to the city and make any needed recommendations so that the plans are in compliance with this ordinance.

§ 11.04 Enforcement authority.

It shall be the duty of the city council when requested by the building official or the zoning official and when the facts warrant, to institute such legal proceedings as may be advisable to enforce compliance with this ordinance.
